About this file

This is an FTA Certifications and Assurances document issued by the Arizona Department of Transportation (ADOT) for the On Call Transit Consultant Services solicitation (BPM007068). The document pertains to Fiscal Year 2025 and establishes the federal compliance requirements for contractors and consultants selected to provide multimodal transit consulting services across six primary disciplines: Transit Planning Studies, Transit Planning Tasks, Transit Operations Planning, Transit Operations Tasks, Strategic Planning, and Coordination and Mobility Management Projects. The contract will be performed on an as-needed basis through individual task assignments over an initial twelve-month term with potential extension up to forty-eight months total. Proposals are due by September 10, 2025. The solicitation establishes multiple contracts to support diverse transit-related entities, particularly focusing on rural and small urban transit services, transportation for elderly and disabled populations, and transit planning initiatives.

The document requires all awarded contractors, consultants, and subcontractors to certify compliance with Federal Transit Administration certifications and assurances pursuant to 49 U.S.C. 5323(n). Contractors must individually assure and take all measures to ensure that contract performance will not hinder or invalidate ADOT's certifications and assurances made to FTA. Failure to comply with these requirements results in contract cancellation. The contract is funded through federal transit programs including FTA Sections 5311, 5310, and 5305. Reimbursement will be based on hourly rates for actual work performed, with each task assignment detailing specific scopes of work, deliverables, and performance metrics. The solicitation establishes a 0.00% Disadvantaged Business Enterprise (DBE) contract goal, though DBE participation is encouraged. Eligible respondents include federally recognized tribal agencies, councils of governments, metropolitan planning organizations, non-profits, local governments, and transit authorities. AECOM Technical Services, Inc., represented by Jennifer Bixby, PE, PTOE, Vice President, is identified as the awarded contractor on this certification document.

SOLICITATION NO: BPM007068 Available online at https://appstate.az.gov/

Rev. 09/2022

Federal Transit Administration (FTA) Certifications and Assurances Fiscal Year 2025

Pursuant to 49 U.S.C. 5323(n), the Federal Transit Administration (FTA) consolidated certifications and assurances required by Federal law or regulations for its programs. On an annual basis, any agency with an active FTA capital or formula project must agree to comply with all categories applicable to its funding. It is the Department’s responsibility, as the applicant of FTA funds, to certify on behalf of its subrecipients, consultants, contractors, or other third parties, and to assure compliance with those certifications.

The Department herein notifies, and requires assurance from the awarded Contractor/Consultant and each SubContractor/SubConsultant that it shall individually assure and take all measures to ensure that performance under this Agreement/Contract shall not, in any way, hinder or invalidate the Department’s certifications and assurances made to FTA.

Such notification and agreement shall occur each time FTA issues new certifications and assurances, subsequent to each occurrence of the Department’s assurance to FTA. Assurance and compliance with this is mandatory and a prerequisite for performing any work under this Agreement/Contract. Failure to make such agreement and assurance shall result in cancellation of the Agreement/Contract. The relevant certifications and assurances made by the Department are indicated on the attached Affirmation page.

BY SIGNING BELOW, on behalf of the awarded Contractor/Consultant/SubContractor/SubConsultant, and under the criminal provisions of 18 U.S.C. 1001 and Program Fraud Civil Remedies Act of 1986, 31 U.S.C. 3801 et seq., I declare that it has duly authorized me to make this Certification and Assurance and bind its compliance.

Thus, it agrees to assure and take all measures to ensure that performance under this Agreement/Contract shall not in any way hinder or invalidate the Arizona Department of Transportation’s Certifications and Assurances made to the Federal Transit Administration. By Signing Below, the Contractor/Consultant/SubContractor/SubConsultant agrees to indemnify and hold the State, its agents and employees, harmless from any claims or causes of action relating to the State’s action based upon reliance on the above representations, including the payment of all costs and attorney fees incurred by the State in defending such an action.
