All Offerors shall submit information substantiating the Offerors’ past performance in complying with FAR Clause 52.219-8, “Utilization of Small Business,” maximizing opportunities for U.S. small business subcontractors. Offerors shall also provide a statement indicating whether any negative information has been reported in the past 5 years concerning the Offerors’ past compliance with FAR Clause 52.219-8. If any such negative information has been reported, the Offeror may submit explanations or comments responding to such negative information. Offerors with no prior contracts containing FAR Clause 52.219-8 shall certify the same; however, they may provide documentation from customers; local, state or federal agencies that demonstrates use/support of small businesses. Note: For small businesses, the SBEB is looking to determine an offerors compliance with FAR 52.219-8 of which have been totally completed by a small business offeror and/or subcontracting to other small businesses.
In support of FAR 52.219-9 other than small business/large business offerors must submit a minimum of 3, but not more than 5 ISRs and include a brief description of each project to support ISRs. The description must describe the services/supplies provided under the contract, size, complexity, contract number, etc. Ensure that ISRs are of similar size, scope and complexity. For each project submitted, include the corresponding most recent Individual Subcontracting Report(s) (ISR), covering the period of performance for the submitted project.
Customer letters of commendation for use/support of small businesses, correspondence from small business subcontractors that provided support, and Small Business Administration Compliance Reviews will also be accepted. The SBEB must be able to determine which ISR, customer letter of commendation, etc., goes with each project description. Therefore, project descriptions should be directly followed by the ISR or other supporting documentation described above for reference purposes.”

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
SUBMISSION INSTRUCTIONS
1. Introduction.
The intent of this Request for Proposals (RFP) is to solicit proposals under a Multiple Award Environmental Services (MAES) contract, hereafter referred to as MAES 2017, in support of the North Atlantic Division (NAD) – Baltimore (NAB), Environmental and Munitions Design Center (EMDC).
The geographic area of coverage will primarily be the North Atlantic Division (NAD) mission Area of Responsibility (AOR); with incidental utilization in the Continental United States, Alaska, Hawaii and Puerto Rico. Contracts awarded under this MATOC may also be made available for use by other Districts to support mission critical projects in those Districts when capacity is not available locally.
The business goal of the contract is to award a total of up to ten (10) contracts, with a total shared capacity of $230M with a five (5) year ordering Period. Of the 10 contracts proposed; up to six (6) contracts will be reserved for Small Business.
The contracts may be for a wide range of environmental services. The work may require actions to characterize and/or remediate radioactive material or military munitions and explosive of concern (MEC) or munitions constituents (MC) as well as to perform environmental sustainability services.
Task orders issued under the MAES 2017, while primarily focused on environmental services including remediation, may include elements of construction activities that will be incidental to the remediation services provided. The requirements of each task order will be evaluated during the acquisition strategy phase to determine the percentage, if any, of construction activities. If the predominance of activities are determined to be construction, the applicable construction clauses will be invoked and the order of magnitude will be identified. Task Orders issued under this Contract may be Firm-Fixed Price (FFP) or Cost Plus Fixed Fee (CPFF) incorporating Service (Contract Act) or Davis-Bacon Act wages, as applicable, depending on the type of work being performed in each individual Task Order.
Pursuant to FAR Clause 52.215-1, the Government reserves the right to award a contract without discussions. Therefore, the Offerors’ initial proposal should contain the offeror’s best terms from a price and technical standpoint. If the Contracting Officer determines during the source selection process that discussions are necessary the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. Offerors are cautioned that “parroting” of the Technical requirements of the PWS with a statement of intent to perform does not reflect an acceptable understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.
Offeror’s shall provide proof that they will be able to obtain bonding ($150K in individual bonding capacity and $10M in aggregate bonding capacity) and have an adequate accounting system.
In order to be eligible for award of cost type task orders, in accordance with FAR Subpart 16.301-3(a) (1), offerors shall provide proof of DCAA’s verification that their accounting system has been determined adequate for determining cost applicable to the contract. The offeror shall submit either (1) documentation from the applicable Defense Contract Audit Agency (DCAA) office verifying that their accounting system has been determined adequate for determining costs applicable to the contract or submit a completed DCAA Checklist (located at http://www.dcaa.mil/preaward_accounting_system_adequacy_checklist.html). The DCAA checklist will be used by the Government only as a preliminary measure to determine if an offeror is or it’s not likely to have it accounting system approved by DCAA after award. If an award is made to any offeror who has not had the opportunity to obtain prior DCAA approval, the Government shall sponsor the awardee for DCAA approval. In the event DCAA demines approval for any sponsored awardee or withdraws approval of any other awardee, that awardee will be ineligible for award of any cost type task order.
