SECTION L – INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS – PHASE I

REVISED 05 March 2024

L.1 GENERAL INSTRUCTIONS TO OFFERORS FOR PHASE I

L.1.1 The Government is using a two-phase procurement approach for this design-build project.

Potential Offerors are invited to submit the information described herein for review and evaluation by the Government. Following completion of the evaluation of Phase I proposals, up to a maximum of five most highly qualified offerors will be selected to participate in Phase II.

L1.2 This is an all-electronic solicitation release. No hard copies of the solicitation will be mailed.

Notifications and Amendments to the solicitations will be posted to https://sam.gov/. It is the responsibility of each Offeror to review the webpage for notice of amendments, updates, or changes to current information. Responsibility for source selection resides with the Government. Proprietary information submitted in response to this solicitation will be protected from unauthorized disclosure as required by Subsection 27 of the Office of Procurement Policy Act as amended (41 U.S.C. Sections 210- 2107) and as implemented in the FAR. Proposals shall be unclassified and treated as Source Selection Sensitive Information (see FAR 2.101 and 3.204).

L.1.3 Proposals must be complete, self-sufficient, and respond directly to the requirements of the solicitation. Any commitments made in the proposal shall become part of the resultant contract. Any significant inconsistency, if unexplained, raises a fundamental issue of the Offeror’s understanding and/or ability to perform the contract. This may be basis for rejection of the proposal. In no case shall statements similar to “we will comply with the requirements of the contract” or equivalent statements be acceptable to meet all the requirements of this Request for Proposal (RFP). However, the proposal shall include a declaration statement that acknowledges and accepts, without exceptions, all RFP requirements, to include the Statement of Work (SOW) and all other attachments and exhibits. Failure to comply with these instructions may result in an Offeror’s proposal being excluded from further consideration for award.

L.1.4 All questions concerning this procurement, either technical or contractual, must be submitted in writing electronically to the Contract Specialist and Contracting Officer. See FRP Section 00700 Clause entitled, “Question and Answer Via ProjNet”.

L.1.5 Contract Cost Ceiling Limitation: The design and construction costs will be subject to the funds available for this project. The total contract award must not exceed $5,000,000.00 for this contract. The Government may not be able to make an award if the dollar value for this project is exceeded.

L.2 PROPSAL FORMAT

L.2.1 File Organization: Each file must be clearly indexed and logically assembled. Text size must be no smaller than what is equivalent to Microsoft Word, Times New Roman, 11 point. A page is defined as one 8 ½ x 11-inch paper with printing on one side of the paper. Line spacing settings must be at least one and one-half (1 ½) line spacing. Margins on all four (4) edges of each page must be at least 1-inch. The proposal must be in a narrative format, organized and titled so that each section of the proposal follows the order and format of the volumes. The information presented should be organized to pertain to only the evaluation factor in the volume that the information is presented.

Each Volume must be organized in the following order and submitted as a single file with the expectation of volume attachments and/or size limitations:

Cover Sheet. The cover sheet must be clearly marked as to Volume number, title, solicitation identification, and the Offeror’s name. The cover sheet will not count against page counts.

Table of Contents. The table of contents must include all charts, illustrations, tables and any attachments for the Volume. The table of contents will not count against page counts.

Glossary. The glossary must contain all abbreviations and acronyms used in the volume with an explanation for each. The glossary will not count against page counts.

L.2.2 File Size Limitation: Offerors are advised to limit email attachments to a limit of 10MB in total per email. If needed, Offerors are advised to break files down into smaller sections in order to ensure file delivery.

L.2.3 File Naming Convention: To ensure an Offeror’s submission is received and processed appropriately, it is important that interested parties carefully ensure their electronic files adhere to the following naming convention:

W912EK24R0001-FIRM_NAME_PHASE I_VOL I

W912EK24R0001-FIRM_NAME_PHASE I_VOL II

W912EK24R0001-FIRM_NAME_PHASE I_VOL III

L.2.4 The following Volumes will be submitted and evaluated for Phase I:

Volume 1: General and Administrative Qualifying Criteria (Factor 1) Volume 2: Qualifications & Capacity (Factor 2) Volume 3: Past Performance (Factor 3)

L2.4.1 Volume 1 must contain a list of qualifying criteria submissions that will be evaluated per the evaluation criteria in Section M.1.3.1, Factor 1 Evaluation Scale. The qualifying criteria proposal must be organized in Volume 1 folder in the order listed in Section L and submitted per L.4.1.

