SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
AMENDMENT 02
A. The purpose of this amendment is to;
1. Add FAR Cluase 52.204-25, Prohibition on Contracting for Certain Telecommunication and
Videio Surveillance Services or Equipment by full text.
2. Revise PWS and Addendum to FAR 52.212-1 and 52.212-2.
3. Response to the questions as below;
Q1) Korea Ministry of Land, Infrastructure and Transport has been promoting for many company have 시설물관리업(Building/Facilities Maintenance) convert their business item category from 시설물관리업 to just General Construction Business Registration
(종합전문건설업) from last July 2021. Please find the attached file and link below.
https://www.molit.go.kr/USR/NEWS/m_71/dtl.jsp?id=95085740
As you can see, existing Building/Facilities Maintenance businesses can convert its business item category to just General construction business and with only General construction business, the company can still do the facilities maintenance business.
For that reason, our company requested the conversion in July 2021 and we got 'General Construction Business' and when we worked with maintenance work, we didn't need to have facilities maintenance business item category anymore.
So, my question is if we have only General Construction Business (certification), can we still get approval that we have the right certificate for this bidding?
A1) See revised para 2.1 of PWS, Addendum to FAR 52.212-1 and 52.212-2.
Q2) We saw the modification W91QVN-22-R-0001-0001 answer the following question:
“Regarding this solicitation, the newly awarded prime contractor shall not have a subcontractor?” Answer: There is no prohibition on use of subcontractors, subject to compliance to other terms and conditions in the solicitation. Does this mean we can propose the subcontractor's engineers (manpower) when we bid? We have many engineers in each category but we also have many subcontractors, so we'd like to know if we can propose subcontractor's instead of our manpower.
A2) There is no prohibition on using subcontractors. See revised Para 2.1.2.1. Performance of work by the contractor of PWS.
Q3) Certification : General Construction Business Registration instead of Construction Business
Registration with Building/Facilities Maintenance (건설업등록증에 시설물유지관리업이
따로 표기되어 있지 않지만 시설물유지관리업을 할 수 있는 종합건설면허를 가지고 있어
이것만으로 입찰 자격이 되는지)
Our company has many professional Registration and one of them is "General Construction
Business Registration (종합전문 건설업등록증)" which allows us to work in the business area of Building/Facilities Maintenance (시설물유지관리업).
In other word, when we propose that LH, Korean Government issue to work in case of
Building/Facilities Maintenance (시설물유지관리업), we only submitted "General Construction
Business Registration (종합전문 건설업등록증)".
In that reason, on the General Construction Business Registration didn't written additional
Building/Facilities Maintenance (시설물유지관리업).
A3) See answer A1.
Q4) Even if the Prime contractor doesn't have all the certificates, generally most multiple-job contracts allow for contractors to perform as a consortium with more than two subcontractors (in my experience). But I saw the line in the solicitation like these: The experience of a subcontractor cannot be substituted for the prime contractor’s experience, the business registration and permission of a subcontractor cannot be substituted for the prime contractor’s business registration and permission. But, Also I can see the amendment line like this: Answer the following question: “Regarding this solicitation, the newly awarded prime contractor shall not have a subcontractor?” Answer: There is no prohibition on use of subcontractors, subject to compliance to other terms and conditions in the solicitation.
I was a little confused. Because if a Prime contractor should propose their own certificates and past performance, after award, they should do the work with their own staff?
What if the subcontractors don't have qualified past work experiences and business certificates or the staff doesn't have similar work experiences or licenses? It sounds a little ironic to me.
My first question is here. Is it fine if I'm understanding the amendment line like this; Prime contractors can propose a staffing plan including subcontractor's staff in case of the future award situation?
Please advise me so I can make a decision on how I should make a staffing plan at this time.
A4) Prior experience and business registration shall not be substituted for the prime contractors prior experience and business registration except for CCTV maintenance requirement. See revised Addendum to FAR 52.212-1 and FAR 52.212-2.
Q5) I also want to talk about one of technical subfactors (2); Prime Contractor's Business
Registration and Permission - Construction Business Registration (건설업등록증) for the business item category of Building/Facilities Maintenance (시설물유지관리업) in accordance with the Article 9 of ROK Law "Framework Act on Construction Industry" (건설산업기본법).
As you may know, Korean Ministry of Land, Infrastructure and Transport addressed that
Building/Facilities Maintenance (시설물유지관리업) will be abolished by 2023.
So, if any company want to keep their Building/Facilities Maintenance (시설물유지관리업), they should convert the high business category as a General Construction Business.
For this reason, my next question is here.
If a company have a General Construction Business, the company can be evaluated as the same condition of having certificate the Construction Business Registration (건설업등록증) for the business item category of Building/Facilities Maintenance (시설물유지관리업) in accordance with the Article 9 of ROK Law "Framework Act on Construction Industry" (건설산업기본법)?
A5) See answer A1.
Q6) Lastly, about the required certificates at each work area. For example It seems 'facilities maintenance work' requires Construction Business Registration (건설업등록증) for the business item category of Building/Facilities Maintenance (시설물유지관리업) in accordance with the
Article 9 of ROK Law Framework Act on Construction Industry (건설산업기본법), 'HVAC/Electrical work' requires Electric Work Business registration (전기공사업등록증) in accordance with the “Electric Work Business Act (전기시공업), Article 4, Para 1 of the ROK
Law and 'Custodial/Cleaning Service' requires Public Sanitation Control Business Permission
(위생관리용역업신고).
Then how so, CCTV work does not require any certificate at all? In General, the CCTV PM work is also quite an expertise area.
If this Military Family Housing, Osan AB, ROK (No. W91QVN22R0001) need a expertised company to conduct all the work required, I think the business registration certificate for
“Information and Communication Construction Business (정보통신 공사업 등록증)” is required as well.
