Amendment 0005

Friant-Kern Canal Middle Reach Capacity Correction Project Phase 1 Offeror’s Questions and Answers

Question 1: Sheet C-22 depicts the Lower Tule River Turnout in the upper left corner. There is a detail callout for Sheet C-504 detail. There is no sheet C-504. Is this supposed to be C-505?

Response 1: Yes. This callout should be C-505. See revision in Dwg C-22 that was issued previously with Amendment 0004.

Question 2: Re: Spec Section 31-23-19-3.4-B “Dewatering Existing Canal” a. Reference is made to Hydraulic Profile Drawings GC-6 & GC-7 for existing canal invert and low spots. GC-6 show typical trench section and GC-7 was not included in the plans. – Please review and send out plans showing the Hydraulic Profile of the existing canal and low spots.

Response 2: The reference should be to drawings G-6 and G-7 NOT GC-6 and GC-7. See revision to specification Section 31 23 19-5 issued previously with Amendment 0004.

Question 3: Please define what CLINs you are expecting to see in the proposal in reference to “e) Work schedules and crew sizes including total labor hours for the applicable CLINs” on page L- 14 and “f) Work schedules and crew sizes including total labor hours for the applicable CLINs” on page L-15.

Response 3: Page L-14 for Factor 1B, 1. d) and e) provide the requested information pertaining to the following CLINS: DUST ABATEMENT AND MAINTENANCE OF HAUL ROADS

(CLINS 7 AND 8) CONSTRUCT NEW CANAL INCLUDING EXCAVATION AND

COMPACTING EMBANKMENTS (CLIN 12 THROUGH 20) OVEREXCAVATION FOR

CANAL AND STRUCTURES (CLIN 21) TRIMMING EARTH FOUNDATION FOR CANAL

LINING FOR NEW PARALLEL CANAL (CLINS 22 AND 23) 3.5-INCH THICK CONCRETE

CANAL LINING FOR NEW PARALLEL CANAL (CLINS 24 AND 25) Page L-15 for Factor 1B, 2. e) and f) provide the requested information pertaining to the following CLINS:

CONSTRUCT NEW CANAL TIE-INS TO EXISTING CANAL (CLINS 32 THROUGH 33)

CONSTRUCT NEW DEER CREEK CHECK STRUCTURE, WASTEWAY TURNOUT AND

SIPHON (CLIN 34) CONSTRUCT NEW SIPHON STRUCTURES (CLINS 35 THROUGH 41)

CONSTRUCT NEW TURNOUT STRUCTURES (CLINS 42 THROUGH 50) CONSTRUCT

IRRIGATION AND DRAINAGE SIPHON EXTENSIONS (CLINS 52 THROUGH 53)

Question 4: A Stoplog Schedule has been provided on Drawing GM-3. The Schedule states that the opening size for Weir Stoplogs is 7-1/2” W x 10’ H, and that 18 sets of Weir Stoplogs are to be furnished. The single weir box structure in the Bid Drawings contains two (2 each) stop log openings that are 10’ wide x 13’ high. Please update the Stoplog Schedule on Drawing GM-3 to reflect the correct opening size and quantity of stoplogs to be furnished.

Response 4: The stoplogs for 7 feet 1/2 inch wide by 10 feet high clear opening called out on GM-3 are for check structure weir stoplogs (see S-12 and S-26); not for weir box stoplogs. Note that there is a typo in the clear opening width for these stoplogs in equipment schedule table GM-

3. The width of each opening is 7’-1/2” not 7 ½”. Correction will be made to the drawing GM-3.

The weir box slots as shown on drawing S-37 do not require stoplogs under this contract.

Question 5: Regarding the Environmental Past Performance requested in Factor 2A on page L- 16, in Amendment 003 Response 8, BOR referenced that we should provide environmental past performance information in a spreadsheet. However, the requirement seems to be looking for a narrative “The offeror shall describe approach to working with the Government to meet environmental requirements. The offeror shall provide a description of no more than 3 projects completed with the last 15 years that demonstrate similarity to this solicitation.” Please confirm that BOR is looking for a narrative along with the PPI spreadsheet as it relates to environmental past performance for Factor 2A.

