SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS
The following have been modified:
Amendment 0002:
Responses to RFIs 1-7 are contained in Amendment 0001
8. The detail on plan sheet C-505 (State Road with Reinforced Concrete Base Temporary Trench Pavement Detail). This detail appears to entail the permanent trench work which we assume are covered by pavement items 0065 & 0066. No, the temporary trench pavement details are covered in the cost for each type Pipe Item. Refer to Specifications, Section 01 22 00, Measurement and Payment.
Refer to the same Section 01 22 00 for items 0065 and 0066. These items include estimated quantities to determine supplemental costs, if needed, for bituminous adjustments related to State
Road pavement restoration as required or directed by CTDOT and /or the Contract Authority, including as follows; (0065) for up to 6-in of supplemental bituminous to match existing concrete base thickness, and (0066) to replace the concrete base where the trench limits reduce the width of the remaining concrete base in the shoulder to less than 3’ft remaining.
8a: What is the temporary pavement depth requirement for the state road and is this expense part of the DI Pipe and Service Pipe Items? As noted above this expense is part of the DI Pipe and Service Pipe Items. Refer to Sheet C-502 through C-505 for the related water main, services, appurtenances, and restoration details.
8b: What is the permanent paving item for the two – 2” Bituminous Concrete S 0.5 Courses? The permanent paving pay item for State roads is Item Number 0068. The permanent paving pay item number for Town roads is 0067.
9. Item 0068 – The item for mill and 2” overlay of the roadway on state roads appears to be very low. Are the quantities of 0067 & 0068 inverted? No, the quantities are not reversed. The quantity for Item 0067 is correct, but 0068 is low and the quantity should be increased to 31,000 SY. As shown shaded on the drawings, Town roadway overlay (Item 0067) is full width and includes all streets other than State Roads where the overlay is limited to ½ roadway width or as otherwise indicated on the drawings for services, etc. Refer to revised bid schedule with revised quantity for bid item 0068. See also clarification in question 31 below.
10. Detail Sheet C-505 (City and Town Roads and State Roads Shoulders Temporary Trench Pavement Detail). Is the cost for this detail to be carried in the DI Pipe and Service Pipe Items?
Yes, refer to Section 01 22 00 Also, will this pavement stay in place and will it be used as the permanent trench base? Yes.
11. The bookmarks in volume 1 of 2 of Specs_Vol_1_Durham_Waterline_10_May_2018_Final, show Division 0 - Contract Documents and Division 1 - General Requirements, however, when you click on them, they are unavailable. They are also, not listed in the table of contents. And are not included anywhere in the package. The bookmarks in volume 2 of 2, show Division 0 - Contract Documents and Division 1 - General Requirements in the table of contents, however, they are nowhere to be found in the document. Can you please clarify? Sections 0 and 1 were removed from the AE’s specifications and superseded by the solicitation and USACE specifications. Please ignore the residual bookmarks from the AE’s specifications.
12. Please provide an accurate Engineer’s Estimate/Project Budget [the Solicitation lists a range of $10,000,000 to $30,000,000]. Per FAR 36.204, the government establishes a price range for construction contracts. The government does not provide potential bidders with the Independent
Government Estimate until the bid opening. The solicitation will thus not be updated with the Engineer’s Estimate.
13. What is the RFI Deadline or Deadline for Questions? RFIs are requested to be submitted prior to a week and a half before the bid opening date.
14. What is the anticipated Award Date? Per section 13. D of the solicitation, the government has 60 calendar days for bid acceptance.
15. What is the anticipated Notice to Proceed date? Notice to proceed will be issued after approving the awardee’s performance and payment bonds.
16. Is there a specified percentage goal or requirement for WBE participation? This is a small-business set aside. There is no subcontracting plan required. See clause 52.222-23.
17. Is there a specified percentage goal or requirement for MBE participation? See clause 52.222-23.
18. Please confirm that Buy American or American Iron and Steel (AIS) is in fact a requirement for this project. See clause 52.225-11 and 52.225-12.
19. Please confirm that State of Connecticut Prevailing Wages are in effect and supersede Federal Davis-Bacon wages on the project. See the solicitation. As this is a federal construction project, Davis-Bacon wages supersede all other wages.
20. Final Completion is specified as 1095 days. Is there a specified Substantial Completion or specific Milestone Dates for elements of the construction? Contractor shall be required to complete all work within 1095 days of notice-to-proceed.
