FAR 52-222-54 indicates employment eligibility is not required using E-Verify for any employee "(2) Who has been granted and holds an active U.S. Government security clearance for access to confidential, secret, or top secret information in accordance with the National Industrial Security Program Operating Manual; or Section 00 74 18 "Level VI security vetting - top secret facility security clearance; 180 calendar days shall be allowed for the vetting process" Amplification: The scope of work indicates that the Government intends to use this contract for Sensitive Compartmented Information Facility (SCIF) construction. Given the RFP requirements do not require a Top Secret Facility Security Clearance, then a company without a FCL could win one of the MATOC.
Section "Activities which are the responsibility of any Host Nation or foreign (non-US) Government agency at any level, including, but not limited to: reviews, permit approvals, and clearances must have a Host Nation Responsibility Code assigned."
Amplication: Throughout the RFP there are references to Clearance Levels, security clearance requirements etc.
Given the work may require personnel with a SECRET or TOP SECRET Clearance to construction SCIFs it appears Facility Clearance Level is required during execution but not stated.

1. Would the Government please amplify the RFP with the expected Task Order security clearance levels expected?
2. Would the Government indicate whether they will support sponsorship for a Facility Clearance Level for companies or subcontractors who do not have not have a FCL after MATOC Award?

Background: SOW states: "Base access and security requirements may be altered by the Romanian authorities at any time. The contractor shall have no recourse as to costs or time extensions for any delays resulting in changes to access and/or security requirements."
Question: Please confirm that projects may be on foreign bases and that USACE will not give time or cost modifications due to unknown or changing Access Control procedures at these bases. This appears to be an unfair statement in the SOW for a potentially unknown condition at bid.

Government Response. . Task order work may be performed on installations where the Host Nation (HN) controls installation access. The Army Corps of Engineers (USACE) will provide access procedures and will facilitate coordination with the HN, however, USACE does not warranty the process, duration, or actions of another sovereign nation. In situations where project delays occur as a result of sovereign acts, or other acts outside of the control of USACE, these delays will not be compensable. With that said, the construction contractor may be entitled to a non-compensable time extension to the contract and relief from liquidated damages if they can demonstrate that the cause of delays were beyond their control. If the task order is design-bid-build (contractors are provided 100% designs with the RFP) then USACE and the A/E will coordinate with the HN for the issuance of HN construction authorizations/permits. Construction contractors may still be responsible for generating additional information/documentation and obtaining some additional authorizations/permits.
These requirements should be provided on a task order by task order basis.
If the task order is design-build and the MATOC contractor is responsible for completing the design, then the MATOC contractor will have the responsibility to ensure the design is capable of obtaining HN authorization and permits. Page 30 Factor 2: Management Approach submissions states, The organization chart, resumes (if provided), and letters of commitment are not considered part of the 30 page limitation. NOTE: Pages that exceed the required page limitations will not be evaluated. Additional pages over the maximum allowed will not be evaluated by the Government.
In this sentence the owner accepts that resumes may not be provided in Phase I submission.
The Phase II Technical Approach Narrative Key Personnel requirements requires names and qualifications, and letters of commitment.
