About this file

This is a Permitting Assessment Form (PAF) completed by the National Park Service Denver Service Center for a riverbank stabilization project at Cuyahoga Valley National Park (CUVA Project 224822). The PAF identifies all required permits and regulatory compliance requirements necessary before construction solicitation and is part of the larger DSC permitting process that includes scoping, permit assignment, and acquisition of government-furnished permits prior to bid.

The project involves stabilizing the riverbank along the Towpath Trail near Mile Marker 20 at eight separate locations along the Cuyahoga River, affecting approximately one acre (125 ft x 300 ft). Key permits and compliance requirements identified as "Part of Project" include: Waters of the US and Wetlands permits (federal USACE Section 404/Section 10 and state Ohio EPA Section 401 Water Quality Certification); Floodplain Development Permits from both federal (FEMA) and local authorities; Navigable Waters permits (USACE and USCG coordination); Water Quality Certification (Section 401); NPDES Construction Stormwater Permit (federal and state authority); and Local Notice to Mariners coordination with USCG District 9. The site is located within the Buffalo Regulatory District and the regulated floodway and 100-year floodplain of the Cuyahoga River. Compliance with Executive Order 11988 on floodplain management is required. The assessment confirms the site is completely on NPS land under concurrent jurisdiction and identifies no federally listed species requiring incidental take permits, though seasonal tree-cutting restrictions are recommended for Indiana bat and northern long-eared bat protection. Private utilities exist within site boundaries, and the Towpath Trail itself is listed on the National Register of Historic Places with a portion designated as a National Historic Landmark. The DB Contractor is required to confirm all assessment information and submit verification at the first design deliverable.

Read Me The Permitting Assessment form (PAF) is part of a larger Denver Service Center (DSC) permitting process, which consists of Scoping all required permits (PAF); Generating a list of required permits; Assigning permits to be either Government Furnished, Contractor Provided, or Park Acquired; Planning a clear path to acquire each Government Furnished Permits (Permit Plan Form); Develop complete and acceptable applications; and Acquire Government Furnished Permits prior to solicitation.

This workbook contains 4 tabs (worksheets):

1. Read Me - Current worksheet.

2. Form - Blank and used to complete the Permitting Assessment.

3. References - Links to web pages with additional information.

Questions Examining Jurisdiction - Who needs to be involved?
Is the site COMPLETELY on NPS land?Yes
What is the classification of the jurisdiction for the Park at the site? See RM39-1, pg. 9. 1Concurrent (a blend)Source: Summit County Parcel Data (DBC to Verify)
Has the site's jurisdiction been DOCUMENTED?Yes
Questions regarding circumstances that might give an agency jurisdiction at a site.
Is there standing water on site?YesProject will occur on either left or right bank of Cuyahoga River at eight (8) separate locations.
Are there water channels on site?YesThe Cuyahoga River is part of the project.
Is there any known local jurisdiction on the site?YesSee notes on jurisdictional assessment below.
Have the site's structures been reviewed? (levees, utilities, etc.)?YesThe Towpath Trail is a linear historic districts listed on the NRHP and a portion of which is a National Historic Landmark. No other structures have been identified. Site survey has identified private utilities within site boundaries.

Notes on Jurisdictional Assessment: Project site/study area is approximatley one acre in size (125 ft x 300 ft) and will be finalized when access to project sites and buffers are confirmed. The site, including currently identified access and staging area and any associated other jurisidictions are:

Impacts to Resource Topics - Compliance Related
Not part of projectListed Species Incidental Take: Fish (NPS typically avoids incidental take)
Permit?Jurisdiction:AgencyLaw, regulation, etc.Permit Type:Requirements, Actions, Etc.:
NoFederal:NMFS and/or FWSESA § 95,7
NoState:Ohio DNROhio Revised Code 1531.25
NoLocal:------------Local jurisdiction typically does not apply to NPS for this topic
Basis of Decision: No federally listed fish species are within Cuyahoga or Summit Counties. The Ohio Department of Natural Resources lists 3 species of fish as threatened or endangered for Cuyahoga County and 5 species of fish as threatened of endangered for Summit County. The Cuyahoga River does not provide suitable habitat for any of the state-listed threatened or endangered fish species. Many of these species require clear glaciated lakes, relatively clear streams, or are closely associated with Lake Erie and its adjacent tributaries in northwest Ohio.
Not part of projectListed Species Incidental Take: Marine Mammals (NPS typically avoids incidental take)

NoFederal:USFWSESA § 95,7, MBTA8Selected contractor will be required to follow standard conservation measures for the Indiana and northern long-eared bat, piping plover, rufa red knot, and MBTA species. However, no incidental take permit will be required.
NoState:Ohio DNROhio Revised Code 1531.25
NoLocal:------------Local jurisdiction typically does not apply to NPS for this topic
Basis of Decision: There are two federally-listed endangered species (Indiana Bat and piping plover) and three federally-listed threatened species (northern long-eared bat, red knot, and northern wild monkshood) capable of potentially occurring in the project area. Incidental take (see Definitions below) of northern long-eared bat is prohibited if it occurs as a result of removing a known occupied maternity roost tree or removing trees within 150 feet of a know occupied maternity roost tree during the pup season from June 1 through July 31 or as a result of removing trees from within 0.25 mile of a hibernaculum at any time of the year. Indiana bat hibernate in caves and roost under loose tree bark on dead or drying trees during the summer. In order to mitigate effects on the species, seasonal restrictions on tree cutting are encouraged. Trees should only be cut when the species is hibernating or concentrated near its hibernacula. For project areas affecting Indiana bat swarming habitat (near hibernacula), only cut trees between November 15 and March 15. For project areas affecting the species' summer habitat, only cut trees between October 15 and March 31. Piping plover and rufa red knot prefer sparsely vegetated shorelines or intertidal mudflats to nest and forage. The Cuyahoga River lacks suitable habitat features for the two species. Northern wild monkshood is typically found on shaded to partially shaded cliffs, algific talus slopes, or on cool, streamside sites. The areas must have cool soil conditions, cold air drainage, or cold groundwater flowage. In Ohio, it is typically found on sandstone in cool, shaded ravines in close proximity to running water, seeps, talus slopes, rock shelters, or vertical cliff faces. The Ohio Department of Natural Resources lists 17 terrestrial species as either threatened or endangered in Cuyahoga County and28 species as either threatened or endangered in Summit County. Additionally the two counties collectively list 93 terrestrial species as either species of concern or of special interest.

NoLocal:--------Local jurisdiction typically does not apply to NPS for this topic
Basis of Decision: The project area is within the Buffalo Regulatory District. The Cuyahoga River is a navigable water and therefore would require coordination under Section 404 and Section 10. This coordination is concurrent for the Buffalo District. The type of permit needed is undetermined but notification will be required due to the Section 10 waters. An individual Section 401 Water Quality Certification from Ohio EPA will be needed. An application form per ORC section 6111.30(A) will be needed and all requirements of the Clean Water Act Section 401 Certification Rule followed. In addition, if discharge dredged or fill material into isolated wetlands occurs, an Isolated Wetland Permit from Ohio EPA would be required.