So, my last question is, in order to work with expertised company at CCTV PM work, don't think
“Information and Communication Construction Business (정보통신 공사업 등록증)” should be needed as well?
A6) See revised Para 2.1, 2.2.9, 5.8 of PWS, Addendum to FAR 52.212-1 and 52.212-2.
Q7) With regard to the Public Sanitation Control Business Permission, We would like to ask a question as the belows.
Q7-1) Can the prime contractor form a joint venture with a partner company who has Public Sanitation Control Business Permission to bid?
A7-1) There is no prohibition on creation of joint ventures. A joint venture must have a single DUNS and business registration and operate as a single business entity.
Q7-2) If No. 1 above is not allowed, can the Government allow the Public Sanitation Control Business Permission to be submitted by contractors before the start of Phase-In, considering the short bid preparation period?
Because it doesn't have enough time to apply and get permission.
A7-2) Offeror shall submit required registration and permission when submitting proposal.
Q8) Related to CCTV Maintenance, There is no Paragraph 5.10. On Demand Maintenance Threshold (DMT) Operation Procedure and check if there are any free replacement items. also need to clarify the installation date for the replace cycle of some parts.
A8) See revised para 5.8 of PWS.
Q9) We saw that the generator and oil tank were in the outside mechanical area. Please check whether the generator and oil tank maintenance are within the SOW.
A9) See Appendix 5. Generator maintenance is not required. However, fuel tank requires service.
Q10) Please provide a list of any other contractors related to the family housing.
For example, pest control, fire alarm system, or fuel oil (Gas) maintenance contract etc.
A10) Any type of work outside this PWS is not required for contractor to perform.
Q11) Please clarify the size of MERV 8 filter unit size again. Because it's not the size that we can get them. APPENDIX12 - HVAC Filter List
A11) See Appendix 12 - HVAC Filter List. Some filters may be customized or tailors as needed.
Q12) In the solicitation it indicates that ‘Appendix 8. MAPS’ will be distributed at site orientation. Will there be any chance for the offerors who did not participate the site view, to get the documentation?
A12) Appendix 8 is not releasable to the public and will only be available to the awardee.
Q13) Shall the prime offeror be required to have the same or similar performance experience based on size, scope, complexity within the past five (5) years from the date of this solicitation issuance to meet the solicited qualification criteria?
A13) See Addendum to FAR 52.212-1, Subfactor (1) Prime Contractor’s Prior Experience.
Q14) Could you possibly provide monetary information for offerors that how much the incumbent contractor has procured off-shore and domestic materials with dollar and/or KRW amounts for the past three (3) years for the contract performances.
We would like to kindly request for such historical data and information to prepare a material cost in our price proposal, which would be the biggest portion of the expense in contract performance.
A14) See Appendix 1, Historical Workload Data.
Q15) In the previous solicitation (W91QVN-16-R-0026), the required number of workers was specified under Subfactor 3-Personnel Qualification. However, this solicitation did not set forth the required number of personnel. Could you clarify how many workers on each position under the Subfactor (3) Key Personnel Qualification?
A15) Offeror shall propose number of personnel to accomplish timely service in accordance with
PWS.
Q16) According to the solicitation, the Government does not require a Heating Mechanic with a license of Craftsman Boiler (보일러기능사) even though it was required in the previous solicitation. Do you mean that the contractor's personnel would perform a boiler inspection task without a license of Craftsman Boiler (보일러기능사)?
A16) See revised Para 2.2.5 of PWS, Addendum to FAR 52.212-1 and 52.212-2.
Q17) The Government stated that “there is no prohibition on use of subcontractors, subject to compliance to other terms and conditions in the solicitation” in the Amendment 0001. Can the contractor hire a subcontractor that will perform 100% of the contract on a turn-key basis?
A17) There is no prohibition on using subcontractors. See revised Para 2.1.2.1. Performance of work by the contractor of PWS.
Q18) We found there is no specific requirement for CCTV 'Maintenance' at PWS.
As you might know, there is CCTV Maintenance description at 5.8.(5.8.1) of PWS and it says "Maintenance" not Preventive Maintenance. So, we'd like to know what the specific meaning of Maintenance is. Also, the CCTV Item CLIN Unit is Month, it means monthly checking or inspection of all the CCTV cameras, DVRs and UPS? In that case, It would be much clearer for us to work if we can get the inspection/checking standard and checking list for the "CCTV Maintenance". (I think since there is missing Appendix 8 at SAM site, maybe the Appendix 8 would be about the CCTV. I'm just guessing)
A18) See revised Para 2.1, 2.2.9, and 5.8 of PWS. Appendix 8 is Map. See Appendix 13. CCTV.
Q19) We found that there is no hourly labor rate for technicians working on the major repair.
Should the contractor be required to provide the major repair services without the Government's payment for labor charges based on hourly labor rates for technicians?
A19) Labor rates on major repair shall be covered under CLIN X009.

Price must include all CLINs as listed on the Price Schedule. The Government intends to evaluate proposals and award a contract without discussions.
Therefore, Offerors are instructed that the offeror’s initial proposals should contain their best pricing.
FAR Clause 52.217-8 Option to Extend Services. As part of price evaluation, the Government will evaluate its option to extend services (FAR Clause 52.217-8 - Option to Extend Services) by adding one-half of the Offeror’s final option period prices to the Offeror’s total price. Thus, the Offeror’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option, 4th option, and one-half of the 4th option. Offerors are required only to price the base and four (4) options. Offerors shall not submit a price for the potential one-half year extension of services period.

In addition to the information provided by the offeror, the Government may evaluate past performance information gathered from any reasonable source available, including Government personnel or Government data in order to evaluate past performance.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or neutral) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered "acceptable".