Response 5: Please see the revised Section L included in this Amendment which clarifies that environmental past performance is a subpart of the requirement's Factor 2B - Past Performance Narrative. The page limitation for the narrative has been increased from no more than three (3) pages to reflect no more than four (4) pages.

Question 6: The RFP requires under Section L (p. L-10) that the Offeror’s Proposal provide in Volume 1 “Business Proposal Contents”. Section M provides the Factors for the Evaluation of Proposals. Section M does not appear to indicate that Volume 1 will be evaluated or scored. Will Volume 1 be part of the evaluation and decision on whom to award or will only those Factors listed in Section M, Factor 1: Technical Approach, Factor 2: Past Performance, and Factor 3:

Price, be part of the evaluation and decision?

Response 6: Volume 1 “Business Proposal Contents” will be evaluated under Factor 3: price in Section M.

Question 7: Under Amendment 0002 - Response 6 to Question 6 stated “The Government will use the subcontractor’s System for Award Management (SAM) certification to determine the socioeconomic status of each firm in accordance with FAR 52.219-8, “Utilization of Small business Concerns.” Under FAR 52.219-8, “Utilization of Small Business Concerns.”, Section (d)

(1) states “The contractor may accept a subcontractor’s written representations of its size and socioeconomic status as a small business, small disadvantaged business, veteran-owned small business, service-disabled veteran-owned small business, or a women-owned small business if the subcontractor represent that the size and socioeconomic status representations with its offer are current, accurate, and complete as of the date of the offer for the subcontract.” and Section (d) (3) states “The Contractor may not require the use of SAM for the purposes of representing size or socioeconomic status in connection with a subcontract.” (See attached excerpted from FAR 52) If the contractor may accept a subcontractor’s written representation of its size and socioeconomic status and may not require the use of SAM for the purposes of representing size or socioeconomic status in connection with a subcontract, will certifications from local jurisdictions such as CDOT DBE UCP and CA DGS SBE and/or will “self-certifications” be accepted?

Response 7: self-certifications will be accepted.

Question 8: If bidding as a Joint Venture, should both company’s Cage Code, DUNS, TIN (Tax Identification Number), Business Size, information be listed where required?

Response 8: Yes.

Question 9: In Amendment 3 ~ Response 6 to Question 6 states “Section L, Page L-15 Note iii – One page is defined as a single side of an 8 1/2" by 11” paper in this note. A single side of an 11” x 17” paper is twice the size of the “one page” definition and will therefore be counted as two pates as it relates to this requirement”. BUT, on page L-14 under “Factor 1A – Construction Schedule”, the Format paragraph requires the schedule to be printed formatted so that it can be printable on a 11x17 sized paper. Since a 11”x17” format is required for the construction schedule, will the 11”x17” construction schedule pages count as the same page equivalent as one side of double-sided piece of 8.5”x11” paper as listed in the first paragraph on page L-10?

Example: Factor 1A-Construction Proposal submitted contains 15 pages formatted as 8.5”x11” sized paper and 10 pages formatted as 11”x17” sized paper. Would that meet the 25-page maximum allowed for Factor 1A – Construction Schedule

Response 9: Yes. The combined maximum total number of pages shall not exceed 25 pages.

Question 10: The Past Performance Questionnaire states that the reference is to return the form to the Contract Specialist no later than June 17, 2021, 2:00 pm PST which was the previous bid date. Now that the bid date is revised, will the completed Past Performance Questionnaires be accepted until the new proposals due date?

Response 10: The completed Past Performance Questionnaires will be accepted until 2:00 pm PST on July 14, 2021.

Question 11: WBR 1452.215-82 (d).(c),(1) requires an Executive Summary to be included in the Technical Proposal. Is there a page size requirement for the Executive Summary (i.e. can it be printed on 11x17)?