It is anticipated that a small number of task orders may be performed at secure facilities, where security clearances are required. To be considered for such a task order, the offeror would be required to provide proof that the key management personnel, and personnel in required disciplines, possess valid Top Secret security clearances. Also, a firm making a proposal on a task order that requires work at a secure facility may be required to possess a final Industrial Security Facility Site Clearance of Top Secret for the office out of which the project will be managed. The appropriate Security Clearance identified in
PWS will be an evaluation factor at the task order level when deemed necessary.
Offerors shall submit in their proposal all requested information specified in this section of the solicitation at or before the exact time specified. There will be no public opening of the proposals received as a result of this solicitation. If an Offeror believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise unsound, the offeror shall immediately notify the Contracting Officer in writing with supporting rationale.
In accordance with FAR Subpart 4.8 (Government Contract Files), the Government will retain one copy of all unsuccessful proposals.
2. Proposal Submission Requirements:
a. Offerors shall submit proposals to the United States Army Corps of Engineers (USACE)
Baltimore District, at the address shown in Block 7 of the Standard Form 33 (SF33) by the date and time specified in the RFP. The RFP shall provide the Government address and the receipt date for proposal submittal.
b. The offeror’s proposal shall be submitted in hard copy, with accompanying digital copies, as set forth below. The offeror’s proposal shall consist of three (3) volumes.

NOTE: Pages that exceed the required page limitations will not be evaluated. Additional pages over the maximum allowed will be removed or not read and will not be evaluated by the Government.
c. Files shall not contain classified data. The use of hyperlinks in proposals is prohibited. Each volume shall be bound separately. Any pages that are changed (as a result of negotiations or proposal revisions) should be of a different color and have changed information clearly marked by a vertical line in the right margin of the page. The revised pages shall be dated. Each binder shall be clearly labeled with its Title and a copy number (e.g., copy 1 of 5).
d. Printing should be single spaced. Each paragraph shall be separated by at least one blank line. A standard, 12-point Times New Roman font is required. Tables and illustrations may use a reduced font size no less than 8-point and may be landscape. All charts, graphs, diagrams, tables, photographs, drawings, etc., are included in the page limitation.
e. The page limits do not include covers for volumes, tables of contents, glossary of abbreviations and acronyms, indices, title pages, cross reference indices, and section dividers/tables if they are inserted solely to provide ease to the reader in locating parts/sections of the proposal, but pages will be counted if they contain any other information, i.e., diagrams, extraneous data, etc. Additional pages beyond the stated limit will not be evaluated. Pages will be counted if they contain any other information, i.e., diagrams, extraneous data, etc. Pages marked “This page intentionally left blank” will not be counted. Pages may be submitted as “Double Sided”; however each side will count towards the page limitation.
3. Proposal Files
a. Format. The proposal shall be clearly indexed and logically assembled. Each volume shall be clearly identified and shall begin at the top of a page. All pages of each volume shall be appropriately numbered and identified by the complete company name, date and RFP number in the header and/or footer.
A Table of Contents should be created for each volume. Labeled Section Tabs shall be used to separate sections in the document. MS Word (doc) files shall use the following page setup parameters:

NOTE: 11X17 folded pages are acceptable for tables/graphic representations; however, each 11X17 page counts as two pages. A smaller type may be used on charts, graphs, figures, diagrams, and schematics to accommodate a “make to fit” software capability; however, all text shall be legible and easily read.
b. Electronic Files: Offerors shall provide all proposal files in electronic format on a CD/DVD. Files shall be in read-only format, using PDF files. In addition, price spreadsheets shall be submitted in Microsoft Excel Read/Write format and shall demonstrate all formulas used in the preparation of the cost/price data viewable in Microsoft Excel 2010. Electronic files shall be labeled and indexed the same as the corresponding hard copy proposal. The CD/DVD shall be externally labeled with the volume number, date, and offeror’s name.
**Please note Self extracting exe files are not acceptable. If the hard-copy proposal differs from the electronic version, the hard copy will govern.
c. Content Requirements: All information shall be confined to the appropriate file. The offeror shall confine submissions to essential matters, sufficient to define the proposal in a concise manner, to permit a complete and accurate evaluation of each proposal. The use of outlines, tables, and other means of summarizing pertinent and required information is encouraged. Proprietary information shall be clearly marked.
1) Volume 1 – Technical. A title page is required by FAR Clause 52.215-1(2)(c)(i)-(v) and must be submitted by all offerors. Please refer to FAR Clause 52.215-1(2)(c)(i)-(v) for contents.
