About this file

This is a Performance Bond form for the City of St. George, Utah, related to the construction of Thunder Junction Park Phase 2, Inquiry No. 26-299. The bond serves as a guarantee that the selected contractor will perform all work, obligations, covenants, terms, conditions, and agreements outlined in the construction contract during the original term and any approved extensions, as well as throughout a one-year guaranty period following completion. The bond obligates the contractor and surety to satisfy all claims and demands under the contract, indemnify the City from costs and damages resulting from contract default, and reimburse the City for any expenses incurred in remedying such defaults. The surety waives notice of any changes, extensions, alterations, or additions to contract terms or work specifications and acknowledges that final settlement between the City and contractor does not limit the rights of any unsatisfied claimant under the bond.

The Performance Bond requires the surety company to be listed on the U.S. Treasury Department's current list (Circular 570 as amended) and authorized to transact business in Utah. The bond amount, to be specified in the penal sum section, corresponds to 100% of the contract value as required by the City's bid specifications. The bond must be executed by both the contractor (or all partners if a partnership) and the surety, with the bond date required to be on or after the contract date. This bond works in conjunction with the bid bond requirement of 5% of the bid amount, also mandated for this project.