Response 11: Executive Summary shall be no more than 3 pages and printable on 8.5”x11” sized paper.

Question 13: Drawing GC-9 shows the O&M road on the West side of the canal is 16’ wide for the seal coated aggregate base. On the siphon drawings (Drawings C-203 thru C-209) and tie-in drawings (C-302 and C-304) the road width is shown 18’ and 20’ wide, respectively. Please clarify if the Seal Coated O&M Road is 16’ wide, 18’ wide or 20’ wide.

Response 13: Seal coat required is 16.0' per Dwg GC-9. See revised Dwgs: C-203, C-204, C-205, C-206, C-207, C-208, C-209, C-302, and C-304.

Question 14: Please refer to Specification Sections 05 50 00 and 35 22 57. Specification Section 05 50 00, paragraph 2.1.B indicates that the stop log guides are to be epoxy-coated steel.

Specification section 35 22 57, paragraph 2.1.G states that the stop log guides are to be aluminum.

Please clarify whether the stop log guides are to be epoxy-coated steel or aluminum.

Response 14: The stop log guides and sill plates shall be epoxy-coated steel per Section 05 50 00, paragraph 2.1B. See attached revisions to Section 35 22 57.

Question 15: Specification Section 03 32 00, Paragraph 1.6.A states “The Contractor shall furnish a 5-year written warranty of the entire sealant installation against faulty and/or incompatible materials and workmanship, together with a statement that the Contractor agrees to repair or replace, to the satisfaction of the Government, any defective areas which become evident within the 5-year period.” Given the known and continued subsidence of the ground in this area, please consider removing this warranty requirement. The cracks and failure of the sealant due to continued subsidence is an unknown and unquantifiable risk that the Government is asking the Contractor to bear.

Response 15: See revise Section 03 32 00-7 Amendment 0005.

Question 16: Drawing C-407 – DEID-68 Turnout Plan and Profile show an open cut construction crossing of Road 192. Please confirm it would be acceptable to bore Road 192 with a casing pipe, install the carrier pipe with centralizers and then grout the annulus.

Response 16: The County of Tulare has approved the design documents with this crossing shown as an open-cut crossing.

Question 17: Drawing CD-3 lists three ground water wells to be abandoned by station number.

Drawing C-40 shows a fourth well to be abandoned, not indicated on CD-3. Please confirm this well is to be abandoned by the Contractor. If this well is to be abandoned, please provide details for abandonment (diameter, depth, etc.).

Response 17: The well identified on C-40 needs to be abandoned per revised drawing CD-3

Question 18: Request the proposal due date be extended an additional two (2) weeks from the.

current due date of July 2, 2021.

Response 18: Previously issued Amendment 0004 extended the date and time for receipt of offers to July 14, 2021 at 1:00 p.m. PST

Question 19: Referencing GC-8, please clarify what width of the O&M road that would need to be provided if the Keynote “E” material on the West Bank of the existing canal was to be used for borrow. Keynote “J” calls for a 12’ O&M road but also refers to drawing GC-15 which calls for a 16’ wide O&M road.

Response 19: The O&M road on the west side of the existing canal shall have 12' of gravel base and seal coat per keynote "J". Note drawing GC-15 was updated previously in Amendment 0003.

Question 20: Siphon Section B on Dwg S-8 (and Section B on Dwg S-15) reflect an interior construction joint (type) at the interface of the siphon walls and the deck soffit. Contractor respectfully requests this joint be deemed an “optional” construction joint. Please advise if this is acceptable.

Response 20: The construction joints at the interface between siphon walls and top slab are required as shown on the plans.

Question 21: Regarding well abandonments on sheet 32 / plan CD-3. The following table below lists three total well abandonment to happen. Although on sheet 53 / plan C-40 there is a call out

(D) that lists a well abandonment at approximately station 5786+00. Can you please clarify the number of well abandonments there are?