The written proposal shall contain complete written responses to Factors 1 through 5. A 125-page limitation applies to Volume I, Factors 1 – 5. Pages submitted beyond this page limitation will not be read or evaluated. Volume 1 shall be organized into the following sections:
i. Executive Summary: Volume I of the proposal shall include an Executive Summary (ES) which should provide an introduction of the Offeror’s firm (business size and cage code), proposal team, firm’s capabilities, Point of Contact and phone number. The ES shall not exceed two (2) pages in length and will not be included in the page limit. Volume I shall not contain any pricing information.
ii. Factor 1: Sample Problem (Page Limitation: 25 pages)
Offerors shall provide a narrative describing their technical approach, to include a conceptual site model, to the hypothetical sample problem, as provided in Section J, Attachment 6. Offerors should clearly describe all assumptions used when developing their approach as though the offeror were submitting a real proposal for a combination Firm Fixed Price and Cost Reimbursement task . Offerors should identify and cite applicable regulations. The technical narrative shall not exceed 25 pages.
Cost/Price information related to the sample problem shall be submitted and evaluated under Factor 7.
iii. Factor 2: Relevant Corporate Experience/Project List (page limitation 30 pages)
Describe at least five (5) but no more than eight (8) recent and relevant projects performed as the prime or major subcontractor which demonstrate the offeror’s experience. Five
(5) of the projects should be of the following types: CERCLA groundwater remediation;
CERCLA soil remediation; bioremediation; investigation or remediation of a radiological site; landfill cap construction or repair; environmental compliance; free product recovery;
underground storage tank removal/closure/replacement. If the proposal is from a Joint Venture (JV), there must be a minimum of two projects from each company where that company acted as the prime offeror. Demonstrated experience with a variety of environmental services/remediation project types, projects that demonstrate experience with performance based acquisitions, and projects that demonstrate experience with different phases of the CERCLA process will be viewed more favorably. Additionally, projects with regulatory interaction in the states of Maryland, Virginia, Pennsylvania, New York and New Jersey will be viewed more favorably than regulatory interaction with other states.
The offeror should list all stakeholders and/or regulators involved in the project, the stakeholders and/or regulators role in the project and describe the offerors interaction with the stakeholders/regulators. Additionally, the offeror should indicate if the projects were performance based and whether or not the performance objectives were achieved with supporting narrative.
Project experience from formal Teaming Partners may be included.
For each project, the Offeror shall utilize the attched Experience in Relevant Projects provided in Section J of the solicitation. Offerors may add lines to the Experience in Relevant Form to provide additional project details provided to the 30 page limitation is not exceeded.
The Offeror shall provide documentation outlining the offeror’s experience with contracts, as a prime or major subcontractor. The submittal shall include rationale supporting your assertion of relevance and how it was determined that the work performed previously was the same or similar in nature, size, and complexity to the work specified by this solicitation. In addition, the offeror shall address the following elements within the narrative:
(1) demonstrated ability to manage projects which were completed on time, within budget, and met the projects’ objectives;
(2) demonstrated ability to manage regulatory interface and stakeholder interface;
(3) demonstrated ability to manage multiple, concurrent projects;
(4) demonstrated ability of managing projects with performance-based milestones; and
(5) demonstrated ability to implement processes to save time and costs for the customer.
For the purposes of this factor, the term “recent” is meant to apply to a project that has been completed within the last five (5) years as of the RFP closing date, or is currently being performed and is at least 75% complete (as measured by dollars and performance). The term “relevant” is meant to apply to similar services as described by this RFP.
iv. Factor 3: Past Performance (Past Performance Questionnaires (PPQ) do not count towards the page limitation)
PPQ: For all projects identified in Factor 2 – Relevant Corporate Experience/Project List pertaining to the Offeror (prime offeror, partnership, JV offerors, etc.), a PPQ form must be completed and submitted. The PPQ form included in this RFP (Section J) is provided for the offeror or its team members to submit to their customer(s) for each project the offeror includes in its proposal for Factor 2 – Relevant Corporate Experience/Project List. A one page introduction or summary page may be included, if desired; however, the content of that summary or introduction page will not be evaluated.
(1) The PPQ form included in this RFP is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 2 – Relevant Corporate Experience/Project List. Ensure correct phone numbers and email addresses are provided for the client point of contact.
(2) PPQ forms must be submitted by previous customers for each project the offeror includes in its proposal for Factor 2 – Relevant Corporate Experience/Project List.
(3) Completed PPQs should be submitted by the previous customer directly to the Government’s point of contact, Kathy Brown via email at Kathryn.E.Brown@usace.army.mil prior to proposal closing date of the solicitation. Make sure the email is titled: “W912DR-16-R-0004 PPQ for (insert Company’s name)” Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
(4) In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using a Contractor and Government Entity(CAGE) code/ Data Universal Numbering System (DUNS) numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
v. Factor 4: Relevant Technical Capabilities/Key Personnel (page limitation 40 pages)
The Offeror shall provide the resumes of the proposed individuals that will be filling the key personnel positions, as indicated below. Resumes should not exceed two (2) pages per individual. Resumes will be evaluated to determine the depth and breadth of their individual experience and training as it relates to the responsibilities each person will have on this contract; as well as for geographic availability, technical knowledge of Federal, State and local laws, regulations and guidance applicable to this procurement. Prior experience of the proposed personnel with performance-based contracts will also be considered.
