SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been modified:

Prior RFIs are answered in Amendments 0001-0003.

Amendment 0005:

44. Specification 01 11 00, 1.11.7: Please confirm that the gas main contractor will be complete prior to the start of this project.

The gas main contractor may not be done before the water line project begins. It is assumed that all work on Route 17 will have been completed but the work on Route 68 and the gas main extension on Maiden Lane and Pickett lane will not be completed before the start of the water line project.

On 17 July 2018 a representative of the gas company provided the following information – “The intersection of Rte 17 and Rte 68 will be completed tonight and in about 1 week they will be past Talcott Ridge Rd in Middletown. We do have a new business project off the 16” line on Maiden Lane and Pickett Lane to serve the high school and Korn School in 2019. Rte 68 between Rte 17 and the skating pond (and further west) will be phase 3 work in 2019. We have installed a stub halfway across the intersection of Rte 17 and Rte 68 to continue our phase 3 work in 2019.”

45. Please provide as-built or plan drawings of the location of the new gas line.

As of now, we do not have as-built drawings. A representative of the gas company provided the following information – “We should be able to provide you with GIS mapping showing our main installation in the water main installation area before you start. The 16” gas main was installed with a normal depth of cover of 36” and the mapping is for reference only and will not have depth information that can be used to locate our facilities in the vertical plane.”

46. Will the current gas line installation company be required to re-pave State Route 17?

The gas line installation company is responsible to re-pave the side of Route 17 where the gas main is installed. The water line will run on the opposite side and the water line contractor must re-pave along that side as well as any curb stop and intersections.

47. Compensation for well decommissioning is standard regardless of depth, and is based on actual number completed. Please confirm that this unit price item will be paid based on units, and is not to be considered a lump sum item. Please additionally confirm that FAR 52.211-18 (Variation in Estimated Quantity) applies.

This question refers to bid item 0042. Yes – the item will be paid based on unit price each, not lump sum. Yes – the Variations in Quantity clause applies.

48. Measurement and Payment: CLINs 001 to 0009 does not mention compaction. Please confirm that compaction testing should be priced with the appropriate pipe installation area.

Yes – compaction testing should be priced as part of items 0001 through 0009. Consider it to be part of the ‘backfill’ and ‘testing’ requirement.

49. Measurement and Payment: CLIN 0042 indicates decommissioning and conversion to monitoring wells is under 0039; this appears to be in error and should be 0043; please indicate where to price the conversion – at 0042 or 0043?

You are correct, the reference should be line item 0043, not 0039. See revisions to Measurement and Payment section.

50. Measurement and Payment: CLIN 0043 says three wells converted plus the Durham Fair Ground well are included in this item. That would make 4. Bid form only shows three. What should be priced?

The quantity for item 0043 should be 4 not 3. Refer to revised unit price schedule.

51. Measurement and Payment: Paragraph 1.4 pp: The text says that the contractor must gain an access agreement before working on private property for decommissioning wells. It appears that the Consent for Access to Property forms included with the contract documents already cover that work. Please clarify what additional information / access agreements will be required beyond what is already established.

The water line contractor will be responsible for confirming that there has not been a change in property ownership that would require a new access agreement and provide information to support scheduling and interaction with property owners regarding the work to be performed.

52. Measurement and Payment: “Miscellaneous Earthwork Excavation” is called out in Items 0055, 0056, and 0057 does not exist on the bid form. Is this meant as a reference to bid item 0053, Excavation of Earth Material Outside of Standard Trench Limits?

It is not meant as a reference to bid item 0053.

53. Please confirm that all material excavated from the trench will require analytical testing for legal disposal.

Material excavated from the service line trench on the Durham Manufacturing Company property at 201/203 Main Street in Durham shall be analyzed as appropriate to meet disposal facility requirements. Historical data is available in Appendix D. Trenching operations outside the limits of the 201/203 Main Street property shall comply with the requirements of the CT DEEP Guidance for Utility Company Excavation, if contaminated soil is encountered.

54. Measurement and Payment: Payment for Removal and disposal of contaminated materials in CLIN 0058 (paragraph fff) will only be used if the contaminated materials are encountered during construction. It further states that the Contracting Officer will review invoices, etc. If this item will only be paid if contaminated materials are encountered, would it be better suited as an optional item?

