About this file
This document is a solicitation for the replacement of the hydraulic system for Penstock #5 at Amistad Dam, issued by the United States Section of the International Boundary and Water Commission (USIBWC). The project involves fully inspecting and restoring the penstock's functionality, with work including site preparation, system and structural inspection, hydraulic system replacement, debris disposal, quality control testing, and potentially manufacturing a new penstock bulkhead. The construction site is located in Val Verde County, Texas, with specific constraints including limited working hours (7:00 am to 3:30 pm, Monday through Friday), restricted access through a port of entry, and load limitations on roads and dam infrastructure.
The project is estimated to be valued between $1,000,000 and $5,000,000, with a total contract duration of 485 calendar days (365 days for construction and 120 days for closeout paperwork). The solicitation will be issued under Federal Acquisition Regulation (FAR) Part 14, with a firm-fixed price contract under NAICS Code 237990. Key technical requirements include replacing the hydraulic system, inspecting all systems and structures, and potentially creating a new bulkhead weighing approximately 33,000 pounds. Contractors must provide their own crane and certified operator, coordinate with the Amistad Dam Area Operations Manager, and comply with specific site access and operational restrictions.

1.6.E. The Bidder shall take no advantage of any item of which they have a duty to inquire.
1.7. INVESTIGATION OF SITE CONDITIONS
1.7.A. The Bidder, as well as their subcontractors, is urged to visit the worksite and project area to become fully aware as to the existing conditions affecting the work to be performed under the Contract documents. A site visit will be announced during the solicitation. Each Bidder shall attend at their own expense. The
Government will not pay for any site visits. This visit is intended to provide the potential Bidders the opportunity to observe site conditions and incorporate into their proposal any required work based on site conditions. The Bidder will have the opportunity to walk around during the site visit. Unless otherwise noted, no other opportunity will exist for visits to the site.
1.7.B. The Bidder shall be responsible for ensuring that all of its suppliers, manufactures and subcontractors have reviewed all applicable Contract documents relative to their work. The Bidder shall provide all labor, material, equipment, and services not provided by the Bidder’s suppliers, manufacturers, fabricators, and/or subcontractors but required for complete and operable facilities as described in the
Contract documents.
1.7.C. Bidder has the sole responsibility to make such independent investigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in accordance with the SOW.
1.7.D. The Government assumes no responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of the Bidder's officers or agents before the execution of this Contract, unless that understanding or representation is expressly stated in the Contract documents.
1.7.E. Any failure of the Bidder to take the actions described and acknowledged in this Section will not relieve the Bidder from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work.
April 7, 2025 Instructions to Bidders USIBWC Solicitation 191BWC25B0003 00.21.13-Page 3
1.8. BID ITEMS
1.8.A. The Contract Line Item Numbers (CLIN) that shall be bid upon are identified in Section B (bid schedule) of the Solicitation.
1.8.B. The Bidder shall include all work related costs within its bid unit prices even if not specifically listed in the bid schedule.
1.8.C. If an error exists on the bid schedule between the CLIN total cost provided and the resultant value of the
CLIN quantity multiplied by the bid unit price, the bid unit price provided shall govern.
1.8.D. If the bid schedule includes CLINs entitled Receiving Lines, No Cost Receiving Lines, No Cost
Receiving Lines for IBWC Use Only, Receiving Lines for Internal Use Only, or similarly, then the Bidder shall not provide a bid price for this CLIN. Receiving lines are used for USIBWC's computer system to make pay estimate processing easier. These are an administrative CLIN and have no value on the
Contract.
1.9. SPECIFICATIONS
1.9.A. The Government does not implicitly warrant performance specifications for complete accuracy or adequacy. Typical performance type specifications set forth an objective or standard to be achieved, and the successful Bidder is expected to exercise their ingenuity in achieving that objective or standard of performance, selecting the means and assuming a corresponding responsibility for that selection.
1.9.B. When a particular product or manufacturer is identified by name, but permits substitution of ‘an approved equal,’ such a specification is ‘performance’ in nature and, as a result, carries no implied warranty.
1.9.C. The Technical Specifications are written in imperative and abbreviated form. This imperative language is directed at the Contractor, unless specifically noted otherwise. Incomplete sentences shall be completed by inserting "shall", "the Contractor shall", and "shall be" or similar mandatory phrases by inference in the same manner as they are applied to notes on the Contract Drawings. The words "shall" are to be placed by inference where a colon (:) is used within sentences or phrases. Except as worded to the contrary, the Contractor shall fulfill (perform) all indicated requirements whether stated imperatively or otherwise.
1.9.D. All equipment and facilities shall be furnished, installed, and constructed by the Contractor to provide the
Government with complete, ready to use components, systems, and facilities. All necessary materials and work required to accomplish this are the responsibility of the Contractor alone, whether or not specifically indicated on the Contract Drawings or stated in the Technical Specifications.
