This Amendment 0005 change revises the original text for Subpart 1.9 B. 3.

only. No other Subparts of this Section are revised as part of this change.

3. United States Army Corps of Engineers (USACE) 404 Permit for WORK in Deer Creek. The GOVERNMENT has worked with the USACE to determine that a Letter of Permission will be required and the application package has been submitted to the USACE in February 2021. The GOVERNMENT expects this permit to be issued prior to WORK in Deer Creek. Within 60 days of completion of siphon construction at Deer Creek, the contours of the stream channel shall be restored as close as possible to their original contour and conditions.

United States Army Corps of Engineers (USACE) Section 404 Permit for WORK in Deer Creek. The GOVERNMENT has received a Letter of Permission and it is provided as an attachment to this specification after the Permits flysheet. The CONTRACTOR shall comply with the conditions and requirements of the permit, including the following:

a. Within 60 days of completion of siphon construction at Deer Creek, the contours of the stream channel and adjacent upland areas within 50-feet shall be restored as close as possible to their original contour and conditions.

b. The GOVERNMENT shall employ a wetland scientist who is familiar with the project site, to continuously monitor all initial construction grading activities in the vicinity of waters of the United States to ensure against unauthorized activity during construction. This scientist shall educate the construction workers about the sensitivities of the wetlands on-site, and the rare species of the area before work begins. This monitor shall make random visits to the project site while the construction is occurring. The monitor shall ensure no unauthorized activities occur during project implementation, and that the project is constructed as designed. If unauthorized activities do occur into waters of the United States, the GOVERNMENT shall have the authority to stop work within waters of the United States immediately and notify the USACE at once.

c. Equipment. Heavy equipment working in wetlands or mudflats must be placed on mats or other measures must be taken to minimize soil disturbance.

d. Soil erosion and sediment controls. Appropriate soil erosion and sediment controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills, as well as any work below the ordinary high water mark or high tide line, must be permanently stabilized at the earliest practicable date. CONTRACTOR is encouraged to perform work within waters of the U.S. during periods of low-flow or no-flow.

e. Siphon installation. Trenches constructed must be backfilled and returned to pre-activity contours and elevations, During construction, the top 6-12 inches of topsoil must be removed and stockpiled separately. Following installation, the stockpiled topsoil will be replaced on top, and seeded with appropriate native vegetation. Material resulting from trench excavation may be temporarily sidecast into waters of the U.S for no more that three months, provided the material is not placed in such a manner that it may be dispersed by currents or other forces.
