About this file
This is a Biobased/Sustainable Products Statement form required for federal contract performance under the Farm Security and Rural Investment Act of 2002 and the Energy Policy Act of 2005. The form mandates that contractors use biobased products to the extent that such products are reasonably available, meet agency or relevant industry performance standards, and are reasonably priced. Biobased products must fall within categories listed by the United States Department of Agriculture in 7 CFR part 3201, subpart B. Additional information regarding compliant products is available at http://sftool.gov/green-products/1/construction-materials.
The form requires contractors to select one of three options: certify that no biobased products are anticipated for the requirement at this time (while acknowledging the government's requirement and committing to provide updated forms if products become necessary during contract performance); propose the use of non-designated products with written justification; or identify specific biobased products, recycled-content products, environmentally preferable products and services, and non-ozone depleting substances to be acquired, used, and installed during contract performance. The form includes numbered spaces to list up to ten products and requires certification by an authorized company representative with signature and date. Failure to comply with biobased product requirements may result in penalties.