21. Is the project Tax Exempt? Tax exemption is granted on a case by case basis and submitted to the contracting officer after award for approval.
22: Background: According to Sheet M-101, the bottom of the perimeter footing is at elevation 437.50’, which corresponds to a 3’-6” footing thickness (depth). It is assumed that the reason for this is to provide sufficient frost protection from finish grade to the bottom of the footing. Given a finish grade elevation of 442’, the resulting frost protection depth is 4’-6” (442.0’ – 437.50’).
Question: Is it acceptable to provide the necessary 4’-6” deep frost protection by a combination of 1’-0” high backfill, the standard 1’-3”-thick footing and a 2’-3”-thick layer of permeable, open-grade crushed stone which is not susceptible to ice lens formation and propagation?
[Please see attached Fig. 2(a) and 2(b)]. The area in question is labelled as the ‘Leveling Base’ on sheet M-101. Contractors shall bid the leveling base detail as depicted on sheet M-101. Note that the ‘Leveling Base’ material shall conform to the requirements of Specification Section 02224, Bank or Crushed Gravel.
23. Section 13225, Page 24, Part B.5, states we are to provide two coats of NSF 61 compliant epoxy coating on the exterior of the aluminum roof hatches. Aluminum accessories for
Prestressed Concrete Tanks are never coated so that the Owner has a maintenance-free structure.
The coating of this accessory is an unnecessary expense and will require future maintenance.
Can this requirement be deleted from the specifications? Roof hatches shall be painted as specified.
24. Section 13225, Page 24, Part C.4, states we are to provide two coats of NSF 61 compliant epoxy coating on the exterior of the aluminum roof vent. Aluminum accessories for Prestressed Concrete Tanks are never coated so that the Owner has a maintenance-free structure. The coating of this accessory is an unnecessary expense and will require future maintenance. Can this requirement be deleted from the specifications? Roof vents shall be painted as specified.
25. Section 13225, Page 26, Part F.5, states we are to provide two coats of NSF 61 compliant epoxy coating on the aluminum exterior ladder and ladder cage. Aluminum accessories for Prestressed Concrete Tanks are never coated so that the Owner has a maintenance- free structure.
The coating of this accessory is an unnecessary expense and will require future maintenance.
Can this requirement be deleted from the specifications? Exterior ladder and cage shall be painted as specified.
26. Section 13225, Page 26, Part H.3, states we are to provide two coats of NSF 61 compliant epoxy coating on the aluminum roof railings. Aluminum accessories for Prestressed Concrete Tanks are never coated so that the Owner has a maintenance-free structure. The coating of this accessory is an unnecessary expense and will require future maintenance. Can this requirement be deleted from the specifications? Railing shall be painted as specified.
27. Will there be an escalation clause for the cost of materials especially ductile iron pipe, copper pipe for service lines, and bituminous pavement? No. There will be no escalation clause for materials.
28. Please clarify if the foundations for the buildings are cast in place or precast. Foundations for structures/buildings shall be precast concrete as noted on sheets M-107, M-108, M-109 and M- 110.
29. Please clarify that the meter building can be pre-cast as multiple sections. The Meter Building (Sheet M-109) can be constructed as multiple sections. Note that on sheets M-107, M- 108 and M-110 a joint is visible between the structure walls and structure roof. This detail is not shown on M-107 due to the proximity of the exhaust fan and vent.
30. Please clarify if there is a structure adjacent to the north side of the altitude valve vault at the tank site as shown on Drawing C-3. This is not shown elsewhere in the plans or details. The structure on the north side of the altitude valve vault as shown on sheet C-3 is electric utility meter. See sheet E-3.
31. Please clarify if the water main trench detail as shown on Drawing C-502 which shows 6” of ¾” crushed stone bedding wrapped in filter fabric under the sand bedding is applicable to all water main trenches or just in areas where unsuitable material is encountered. The ¾” stone detail is applicable to all water main trenches.
32. Clarification – The drawings are not 100% clear as to which roads receive a 2” overlay for their final paving versus which roads receive a milling and 2” overlay for their final paving.
The following roads receive milling and 2” overlay: all roads in Middletown; all state roads in Durham including Routes 17 and 68. (Pay item 0068)
The following roads receive 2” overlay pavement: all non-state roads in Durham. (Pay item 0067)

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