L.2.4.2 Volume 2 will be evaluated per the evaluation criteria in Section M.1.3.2, Factor 2 Evaluation Scale. Proposals must include necessary information to enable the evaluators to form a definitive conclusion concerning the Offeror’s ability to perform the required contract. The Qualifications and Capacity must be organized in Volume 2 folder in the order listed in Section L and submitted per L.4.2.

L2.4.3 Volume 3 will be evaluated per the evaluation criteria in Section M.1.3.3, Factor 3 Evaluation Scale. The Past Performance must be organized in Volume 3 folder in the order listed in Section L and submitted per L.4.3.

L.2.5 Joint Venture Proposal Requirements: When proposing as joint venture, all members of the joint -venture must sign the SF 1442 and prove bonding capability of both firms, unless a written agreement by the joint venture is furnished designating one firm with the authority to bind the other member(s) of the joint venture. In addition, a copy of the joint venture agreement must be submitted with the proposal.

Failure to comply with the foregoing requirements may result in the joint venture’s proposal being excluded from further consideration for award.

L.3 PROPOSAL SUBMITTALS

L.3.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein. However, to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the Offeror’s specialized experience necessary for successful completion of the solicitated project. Requirements stated in this RFP are minimums. Proposals should follow in the order of sequence set forth in the RFP. Information provided out of sequence may not be evaluated and may result in the Offeror’s proposal being excluded from further consideration for award.

L.3.2 Offerors must submit their proposals electronically via email to allison.a.johnson@usace.army.mil and j.c.paitson@usace.army.mil of the U.S. Army Corps of Engineers, Contracting Division no later than the time and date specified in Block 13 of the Standard Form 1442.

NOTE: The Rock Island District is in the Central Time Zone. No hard copies will be accepted.

L.3.3 Proposal Submission and Deadline: Interested Offerors must submit proposals no later than the time and date specific on the SF 1442. The time and date of proposal receipt will be the delivery time and date recorded upon email receipt. Do not assume that electronic submission will occur instantaneously; it usually takes at least a few minutes. Large files will take some time to transmit, potentially up to one hour or longer. Offerors should time their submission effort with prudence by not waiting until the last few minutes – this will allow for unexpected delays in the transmittal process and email receipt. Offerors are encouraged to keep a copy of their submission for their record. Submissions after the deadline will be considered late and will be processed in accordance with FAR 15.208.

NOTE: Phase I proposals DO NOT involve pricing submission.

Staffing – The Government will evaluate the resources described to determine if the Offeror has the capability to self-perform the required amount of the project, the adequacy of their staffing plan to cover all required tasks and responsibilities and provide supervision of all work.

Quality Control – The Government will evaluate the Offeror’s capabilities and understanding of the quality control processes for both design and construction. The Offeror may potentially receive a strength for continued participation by the designer of record during the construction quality control process.

L.4.3 VOLUME 3 PAST PERFORMANCE

L.4.3.1 For Past Performance, the Offeror shall submit no more than seven (7) but a minimum of five (5) successful structure raising projects completed within the last eight (8) years from the date of the solicitation with a minimum of one (1) project per main team member (i.e., Offeror, Lifting Contractor, DOR, etc.). Before and After Photos, two (2) pages maximum

Each project must demonstrate recent, relevant experience on projects similar in size, scope, and complexity as defined in the Statement of Work. Offeror’s may identify state and local government and/or private contracts that are similar to the Government’s requirements. If the Offeror is a joint venture, each firm must provide information demonstrating experience relevant to their proposed role on this project.

Submitted projects that are completed and turned over no longer than eight (8) years preceding the date of this solicitation. If any firm has multiple functions or divisions, limit the project examples to those performed by the division or unit submitting the offer or by the team member. Design firms may list prime contractors they have worked for or government, private, or commercial customers. If projects were design-build, identify them as such.

For each project, provide a past performance reference. The past performance reference must have been a client, or a client representative, with whom the Offeror had a contract, or subcontract (if applicable) for one or more projects. The reference must hold, or have held at the time, a senior position in the client organization with responsibilities of contract administration, quality control, engineering, or technical supervision, or was otherwise in a position to evaluate the Offeror’s performance in executing the contract or subcontract. The past performance reference must have first-hand knowledge of the Offeror’s performance on submitted project examples. The Government may, at its sole discretion, follow up with points of contact, and may use Government databases, personal experience, and other information on determining an Offeror’s past performance.

The Offeror shall provide a Past Performance Questionnaire to the point of contact and/or the person that represents the project owner’s evaluation of the Offeror’s past performance for each of the projects listed.