Delete the sentence “This item would only be used if contaminated materials are encountered during construction.” Line item 0058 will not be an optional item. Refer to Appendix D for information regarding the contaminated material.

55. Measurement and Payment: Payment for Removal and disposal of contaminated materials in CLIN 0058 states that payments will be based on a review of invoices submitted by the Contractor for work by subcontractors, consultants, vendors, haulers, or disposal facilities, and detailed, itemized summaries for work completed directly by the contractor, as reviewed and approved by the Contracting Officer. Does this mean that if costs are significantly below the price per cubic yard that is bid that USACE would compensate for costs plus a negotiated fee?

The purpose of the review is to confirm that contaminated materials were in fact disposed of properly and to confirm quantity. The Variations in Quantity clause would apply to this line item.

56. Measurement and Payment: CLINs 0089 to 0093 include plug numbers. CLINs 92 and 93 include language related to a debit or credit, which is dependent on actual costs for installation / connection fees. This debit/credit language is not used in CLINs 89 through 91. Are offerors to assume that the CLINs 89 through 91 will be treated the same as 92 and 93?

Yes, items 89 through 91 will be treated the same as items 92 and 93 in that payment will be based on actual invoices.

57. Bid Item 0058 in the Measurement and Payment section specifically references property 203R Main St. In the Specification summary (01 11 00), 1.1.1, it states that contamination additionally exists at 201 Main Street. Under which item should bidders price contamination at property 201? Is the contaminant profile at 201 expected to be the same as at 203? Is the volume at 201 included in the stated volume at bid item 0058?

201 and 203 Main Street are part of the same parcel. The extent of the contamination is shown on sheet C-21 and the total quantity is part of bid item 0058.

58. Specification Section 01 11 00, 1.1.2 Winter Shutdown states “A mandatory winter shutdown period extending from 1 December to 31 March, inclusive, of any year, will be enforced during the performance period of this contract. During the winter shutdown periods, the Contractor will not be permitted to perform on-site construction work of any kind.”

a. Please confirm that this shutdown will be enforced regardless of unusual weather (i.e.

late winter freeze or early spring).

Yes, the shutdown will be enforced regardless of weather.

b. Please confirm that “work of any kind” includes basic site prep items or test pitting.

Yes, basic site prep and test pitting is part of “work of any kind.”

59. Please confirm that the “Durham Service Area” is limited to Areas A, E, and I on Figure 1 of the Basis of Design Report.

Response: The contractor should rely on the drawings to confirm the extent of the water line installation. Figure 1 of the is a general representation of the area to be served but the drawings supersede Figure 1.

60. Section 01 57 20, 3.1 states that the contractor is required to apply for a CTDOT encroachment permit, and to allow CTDOT an informal review of the contractor’s work plans.

What will the informal review entail?

As part of obtaining the encroachment permit CTDOT may request the work plans relating to work in the State right of way for review. Please be aware that a separate encroachment request must be submitted for the work in Durham and Middletown. EPA will coordinate obtaining the “owner” signatures on the encroachment permit.

61. Section 01 57 20, 3.1 indicates that the Contractor is responsible for obtaining a CT DEEP General Permit. What entity is considered the Registrant for this permit? What is the permit fee?

The contractor performing the work shall be the Registrant. Contact the CT DEEP for permit fee information.

Information regarding the General Permit can be found at http://www.ct.gov/deep/lib/deep/Permits_and_Licenses/Water_Discharge_General_Permits/com prehensive_gp.pdf

The contractor shall be required to complete the forms at the website below and comply with the requirements in the Comprehensive General Permit.

http://www.ct.gov/deep/lib/deep/Permits_and_Licenses/Water_Discharge_General_Permits/com prehensive_reg.pdf

62. Have all of the Consent for Access to Property forms necessary for the project been obtained? If no will USACE specify which properties do not have access agreements in place?

There are 5 properties which have not yet consented to a water line connection and 14 which have not yet consented to a curb stop. The contract should price the project assuming access for all properties is obtained but will only be responsible for installing work for properties where access has actually been obtained.

63. Drawing C-4: Please clarify the call-outs below Sta. 22+00. They are difficult to discern.

Refer to revised partial drawing C-4 which relocates the call-outs.

