SECTION 00 21 16 - INSTRUCTIONS TO PROPOSERS

The following have been modified:

PROPOSAL SUBMISSION

PROPOSAL SUBMISSION (SECTION 00 21 16)

For clarification, the addressed section shall reference the Solicitation. The identified sections are I accordance with (IAW) the Construction Specifications Institute (CSI) pursuant to the U.S. Army Corps of Engineers Desk Guide

(UDG) 5113.201-1.

Section 00 21 16 of the Solicitation (Request for Proposal (RFP)) contains the proposal submission instructions.

Section 00 21 16 includes specific information on what must be furnished with the offer and identifies evaluation criteria that will be used in evaluating proposals received. Section 00 22 16 contains the basis of award and evaluation methods/ratings.

1. INTRODUCTION

1.1. The Solicitation is a total small business set-aside acquisition using the best-value tradeoff (BVTO) source selection process to award a firm-fixed-price (FFP) type contract.

1.2. Pursuant to DFARS 236.204, the magnitude of the construction project is between $10 million and $25 million.

1.3. The primary North American Industry Classification System (NAICS) code for the acquisition is 333923 – Overhead Traveling Crane, Hoist, and Monorail System Manufac. Size Standard 1,250 employees.

1.4. Selection will be made based on the responsible Offeror whose proposal conforms to the Solicitation requirements, demonstrating high technical capability and low risk, presenting the most advantageous offer to the Government in accordance with (IAW) the Federal Acquisition Regulation (FAR) Part 15, Contracting by Negotiations, and the Solicitation. The Government reserves the right to accept other than the lowest-priced offer or to reject all proposals.

1.5. The Government intends to make an award without discussions but reserves the right to conduct discussions should the contracting officer decide discussions to be necessary or advantageous to the Government. Because the Government does not intend to hold discussions, the Offeror is encouraged to put forth their best proposal.

1.6. The Government will not reimburse any cost incurred or associated with preparing and submitting any responses to the Solicitation. Oral explanations or instructions to Offerors are not binding. Any information given to an Offeror which impacts the Solicitation and/or offers will be provided in the form of a written amendment to the Solicitation. It is the Offeror’s responsibility to acknowledge all amendments in its proposal submission.

1.7. The Offeror shall not modify the terms and conditions of the Solicitation in their technical proposals or add conditions or qualifications to their offers. Should an Offeror include terms and conditions that conflict with the terms and conditions of the Solicitation, the Offeror may be determined ineligible for award. Any questions related to specific terms and conditions contained within the Solicitation should be resolved prior to the submission of an offer.

1.8. All proposals received will be considered complete and final. The evaluation board will not consider any information or data incorporated by reference or referring to other sources outside the respective proposal volumes and factors responses. The successful Offeror will be selected solely based on the evaluation factors below. Accordingly, proposals submitted in response to the Solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors. Elaborate proposals, color brochures, and other excesses are discouraged.

1.9. Proposals that reiterate “Parroting” the contents of the Solicitation, or contain only superficial responses, may be considered unacceptable. Evidence of experience, capability, and qualifications demonstrating and supporting the Offeror’s claims is essential. The absence of such evidence will adversely influence the evaluation of the proposal.

1.10. References to “confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal. The Offeror including confidential information in its proposal that they do not want to be disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall clearly mark their proposals IAW the instructions at FAR Clause 52.215- 1, Instructions to Offerors –Competitive Acquisition, paragraph (e), Restriction on disclosure and use of data.

1.11. Use of the words “shall” or “must” indicate a mandatory requirement for which failure to comply at the time and date for submission of proposals may result in the Offeror’s proposal being disqualified from consideration for the award, or a deficiency or weakness being assessed for the factor. Failure to comply with non-pricing or pricing requirements annotated with the words “should” or “may” can result in an unacceptable proposal. If stated as a number of days, time periods are calendar days unless otherwise specified.

2. E-BUSINESS REGISTRATION REQUIREMENTS

2.1. System for Award Management (SAM). The Offeror shall be registered in SAM at the time an offer is submitted. Failure to have an active and completed registration in SAM [https://sam.gov/] may determine an Offeror ineligible for the award and removed from the competition. A successful https://sam.gov/

Offeror with incomplete or expired registrations at the time of award may not be eligible for a contract. Information contained within an Offeror’s registration shall be current and valid. The responsibility of maintaining current information contained in an Offeror’s registration rests solely on the Offeror.

4. Element 4: Past Performance References (Tab 2d)

The Government seeks an Offeror who maintains a strong commitment to customer satisfaction and superior performance. It is the Offeror’s responsibility to affirmatively document these qualities in its technical proposal.

Note, if a completed Contractor Performance Assessment Report System (CPARS) evaluation is available, it shall be submitted with the proposal. If there is not a completed CPARS evaluation, then the Offeror shall submit Attachment A – Past Performance Data Sheet, and Attachment B – Past Performance Questionnaire (PPQ) for each project included in Factor 2.

The definitions of “recent” and “relevant” for this element shall not be confused with the definitions of these terms under Elements 1-3. The definitions of recent and relevant, as it pertains to past performance references are stated below.

a . Recent, as defined under this factor, is a contract in process (at least at the 30% design submittal) or completed within ten (10) years of the Solicitation closing date., Information on recent and relevant subcontracts and/or commercial contracts may be submitted.

b. Relevant, as defined under this element, is a contract that is similar in scope, magnitude, and complexity to the requirements as set forth in the Solicitation.

• Scope: The Offeror’s submitted contract examples cover the areas defined in the scope of the project.

• Magnitude: The measure of the similarity of the volume, dollar value, and/or duration of the work actually performed under the Offeror’s submitted contracts to the scope of the project.

• Complexity: The measure of the similarity of technical difficulty, managerial intricacy, and/or required coordination of efforts and disciplines performed by the efforts in its submitted contracts to the scope of the project. For complexity, not only will the task performed by the Offeror be considered, but also the Offeror’s ability to coordinate task (e.g., concurrent performance requirements).

A Past Performance Data Sheet (Attachment A) is requested to be submitted for each contract to be considered an example of past performance, with exceptions to contracts that have a completed

CPARS.

The Offeror shall provide a detailed explanation demonstrating the similarity of the contract to the requirements of the Solicitation; a detailed description of the work performed for the contract; and role performed (e.g., Prime or subcontractor). The Offeror is responsible for the accuracy of all data provided. Past Performance information regarding predecessor companies, key personnel who have relevant experience, and/or subcontractors that will perform major or critical aspects of the Solicitation requirements may be provided as a past performance submissions.

For each contract(s) the Offeror describes in a Performance Data Sheet (Attachment A), the Offeror is requested to provide a PPQ (Attachment B) to a reference at the organization that awarded the contract. It is requested that the reference, not the Offeror, email the completed PPQ BEFORE THE DUE DATE FOR PROPOSALS directly to Contract Specialist Hien Ho, via email at hien.ho@usace.army.mil. Facsimile submittals will not be considered.

In conducting its past performance evaluation, the Government will review PPQs submitted with the offeror’s proposal and may utilize previously submitted PPQs from other solicitations and projects.

Offerors are advised that the Government is under no obligation to review PPQs that are merely incorporated by reference in the proposal. Any PPQs that offerors seek to ensure are reviewed by the Government must be included in their entirety with the proposal submission or submitted directly to the Government from the offeror’s clients in accordance with the submittal procedures in the RFP.

The Offeror shall instruct its clients to reference the Solicitation Number in the subject line when submitting its PPQ(s). The PPQ is Source Selection materials. If the client submits a PPQ directly to the Government's point of contact, all successfully submitted PPQ(s) will receive an e-mail confirmation upon receipt. If the Offeror’s client does not receive the confirmation, it is the Offeror’s responsibility to follow up to ensure the Government has received the information.

The Government intends to assess the relative risks associated with the Offeror’s performance based on the past performance information provided in its proposal and, if applicable, information obtained from available sources identified previously. A significant achievement, unexplained or unresolved problem, or lack of relevant data may significantly impact the risk rating by the Government.

Therefore, it is incumbent upon the Offeror to include all relevant information, including demonstrated corrective actions, in its proposal.

If any contracts were terminated, whether for default or cause, the Offeror shall list each, providing the contract number, title, brief type of work effort, and the reason for the termination.

C. Volume III – Cost/Price

Volume III shall be clearly marked “VOLUME III – SOLICITATION W912DW24R0019 – Cost/Price.”

Factor 3: Cost/Price

The information required within an Offeror’s cost/price proposal is described in the Solicitation, Section 00 22 16. Within an Offeror’s price proposal, the following shall be submitted:

a . Proposal Data Sheet (Attachment C)

b. Completed SF 1442

c. Completed Price Schedule

The Offeror’s costs/prices shall be rounded to the nearest dollar.

The Offeror shall verify that the information for all forms submitted is current, correct, and complete, including names of points of contact, email addresses, and telephone numbers.

Failing to submit or fill out attachments correctly may result in rejecting the Offeror's proposal without further evaluation. Therefore, Offeror is to follow instructions and raise questions through inquiries if instructions need to be understood.

The Government reserves the right to require the submission of certified cost or pricing data or data other than certified cost and pricing data if deemed necessary to arrive at a fair and reasonable price.