The project point of contact for the listed references shall complete Appendix 1, Past Performance Questionnaire, and send completed forms with the Subject Line “PPQ for the Southwest Coastal Louisiana Nonstructural Coastal Storm Risk Management Project - [Insert name of Prime Offeror]” to allison.a.johnson@usace.army.mil and j.c.paitson@usace.army.mil, no later than the closing date of receipt of proposals stated in the RFP, but preferably three (3) days prior to the closing date. Offerors are encouraged to follow up on the submittal of past performance questionnaires to ensure that all questionnaires have been emailed to the Government successfully.

L.4.3.2 The Government will first assess the recency of projects accomplished by the Offeror. The Government will then assess the relevancy of recent projects. This rating is not a separate proposal rating, but is only used in developing the overall past performance confidence assessment rating assigned to the Past Performance Factor. The Government will next assess the quality of recent and relevant projects to determine how well the contractor performed on the contracts. This assessment will come via review of submitted Past Performance Questionnaires, additional references, or any other available information. The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the Offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed on those past contracts. The Government will review this past performance information and determine the quality and usefulness as it applies to the past performance assessment.

The Government will evaluate the extent of recent, related experience of the prime contractor, lifting contractor, and Designer of Record/design firm in design, construction, and/or design-build, as relevant to their role in this project. If the design will be accomplished in-house, rather than by subcontract, then the design element will still be evaluated, taking into account the fact that the work is being done in-house.

SECTION L – INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS – PHASE II

L.5 GENERAL INSTRUCTIONS TO OFFERORS FOR PHASE II

L.5.1 The Government is using a two-phase procurement approach for this design-build project. Up to a maximum of five most highly qualified offerors will be selected to participate in Phase II.

L.5.2 Those Offerors evaluated to be the most highly qualified in Phase I are invited to submit a Phase II proposal, as indicated below. The Government will evaluate the proposals in accordance with the evaluation criteria described herein, using the evaluation rating system outlined in Section V – Phase II Solicitation Provisions (Section M – Evaluation Factors for Award). The Contracting Officer will award a firm-fixed-price contract to the responsible Phase II Offeror whose proposal the Source Selection Authority determines conforms to the solicitation, is fair and reasonable, and offers the best overall value to the Government, considering the non-price and price factors. The contract award must not exceed the contract cost limitation described in Section L.1.5. for this project. There are no sub-factors for any factors. The intent of this solicitation is to obtain the best proposal within the contract cost limitation listed in Section L.1.5. There is no obligation to approach or match the cost limitation in the offer. After the Government individually evaluates and rates each proposal, the Source Selection Authority will compare the proposals to determine which proposal represents the best value. The Government reserves the right to accept other than the lowest priced or most highly technically rated offer, or to reject all offers. The Government will not award a contract to an Offeror whose proposal contains a deficiency, as defined in FAR 15.001.

L5.3 This is an all-electronic solicitation release.

L.5.4 Proposals must be complete, self-sufficient, and respond directly to the requirements of the solicitation. However, the proposal shall include a declaration statement that acknowledges and accepts, without exceptions, all Statement of Work (SOW) requirements. Failure to comply with these instructions may result in an Offeror’s proposal being eliminated from further consideration for award.

L.5.5 All questions concerning this procurement, either technical or contractual, must be submitted in writing electronically to the Contract Specialist and Contracting Officer. See FRP Section 00700 Clause entitled, “Question and Answer Via ProjNet”.

L.5.6 Contract Cost Ceiling Limitation: The design and construction costs will be subject to the funds available for this project. The total contract award must not exceed the amount listed in Section L.1.5 above for this contract. The Government may not be able to make an award if the dollar value for this project is exceeded.

L.7 PROPOSAL SUBMITTALS

L.7.1 Offerors submitting proposals for this project should limit submissions to data essential for evaluation of proposals so that a minimum of time and monies will have been expended in preparing information required herein.

L.7.2 Offerors must submit their proposals electronically email to allison.a.johnson@usace.army.mil and j.c.paitson@usace.army.mil of the U.S. Army Corps of Engineers, Contracting Division no later than the time and date specified in Block 13 of the Standard Form 1442.

NOTE: The Rock Island District is in the Central Time Zone. No hard copies will be accepted.

L.7.3 Proposal Submission and Deadline: Interested Offerors must submit proposals no later than the time and date specific on the SF 1442.

Volume 2 shall clearly and concisely describe the organization and technical approach to project management and execution. Offerors must provide documentation as required below. The government will evaluate this information in accordance with Section M.2.3.2.

