4 RECOMMENDATIONS
In summary, various materials with the potential to contain asbestos were observed in the areas inspected. Of the materials sampled no asbestos content was detected above the regulatory limit of 1%. Based on visual inspection of the Subject Location, the following is offered:
TABLE 1
• Per the sampling results provided, contractor is to assume all materials reported in Table 1 to not contain levels of asbestos above the regulatory limit of 1%.
TABLE 2 NON-FRIABLE
• With the exception of the three (3) materials identified as friable and the potential for ACM, all other materials identified in Table 2 as non-friable shall be removed and disposed of in such a manner by the contractor as to not make the material friable. The removal and disposal shall be IAW HAR 11501-7(c) of all non-friable material shall be included in the price proposal. Costs shall be included in the Base Bid.
• In accordance with the State of Hawaii regulation, HAR 11-501-7(c):Regulated ACM (RACM) [which includes Class I and II non-friable ACM] need not be removed before demolition if: (A) it is category I non-friable ACM that is not in poor condition and is not friable; (B) is on a facility component that is encased in concrete or other similarly hard material and is adequately wet whenever exposed during demolition; it was not accessible for testing and was, therefore, not discovered until after demolition began and, as a result of the demolition, the material cannot be safely removed (C) it is category II non-friable ACM and the probability is low that the materials will become crumbled, pulverized, or reduced to powder during demolition.
• In the event that the contractor’s means and methods cause non-friable material to become friable during demolition activities, the removal and disposal of said materials shall be by a qualified firm (if non-friable material is determined by the contractor to be ACM then removal and disposal of said materials shall be by a qualified ACM abetment firm) and at the expense of the contractor. This expense will not be considered an unforeseen condition or change by the Government.
• Per the information provided in Table 2. The Contractor will conduct sampling and analysis of the three suspected asbestos materials identified in Table 2 as friable prior to demolition activities that may disturb these materials to determine the actual presence of asbestos above the regulatory limit of 1%. Offerors shall accomplish sampling and analysis of the identified friable materials contained in this table and therefore shall include costs for sampling and analysis of these materials in their price proposal. Costs shall be included in the Base Bid.
TABLE 2 FRIABLE.
• If friable ACM is identified after sampling and analysis it must be removed and disposed of by a qualified asbestos abatement contractor. Friable ACM is defined as those materials that may be crumbled, pulverized, or otherwise damaged by hand pressure.
• Any of the friable materials confirmed by the sampling and analysis results to contain asbestos materials above the regulatory limit of 1% will be abated and disposed of according to the Forward Pricing Agreement proposed by the contractor and incorporated into the contract at time of award. See Exhibits F and H.
• In the event the friable materials are determined to not contain ACM by the contractor’s performance of required sampling and analysis, the Contractor shall accomplish removal and disposal of said materials as part of the Base Bid contract. Costs shall be included in the Base Bid.
• The services of a qualified consultant shall be obtained to monitor and inspect the removal activities to ensure compliance with applicable Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA), and Hawaii Occupational Safety and Health (HIOSH) regulations pertaining to the handling of asbestos containing material.
• Any abatement and demolition contractor(s) must take appropriate measures to comply with applicable EPA, OSHA, HIOSH regulations pertaining to the handling of asbestos containing materials and worker protection.
• Have air monitoring conducted for airborne asbestos fibers by a State of Hawaii certified Project Monitor during any asbestos abatement and general renovation/demolition activities of areas that were determined to contain this contaminant.