Response 21: The well identified on C-40 needs to be abandoned per revised drawing CD-3

Question 22: Would the agency please identify which stations ground water is anticipated in the excavation of the new channel?

Response 22: Contractors make their own assessment of the groundwater conditions based on but not limited to the data contained in the Geotechnical Data Report.

Question 23: Section 01 14 00 at page 79 identifies Utility Relocation Work By Others and identifies the Relocation Schedule with a Month Ending Date identified. If this work by other is not completed by the applicable Month Ending Date identified, please confirm that the Contractor would be entitled to a compensable time extension.

Response 23: The situation described is a potential change to the Contract. Additional details available at the time of occurrence would be required to determine if there would be impacts of time and/or money to the contract.

Question 24: If unidentified utilities are encountered that require removal and/or relocation, and the work is performed by others (e.g. utility owner or its contractor) and not the Contractor as extra WORK under 01 50 10, 1.6 F., is the Contractor entitled to a compensable time extension for any delays caused by removal/relocation by others?

Response 24: The situation described is a potential change to the Contract. Additional details available at the time of occurrence would be required to determine if there would be impacts of time and/or money to the contract.

Question 25: Detail 5 on Drawing GC-13 shows anodes installed 5’-0” away each side of the pipeline. SID S1 PIPE and SID S2 PIPE have less than 4’ of spacing between the parallel runs.

Should the anodes be installed on the outside of each pipe and not in between them?

Response 25: The anodes shall be installed on outside of each pipe rather than between the two pipes. Refer to revised drawing GC-13 included with Amendment #5

Question 26: Detail 5 on Drawings GC-13 only shows two anodes, however there are a total of 20 anodes on SID S1 PIPE and 16 anodes on SID S2 PIPE. Are the anodes to be placed 5’-0” from the side of the pipe along the pipe alignment? If so, what is the spacing between the anodes?

Response 42: Revised Wage Determination for Tulare County included in this amendment.

Question 43: Please refer to contract drawing T-7, page 198 of 203. Note 6 on this drawing states that isolated pavement repairs are to be approved by Tulare County and Government prior to start work and the isolated repairs are incidental to the work. Considering the work shown on the drawings for the HMA overlay covers approximately 5 miles of roadway, the volume of isolated repairs could be substantial. In addition, a scope of the approved repairs (i.e. full depth removal and replacement, etc.) is not defined, nor quantifiable. Could an allowance bid item be added to the project to cover the cost of these repairs?

Response 43: Refer to revised drawing T-7 that provides clarification on the isolated pavement repairs as requested. An allowance bit item will not be added.

Question 44: Specification section 05 50 10, part 1.6.H, states that any utility encountered along the line of work shall remain continuously in service during all operations under this contract. If an unknown utility is discovered in conflict with the features of the canal, such as an irrigation line, will the contractor be responsible to relocate unknown utilities in conflict with the work?

Response 44: The inquiry has cited the specification section incorrectly, and the inquiry will be addressed considering Section 01 50 10. Discovery of an unknown utility when potholing or during excavation work etc. will be addressed on a case by case basis. Relocation, abandonment, modification, or other suitable corrective action will be determined after the Contracting Officer or their representative has been notified.

Question 45: Specification section 01 29 00 part 1.13.B states “…constitute full compensation for canal excavation, hauling materials to required embankments, applying water to moisture condition materials placed in embankments if required, placing the material in the embankment, scarifying of refill at the top of the lining, refilling the additional excavation between the bottom of the excavation required and the line depth needed, excavating…”. The underlined part of that statement seems to be in conflict with part 1.14 “Overexcavation for canal and structures.” Please clarify where any “excavation required to be over excavated then refilled to the line needed” would not be paid under part 1.14?

Response 45: Overexcavation is to be paid for under part 1.14 (CLIN 21). The term refill used under part 1.13 (CLIN 12 through 20) is intended to refer to the top of lining refill work shown in Detail 1 on Draing GC-9.