Submission Requirements:

Organization:

Describe all firm(s) involved, their resources and how their resources will be utilized, their roles and responsibilities, and any contractual arrangements that have been established. Clearly describe any teaming or joint-venture arrangements, including a clear description of each firm’s roles and responsibilities on the project. Describe the proposed management structure for the team, describing how the design and construction process will be managed and the authorities and delegations of authority within the team. If not to be self-performed, identify the specific firms chosen for mechanical and electrical installation.

Include a corporate organizational chart, illustrating the organization as a whole and hierarchy, which includes key positions and the names of the personnel, their firm affiliations, and their job/position title within the organization. Present a matrix of responsibilities for each firm in executing the key activities of the project.

The Offeror must document unequivocal teaming arrangements within its design firm(s) and house lifting/raising firm(s) with the complete signed form provided in Section L, Appendix 2, Letter of Commitment for Design Firm or House Lifting/Raising Firm, or a signed copy of the teaming or joint venture agreement(s).

Technical Approach:

Describe the technical approach to design and construction of these facilities.

Include any considerations of fast-tracking design and construction. The Governments is looking for ways to streamline construction, manage labor and other resources constraints in an effort to reduce costs and achieve an aggressive schedule. Discuss how the management system will track and control design evolution and changes during design for quality control and to facilitate quicker Government review.

Describe the role and interaction of the design team with the construction team during construction, addressing at a minimum: maintaining configuration managements of the design during construction, including control and approval of revisions to the accepted design; requests for information; shop drawing and submittal reviews and approval; progress meetings; site visits, if any; and contract completion, closeout, as-built, and completion documentation. In addition to the required designer-of-record roles specified within the RFP for maintaining integrity of the design, describe any other DOR involvement in the quality control process, if any.

L.8.3 VOLUME 3 CONTRACT DURATION AND SCHEDULING

Offerors must provide the contract duration and scheduling documentation as required below. The Government will evaluate this information in accordance with Section M.2.3.2.

Submission Requirements:

Proposed Contract Duration: The Offeror must propose the contract duration for a design and construction for all properties.

Summary Schedule: Submit a summary-level schedule for design and construction. Schedules or diagrams may be provided separately in a size that is easily read but must be bound and clearly labeled as Volume III. This summary schedule will, after contract award, be replaced with a project schedule as required by Section 01 32 01. The summary schedule must be task oriented, indicating the number of calendar days after notice to proceed, by which milestones are to be achieved. The Offeror may use a critical path or other method of choice; however, schedules must be graphically represented. The proposed project schedule must reflect the proposed contract duration and show anticipated design and construction starts for each structure; however it isn’t necessary to show the detailed breakdown construction (e.g. by trades) of each structure, site work and utilities.

Provide a maximum of three (3) page narrative to address the following:

Describe the time control capabilities and systems used to plan design and construction and how the schedule will be used to manage design and construction. Discuss internal procedures for handling delays to minimize time growth or “schedule creep”.

Describe the scheduling of surveys and inspections.

Describe the design plan for each structure, including events associated with coordinating the initial and final design submittal and permits for each package and the proper handling of the review comments for each design.

Describe the construction phase for each structure, for the site work and for utilities.

Clearly identify any constraints on the schedules presented (e.g. labor or material availability, permits, weather, etc.).

L.8.4 VOLUME 4 PRICE

Offerors must provide the price information as required below. The government will evaluate this information in accordance with Section M.2.3.3.

Submission Requirements:

Submit the properly filled out and executed SF 1442, to include acknowledging all amendments, along with the CLIN Schedule, containing proposed line item and total pricing, as well as the proposed contract duration. The Offeror shall ensure the information submitted is consistent with and fully supports the dollar values set forth in the Schedule of Prices.

Supplemental Price Breakdown. If deemed necessary to evaluate the price proposals, the Government will request a Phase II price breakdown of the Contract Line items in a separate email marked “Phase II Price

Breakdown Information,” in Microsoft Excel (.xlsx) format. The Government will provide details on where and how to send the breakdown if necessary after initial Phase II Proposal submission. This information will not be needed sooner than three working days after the proposal submission due date.

This information may be required for the initial Phase II proposal and, if requested, for any revised proposals. This information is not an opportunity for an Offeror to revise its non-price or price proposal.

All supplemental price breakdown information must clearly match the Offeror’s proposed CLIN pricing and revisions are not allowed unless as a result of discussions. If supplemental pricing breakdown does not match the CLIN pricing, then this may be evaluated as a weakness, significant weakness, or deficiency and may eliminate the Offeror from further consideration for award.