64. Reference RFI 3 of Amendment 0001 regarding lump sum reimbursement for Bid Item 0076, Uniformed Police Officers. During the estimating period crew sizes and the number of crews are determined, however, this may change in operation (at no cost to the Government). However, by adjusting the number of crews and therefore the number of locations being performed at any given time, the number of uniformed police officers that are needed will change. As a result, bidding this as a lump sum will cause some offerors to place significant markup on this item to protect itself against bearing significantly more costs than originally anticipated. Is it in the best interest of the Government to structure the unit of measure for this item as either a certain number of hours at a given rate or as an allowance of a given amount?

There will be no change to the bid schedule. Bid as shown.

65. Measurement and Payment: Paragraph 1.4, h says that 6” restrained joint pipe for hydrant laterals is paid under the hydrant assembly item. Paragraph 1.4, z says that the price for hydrant laterals does not include excavation. Please confirm that all excavation for all components of the hydrant assembly is included in Bid Item 0026.

Yes, the complete hydrant assembly (including 6-in hydrant lateral) is included in Bid item 0026 (and Paragraph 1.4 h notes that point). Paragraph 1.4 z states “The unit price for this item shall not include payment for items related to excavation which are paid under other items.

66. Measurement and Payment: Paragraph 1.4 pp: Please provide the average depth of wells to be decommissioned.

The average depth is estimated to be approximately 300 ft. (Note: Known well depths vary from approximately 150’ to over 400’. Logs are available for only a limited number of wells.)

67. Please confirm that ductile iron water piping is not required to be encased in polywrap.

There is no requirement to encase the ductile iron pipe in polywrap.

68. Specification 02521, 3.02A & B: Paragraphs note that Fairground wells may require additional or alternate treatment compared to those described in the specification. Please describe what those treatment methods might be.

The two Fairground wells will remain intact and not be abandoned. They will both be used as monitoring wells. The contractor shall remove the pumps and terminate the connection to the Pump Station to prevent cross-connection.

69. Please provide a new pavement cross-section for the storage tank access roadway.

The profile of the new roadway is shown on C-4 with a cross-section detail shown on C-506.

70. While the plans include indication of the proposed alignment of the new gas main, please provide revised or updated plans showing the actual location of the new gas main (including services if applicable) currently being installed if it varies from the proposed.

See response to question 45.

71. Drawing C-43: Please provide details for the domestic and fire service connections at the High School.

The services are to be brought to the vaults as shown. The connection will be performed by others (RSD #13).

72. Vibration-generating activities will require notification of residents within a 500-ft. radius per the plans (C-3, Note 5). Note that there are no explicit requirements for vibration monitoring on the plans. Please clarify whether vibration monitoring is required IAW Spec. Vol 1. Section 02018

Yes, vibration monitoring is required as per specification section 02018.

73. Sheet Numbers C-25 & C-27 state that the new 16” on Main Street & 12” on Maple Avenue should be connected to the existing 12” Line on Main Street & 8” on Maple Avenue. However, that line appears to be owned by Connecticut Water.

a. Is the cost of doing this covered by the plug number provided in CLIN 0092 (Connecticut Water Service Company Service Connections)?

No, that cost is not covered by item 0092 and should be included as part of the installation of the water main.

b. Will a meter be required between the Connecticut Water system and the new Durham system?

No, the Durham Center Water Service system is owned by the Town of Durham. Once installed, the two systems will be combined. No meter between the systems is required.

74. Sheets C-25 & C-27 show new domestic water services being installed on Connecticut Water’s System.

a. Will Connecticut Water install these connections or should the offerors include the cost?

b. If Connecticut Water performs the installation, who will be paving, milling, and overlaying in those areas?

The offerer shall include the cost for items identified in a and b.

75. Measurement and Payment CLINs 0034 – 0036 for service piping: Are excavation, sawcutting, bedding, backfill, temporary pavement, etc. included in these items? If not please identify where they are to be carried.

Yes, payment for services is inclusive as noted.

76. Section 02740, 3.11 requires water service installation by soil piercing method. This method often results in failed sidewalks due to the void created by the method applied.

77. Amendment 2, RFI 21 regarding Tax Exempt status. Frequently when real property is installed on behalf of the Government it is tax exempt. Please clarify who is responsible for submitting the appropriate paperwork related to obtaining Tax Exempt status.

Tax exemption is approved on a case by case basis by the Contracting Officer. The contractor is responsible for submitting the appropriate state Tax Exempt form to the Contracting oOficer after award.
