About this file
This is a Procurement Preferences form issued by the Office of Economic and Small Business Development for Broward County, Florida, related to a solicitation for management of the Airport Rental Car Center Fueling Facility at Fort Lauderdale-Hollywood International Airport. The form outlines eligibility criteria for Small Business Enterprises (SBEs) and County Business Enterprises (CBEs) seeking procurement preferences under Broward County Code of Ordinances Section 1-81 et seq. Vendors responding to non-reserved solicitations without assigned CBE goals may qualify for preference consideration if they hold current Broward County SBE or CBE certification at the time of solicitation opening.
The procurement preference structure differs based on solicitation type: for Invitations to Bid and Quotation Requests, a certified SBE or CBE within ten percent of the lowest responsive and responsible bid may match that bid for award consideration; for Requests for Proposals, a responsive and responsible SBE or CBE proposer scoring within five percent of the highest-ranked non-certified proposer shall be elevated to highest-ranked status and proceed to contract negotiations. Vendors must certify their SBE and/or CBE status on the form and meet certification requirements at the time of solicitation opening. The document specifies that certification will be verified through the Broward County OESBD Certified Firm Directory, and vendors should contact the Office of Economic and Small Business Development at 954-357-6400 for certification inquiries. Additionally, the solicitation notes that effective September 30, 2026, Florida House Bill 433 will prohibit local Living Wage and Prevailing Wage Ordinance requirements from applying to contract awards issued after that date, requiring vendors to submit pricing excluding Living Wage Ordinance costs for evaluation purposes.

OFFICE OF ECONOMIC AND SMALL BUSINESS DEVELOPMENT REQUIREMENTS
PROCUREMENT PREFERENCES FOR SMALL BUSINESS ENTERPRISES (SBE) AND COUNTY BUSINESS ENTERPRISES (CBE)
This form should be returned with the Vendor’s submittal and will be used for informational purposes.
In accordance with Section 1-81.10, of the Broward County Business Opportunity Act, Section 1-81 et seq. of the Broward County Code of Ordinances, (the “Act”), non-reserved solicitations (for certified Small Business Enterprises (SBEs) or County Business Enterprises (CBEs)), and solicitations without any assigned CBE goals, a responding Broward County certified SBE or CBE may be eligible for a procurement preference, in accordance with below:
For Invitations to Bid and Quotation Requests:
If a responsive, responsible bid is received from a certified CBE or SBE that is within ten percent (10%) of the lowest responsive, responsible bid received from a non-certified (SBE or CBE) Vendor, the SBE or CBE (as applicable) shall be offered the opportunity to match the lowest responsive, responsible bid. If the SBE or CBE Vendor (as applicable) is responsive and responsible, and matches the lowest responsive, responsible bid, the CBE or SBE Vendor shall be recommended for award.
For Request for Proposals:
If upon the completion of final rankings by the Evaluation Committee, a non-certified proposer is the highest-ranked proposer, and a responsive, responsible SBE or CBE proposer receives a score that is within five percent (5%) of the score obtained by the non-certified proposer, the highest-ranked responsive, responsible SBE or CBE proposer shall be considered the highest-ranked proposer and shall have the opportunity to proceed to negotiations with the County for award of the contract.
Vendor should indicate below if the Vendor is currently certified Broward County SBE and/or CBE . If the Vendor does not indicate it is an SBE or CBE, preference may not be applied based on information received but certification will be verified in the Broward County OESBD Certified Firm Directory.