Program Manager for this contract: Personnel with prior experience with the management of Environmental Services/Remediation MATOCs will be looked upon more favorably than those without Environmental Services/Remediation MATOC experience.
Corporate Health and Safety Officer: The offeror shall provide the resume of the proposed Corporate Health and Safety Officer. The minimum requirement for the Corporate Health and Safety Officer is that they be a Certified Industrial Hygienist (CIH) and have a minimum of three (3) consecutive years of environmental services/remediation experience. Personnel who also hold a Certified Safety Professional (CSP) certification will be looked upon more favorably.
Senior Project Manager: The offeror shall provide a minimum of two (2) but no more than three (3) resumes for individuals who are trained and experienced as Senior Project Managers. The minimum requirement for a Senior Project Manager is seven (7) years of documented environmental services/remediation project management experience.
Site Safety and Health Officer: The offeror shall provide a minimum of two (2) but no more than three (3) resumes for individuals who are trained and experienced as Site Safety and Health Officers. Site Safety and Health Officers must have a minimum of five (5) years of continuous field site safety oversight experience and be 40-hour HAZWOPER trained. Personnel with a broad range of field oversight experience will be looked upon more favorably than personnel without a broad range of field oversight experience.
Senior Environmental Engineer: The offeror shall provide a minimum of two (2) but no more than three (3) resumes for individuals who are trained and experienced as Senior Environmental Engineers. The minimum requirement for a Senior Environmental Engineer is the possession of a Professional Engineer (PE) license and seven (7) years of documented environmental remediation experience.
Certified Health Physicist: The offeror shall provide a minimum of one (1) but no more than two (2) resumes for individuals who are trained and experienced as a Certified Health Physicist. The minimum requirement for the Certified Health Physicist (CHP) is possession of CHP certification and seven (7) years of documented environmental services/remediation experience.
Senior Hydrogeologist: The offeror shall provide a minimum of one (1) but no more than two (2) resumes for individuals who are trained and experienced as Senior Hydrogeologist. The minimum requirement for a Senior Hydrogeologist is seven (7) years documented experience as a hydrogeologist working in the environmental investigation/remediation field.
Senior Risk Assessor: The offeror shall provide a minimum of one (1) but no more than two (2) resumes for individuals who are trained and experienced as a Senior Risk Assessor. The minimum requirement for a Senior Risk Assessor is seven (7) years documented experience as a Risk Assessor working in the environmental investigation/remediation field.
Senior Chemist: The offeror shall provide a minimum of one (1) but no more than two
(2) resumes for individuals who are trained and experienced as a Senior Chemist. The minimum requirement for a Senior Chemist is seven (7) years documented experience as a Chemist working in the environmental investigation/remediation field.
Technical Support Disciplines (for example; but not limited to: Senior Geologist, Senior Geophysicist, Senior Biologist, Geographic Information Specialist (GIS) Specialist)
iv. Factor 5: Management/Organizational Capabilities (page limitation 25 pages).
The offeror shall identify and describe the organizational management approach it plans to utilize to meet the requirements of Section C (Performance Work Statement (PWS)) of the RFP. Areas discussed should include:
Indicate the workforce size, capabilities, and organizational structure of the team as a whole, to include subcontractors or teaming partners (if applicable). The Government should be able to easily see the depth, diversity of technical disciplines and years of experience of the offeror’s qualified personnel.
Include organizational relationships with any proposed subcontractor or teaming partners, and describe to what extent the prime has successfully worked with the proposed subcontractors in the past. Include locations and functions of significant organizational offices.
Present an organizational chart that clearly defines roles and responsibilities and lines of authority for all personnel and subcontractors proposed. The chart should clearly identify reporting lines.
Provide a list of subcontractors to be utilized under this contract, how it will be determined if they are included in a particular task order, and what they will be doing.
Describe how you would simultaneously manage multiple projects of varying size, complexity and location, and accommodate unexpected surges if the need arises.
Describe your organization’s plan to manage risk (to include identification of risk elements and risk mitigation strategies) and your plan to manage contract performance to ensure quality.
2) Volume II: Factor 6 – Small Business Participation Plan (SBPP) (no page limitation). Large businesses are also required to submit a subcontracting plan under separate cover (Tab B) within this volume. The volume shall be organized into the following sections:
SBPP Format: The format below is to be utilized for the Small Business Participation Plan, but does not preclude offerors from providing additional information that further demonstrates their extent of commitments to small businesses presently and in the past.
All offerors (both large and small businesses) are required to complete a Small Business Participation Proposal (SBPP).
