1.3 DESIGNER OF RECORD
The contractor shall identify, for approval, the Designer of Record (DOR) who shall be responsible for each area of design. One DOR may be responsible for more than one area. All areas of design disciplines shall be accounted for by a Professional Registered, DOR. The DORs shall stamp, sign, and date each design drawing and other design deliverables under their responsible discipline for the final review (see contract clause Registration of Designers). If the deliverables are not ready for release for construction, they should be identified as "preliminary", "not for release for construction" or some other appropriate designation. The DOR(s) shall also be responsible for maintaining the integrity of the design and for compliance with the contract requirements through construction and documentation of the as-built condition by coordination, review and approval of extensions of design, material, equipment and other construction submittals, review and approval or disapproval of requested variations to the accepted design or to the contract, coordination with the Government of the above activities, and by performing other typical professional designer responsibilities.

3.3.3 Design and Code Checklists
Develop and utilize appropriate discipline-specific checklists to be used during the design and quality control of each submittal. These completed checklists shall be submitted with each design submittal, as applicable, as part of the project documentation. See SECTION 01 45 00.00 10 QUALITY
CONTROL.
3.4 INTERIM DESIGN REVIEWS AND CONFERENCES
3.4.1 General
Conduct at a minimum one (1) interim design review: 30 percent design review. May include additional interim design conferences, as needed, to assure continued Government concurrence with the design work. The 30 percent submittal review period and conferences shall be included in the Project Schedule. The required interim design conference shall be held when interim design requirements are reached as described below.
3.4.2 Procedures
After receipt of a 30 Percent Design submission, the Government will be allowed up to thirty (30) calendar days after receipt of the submission to review and comment on the 30 percent design submittal. For each interim design review submittal, the Contracting Officer's Representative (COR) will furnish, to the Contractor, a single consolidated, validated listing
SECTION 01 33 16.00 28 Page 14 of all comments from the various design sections and from other concerned agencies involved in the review process using the Dr Checks Design Review and Checking System. The review will be for conformance with the technical requirements of the solicitation and the Contractor's RFP proposal. If the Contractor disagrees technically with any comment or comments and does not intend to comply with the comment, clearly outline, with ample justification, the reasons for noncompliance within five (5) days after receipt of these comments in order that the comment can be resolved.
Furnish disposition of all comments, in writing, through Dr Checks. The Contractor is cautioned that if it believes the action required by any comment exceeds the requirements of this contract, that it should take no action and notify the COR in writing immediately. An Interim Review conference will be held for the 30 percent review submittal at Albeni Falls Dam conference room, or as agreed upon as part of the partnering process. Bring the personnel that developed the design submittal to the review conference. The conference will take place the week after the receipt of the comments by the Contractor. For smaller fast-track packages that involve only a few reviewers, the parties may agree to alternative conferencing methods, such as teleconferencing.
3.4.3 Conference Documentation
Prepare meeting minutes and enter final resolution of all comments into Dr Checks. Copies of comments, annotated with comment action agreed on, will be made available to all parties before the conference adjourns.
Unresolved problems will be resolved by immediate follow-on action at the end of conferences. Incorporate valid comments. The Government reserves the right to reject design document submittals if comments are significant. Participants shall determine if any comments are critical enough to require further design development prior to Government concurrence. Participants shall also determine how to proceed in order to obtain Government concurrence with the design work presented.
3.5 100 PERCENT DESIGN REVIEW AND CONFERENCE
A 100 percent design review and review conference will be held upon completion of 100 percent design at Albeni Falls Dam conference room.
Include the 100 percent design conference in the Project Schedule. The 100 percent design conference will be held after the Government has reviewed the 100 percent design package and supporting data. For smaller packages, especially those involving only one or a few design disciplines, the parties may agree on a shorter period.
3.6 ACCEPTANCE AND RELEASE FOR CONSTRUCTION
At the conclusion of the 100 Percent Design Review, after resolutions to the comments have been agreed upon between DOR and Government reviewers, the Contracting Officer will accept the 100 percent Design Submission for the design package in writing and allow construction to start for that design package. The Government may withhold acceptance until all major corrections have been made or if the 100 percent design submission requires so many corrections, even though minor, that it is not considered acceptably complete.