1.9.E. The various Sections of the Technical Specifications may contain references to standards, other specification sections, or items that do not apply to the work covered in this project. These references are to be considered for information only and can be ignored by the Contractor unless work changes and they become relevant. If conflicts arise from references or lack of references to standards or other specification sections, COR will determine the relevancy of the apparent conflicts.
1.10. BID SUBMISSION
1.10.A. Submission of a bid shall be conclusive evidence that the Bidder has reviewed, investigated, and acknowledged all items detailed in FAR 52.236-3 and listed below.
1. Conditions bearing upon transportation, disposal, handling, and storage of materials.
2. The availability of labor, water, electric power, and roads.
3. Uncertainties of weather and similar physical conditions at the site.
4. The conformation and conditions of the ground.
5. The security and safety conditions at and around the site.
6. The character of equipment and facilities needed preliminary to and during work performance.
Instructions to Bidders April 7, 2025 00.21.13-Page 4 USIBWC Solicitation 191BWC25B0003
1.10.B. Submission of a bid shall be conclusive evidence that the Bidder has reviewed all Contract documents.
1.10.C. Submission of a bid shall be conclusive evidence that the Bidder has investigated and is satisfied as to the conditions to be encountered, the character, quality, and scope of work to be performed, and the quantities of materials to be furnished.
1.10.D. Submission of a bid constitutes agreement that Bidder has provided written notice of all discrepancies, omissions, conflicts, defects, errors, ambiguities, or items that are open to interpretation discovered in the
Contract documents, that responses to these written notices are acceptable to Bidder, and that Contract documents are sufficient to indicate and convey understanding of all terms and conditions for performing and furnishing required work.
1.10.E. Bidder has the sole responsibility to make such independent instigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in accordance with the Contract documents. The
Government will not award a modification or additional funds for conditions that were observable but not considered by Bidder.

1.5. EXISTING STRUCTURES
1.5.A. Amistad Dam is the largest of the international multipurpose storage dams to be constructed on the Rio
Grande by the United States and Mexico, in accordance with the 1944 Water Treaty between the two countries. The dam is operated and maintained jointly by the United States and Mexican Sections of the
IBWC. Amistad Dam provides important flood control, water conservation, recreation, and electrical power production benefits. The Amistad Reservoir and Dam Project is located in Val Verde County, Texas and the State of Coahuila, Mexico, with the dam approximately 12.8 miles northwest of Del Rio, TX.
Construction started on December 1964 and was completed in June 1969.
1.5.B. Penstock #5 was originally designed to be a "dual gated" 15 foot irrigation outlet (penstock). Both gates were designed as tractor (cable operated) gates and weigh 48,000 pounds each. The dual gates are generally referred to as the penstock gate (aka head gate or upstream penstock gate) and the irrigation gate (aka operating or downstream penstock gate) and are positioned approximately 10 feet apart. The gates can be hung in the Penstock Service Bay which is 190 feet above their operating positions.
1.5.C. During construction, the irrigation (downstream) gate was replaced with a hydraulic slide gate. The penstock gate (upstream/head gate) was left as originally designed and is currently in the up (or open) position. Upstream of both Penstock #5 gates is a bulkhead gate slot.
1.5.D. The irrigation gate was in the closed position between approximately 2010 and 2018. In 2010 the following observations were made during the last, unsuccessful attempt to operate the gate:
1. Hydraulic Operating System
a. The hydraulic gate pump was completely operational and quickly built adequate pressure to the control valve.
b. When the control valve was moved to the open gate position, the hydraulic fluid was heard feeding the hydraulic feed lines; however pressure was quickly lost.
Existing Condition Information April 7, 2025 00.31.19-Page 4 USIBWC Solicitation 191BWC25B0003
c. Visual observation down the gate slot (maybe 40-50 feet down the slot) indicated a spray of hydraulic fluid being lost from the feed lines.
d. There was no indication of gate movement, probably due to the loss of hydraulic pressure.
2. Hydraulic Gate
a. The last time the gate was physically inspected is believed to be in the 1980's.
b. Access to the back side of the gate (downstream side) is 190 foot down the 4 foot by 24 foot penstock gate slot and through an approximate 2.5 foot opening behind the gate.
c. The current physical condition of the gate (wear, corrosion, etc.) is unknown.
d. Similarly the physical condition of the concrete portion of the penstock where the gate frame is embedded in the concrete, as well as that of the concrete/penstock liner interface is unknown.
e. The hydraulic gate was known to have a "chatter" problem at certain gate openings: and during normal operations in 1998 it was reported that the gate would "bleed off" and would not hold a gate opening.
f. The hydraulic gate is framed (and seals) to the upstream side of the penstock concrete.
1.5.E. In 2018 a contract was issued to repair the hydraulic lines. Work included removing and disposing of existing pipe connected to the cylinder on Penstock #5 and installing new ¾ inch 316 stainless steel, socket welded pipe and clamps. Following the replacement of the piping, the irrigation gate was lifted successfully, but the system would not generate sufficient pressure to lower the gate.
1.5.F. In 2019 a new hydraulic motor was installed.
