SUMMARY OF CHANGES

SECTION 00100 - BIDDING SCHEDULE/INSTRUCTIONS TO BIDDERS

The following have been modified:

SECTION 00100

SECTION 00100 INSTRUCTIONS, CONDITIONS, AND NOTICES TO OFFERORS

1. SCOPE:

1.1. You are invited to submit a bid in response to our Invitation for Bids (IFB) entitled) W912PQ-15-B-0001 entitled Repair Fire Station Bldg. 300 WKVB002397 and Add to Fire Station WKVB099052 at F.S. Gabreski ANG, Westhampton Beach, NY 11978-1201.

1.2. As a result of this solicitation, the Government intends to award a Firm Fixed Price (FFP) contract resulting from this solicitation to the responsible bidder whose bid, conforming to the invitation for bids, will be most advantageous to the Government, considering only price.

1.3. This solicitation is set-aside 100% for small businesses.

2. EVALUATION FOR AWARD. Reference DFARS 252.236-7007.

As prescribed in 236.570(b)(5), use the following provision:

ADDITIVE OR DEDUCTIVE ITEMS (DEC 1991)

(a) The low offeror and the items to be awarded shall be determined as follows—

(1) Prior to the opening of bids, the Government will determine the amount of funds available for the project.

(2) The low offeror shall be the Offeror that—

(i) Is otherwise eligible for award; and

(ii) Offers the lowest aggregate amount for the first or base bid item, plus or minus (in the order stated in the list of priorities in the bid schedule) those additive or deductive items that provide the most features within the funds determined available.

(3) The Contracting Officer shall evaluate all bids on the basis of the same additive or deductive items.

(i) If adding another item from the bid schedule list of priorities would make the award exceed the available funds for all offerors, the Contracting Officer will skip that item and go to the next item from the bid schedule of priorities;

and

(ii) Add that next item if an award may be made that includes that item and is within the available funds.

(b) The Contracting Officer will use the list of priorities in the bid schedule only to determine the low offeror. After determining the low offeror, an award may be made on any combination of items if—

(1) It is in the best interest of the Government;

(2) Funds are available at the time of award; and

(3) The low offeror's price for the combination to be awarded is less than the price offered by any other responsive, responsible offeror.

(c) Example. The amount available is $100,000. Offeror A's base bid and four additives (in the order stated in the list of priorities in the bid Schedule) are $85,000, $10,000, $8,000, $6,000, and $4,000. Offeror B's base bid and four additives are $80,000, $16,000, $9,000, $7,000, and $4,000. Offeror A is the low offeror. The aggregate amount of offeror A's bid for purposes of award would be $99,000, which includes a base bid plus the first and fourth additives. The second and third additives were skipped because each of them would cause the aggregate bid to exceed $100,000.

(End of provision)

3. EVALUATION FOR AWARD. Reference DFARS 252.236-7007. Further explanation of this reference for award of multiple projects is as follows: Line item 0001with its ABI line item 0004 and 0007 and line item 0002 with its ABIs line items 0003, 0005 and 0006 are considered two separate projects. The

Government will announce two separate amounts of funds available for each of these projects prior to bid opening.

3.1. Line item 0002 is subject to a statutory limit of $2,000,000.00. Exceeding this limit on the base bid will make your bid non-responsive. Bids will be evaluated on the basis of the same additive items; the base amount plus the additive items in the order stated in the list of priorities in the bid schedule regardless of the ABI’s actually reference number in the project document. which provide the most features within the funds determined available for that project or within the statutory limit for that type of work. If adding another item from the bid schedule list of priorities would make the award exceed the available funds for all of the offerors, the Contracting

Officer will skip that item and go to the next item from the bid schedule of priorities. (Reference DFARS 252.236-

7007(b))

3.2. This same process with be followed for evaluation of Line item 0001 except that Line item 0001 is not subject to a statutory limit.

3.3. Any offer which exceeds the funding availability on any one or both of the projects will not be considered for award.

3.4. The low offeror shall be the offeror that

3.4.1. Is otherwise eligible for award; and

3.4.2. Offers the lowest aggregate amount for both projects with evaluated ABIs

3.4.3. AND Does not exceed the amount of funds available on either of the projects.

3.5. Example

Project 1

Project 2

Total

Aggregate Price

Funds available

$100000

$70000

* AND

Statutory

Limit of

$100000

Offeror 1 base $90000

ABI $ 5000

$10000

Total $95000

$160000

Offeror 2 base $90000

$52000

ABI $10000

$10000

Total $100000

$62000

$162000

Offeror 3 base $101000

$50000

ABI $ 3000

$5000

Total $104000

$55000

$159000

Based on this example, Offeror 1 would be determined to be the Apparent Low Bidder with total bid of $160,000.

Offeror 3’s bid would not be considered because the price submitted for Project 1 base exceeds the statutory limit and is therefore non-responsive. If there were no statutory limit it also exceeds the funds available for that project even though they had the lowest overall total price.

Offeror 2’s proposal for Project 2 is lower than that of Offeror 1; however, award is being made based on the criteria set forth in the solicitation, to the single offeror who’s price is the lowest aggregate price of the two projects/line items inclusive of the ABIs.