Government review and acceptance of design submittals is for contract conformance only and shall not relieve the Contractor from responsibility to fully adhere to the requirements of the contract, including the Contractor's accepted contract proposal, or limit the Contractor's responsibility of design as prescribed under Special Contract Requirement:
SECTION 01 33 16.00 28 Page 15
"Responsibility of the Contractor for Design", or limit the Government's rights under the terms of the contract. The Government reserves the right to rescind inadvertent acceptance of design submittals containing contract deviations not separately and expressly identified in the submittal for Government consideration and approval.
3.7 IDENTIFICATION OF DESIGN SUBMITTALS
Provide a title sheet to clearly identify each submittal, the completion status, and the date. The title sheet shall be unique to a particular design submittal. Submit the project title sheet with design status and date for the design submittals.
3.8 SUBMITTAL DISTRIBUTION, MEDIA AND QUANTITIES
3.8.1 Mailing of Design Submittals
3.8.1.1 Delivery
Mail all design submittals to the Government during design and construction, using an overnight mailing service. The Government will furnish the addresses where each copy shall be mailed to after award of the contract and task orders.
3.8.1.2 Transmittal Identification
Each design submittal shall have a transmittal letter accompanying it indicating the date, design percentage, type of submittal, list of items submitted, transmittal number, and point of contact with telephone number.
3.9 THE CONTRACT AND ORDER OF PRECEDENCE
3.9.1 Contract Components
The contract consists of the solicitation, the approved proposal, and the 100 percent design.
3.9.2 Government Approval
Government review or approval of any portion of the proposal or 100 percent design shall not relieve the Contractor from responsibility for any errors or omissions with respect thereto.
3.10 MANAGING REVIEWS
3.10.1 General
Throughout the design process, enter, track, and back-check comments using the Dr Checks system. DORs shall annotate comments timely and specifically to indicate exactly what action will be taken or why the action is not required. Comments considered critical by the conference participants shall be flagged as such.
3.10.2 Dr Checks Review Comments
Monitor Dr Checks to assure all comments are annotated and agreed to by the designers and reviewers prior to the next submittal. The Dr Checks comments and responses shall be printed and included in the design analysis for record. Conference participants (reviewers) will expect coordination between Design Analysis calculations and the submitted design. Reviewers will also focus on the design submittal's satisfaction of the contract requirements. The DORs shall answer each comment in Dr
SECTION 01 33 16.00 28 Page 16
Checks with a formal response prior to the next submittal, clearly indicating the action that was taken and what drawing/spec was changed. Do not answer any comment until after the DORs have confirmed that the change was completed on the document in question. DORs are encouraged to directly contact reviewers to discuss and agree to the formal comment responses rather than relying only on Dr Checks and review meetings to discuss comments. With the next design conference, reviewers will back-check answers to the comments against the submittal, in addition to reviewing additional design work. Comments that, in the Contractor's opinion, require effort outside the scope of the contract shall be clearly indicated as such in Dr Checks. Do not proceed with work outside the contract until a modification to the contract is properly executed, if one is necessary.
3.10.3 Dr Checks Initial Account Set-Up
The Government will request an office setup in Dr Checks for the Contractor. The Contractor's Lead Designer of Record will be the name of the person that the Government gives to Dr Checks as the contact person for the Contractor. To initialize an office's use of Dr Checks a representative of Dr Checks will call the DOR and setup the Contractor's office in DR checks. This POC (Designer of Record) will be given an office password to distribute to others in the office if needed. Individuals can then go to the hyperlink at {http://www.projnet.org} and register as a first time user. Upon registration, each user will be given a personal password to the Dr Checks system. Once the office and individuals are registered, the COE's project manager or lead reviewer will assign the individuals and/or offices to the specific project for review. At this point, persons assigned can address enter comments, answer comments, and close comments, depending on their particular assignment. For this contract the Contractor and/or Lead Designer of record, or their designated representative will generally, this could be subject to change, be able to answer comments, not enter or back check comments. If you need to call the Dr Checks Help Desk, the number is 800-428-HELP. Hours of operation are Monday-Friday, 8AM-5PM, Central time.
3.10.4 Dr Checks Reviewer Role
The Government will take the role of the reviewer to enter comments into the Dr Checks system that result from each design conference. To enter comments:
