PERFORMANCE WORK STATEMENT

PERFORMANCE WORK STATEMENT

PARK ATTENDANT

Bridge View Park Rathbun Project

C.1.1 BACKGROUND. The Rathbun Lake Project is located on the Chariton River in Appanoose County, Iowa. It is approximately 9-miles north of Centerville, Iowa, and about 16-miles north of the Iowa-Missouri state line. The project includes multiple parks and general public access areas with supporting facilities for use by the public. Park Attendant Contractors will be required to use a Government-furnished computer system to access and successfully utilize the National Recreation Reservation System (NRRS), which will be the method for collecting and entering all fees. Extensive interaction with the public will also be necessary. Contractors shall perform to the standards in this contract.

This is a best value type contract selection process. Contractors are encouraged to provide all pertinent information, such as resumes, past performance questionnaires, and references that demonstrate the qualities that are supportive to satisfactory contract performance.

The Rathbun Lake Project Administrative Building and Complex is located at:

U.S. Army Corps of Engineers Rathbun Lake Project 20112 Hwy J5T Centerville, Iowa 52544

Bridge View Park is located at the west end of the lake and has heavy weekend and holiday use and moderate weekday use. There are approximately 103 camp sites, two shower buildings and a picnic area included in the areas to be serviced.

C.1.1 CONTRACTOR PERSONNEL.

C.1.1.1 MANPOWER REQUIREMENT:

The Contractor shall personally perform, or provide direct personal superintendence of the employees engaged in the performance of duties under the contract. All employees working under this Contract shall be as identified in the Contractor's proposal and shall be subject to approval of the Contracting Officer. Approval shall be conditioned on proof of bonding and a criminal records check demonstrating no felony adjudications of any type or misdemeanor adjudications involving theft or sexual offenses. An "adjudication" shall mean a conviction or any plea of guilty or no contest, or any judicial finding of guilty to the charge, regardless of whether sentence is actually imposed.

Equally-qualified employees may be substituted upon written request and the concurrence of the Contracting Officer based on the criteria stated. All personnel shall be covered by the insurance and bonding requirements of this Contract.

C.1.1.2 SECURITY REQUIREMENTS: Contractors shall safeguard all Government property. Keys to the Park Attendant booth and storage sheds will be provided to Contractors. Contractors shall establish and implement methods of making sure all keys issued by the Government for Contractor’s use are not lost or misplaced, and are not used by unauthorized persons. If keys are lost, the contractor shall bear the cost of replacement keys and rekeying of locks.

C.1.9

1.9.1 PARK ATTENDANT TRAINING. Prior to beginning performance of this Contract, Park Attendant Contractors are responsible for ensuring that all Contractor employees and personnel are familiar with the requirements of this Contract and are properly trained in the use of National Recreation Reservation System, NRRS), and the use of credit card machines for acceptance of fees. Failure of the Contractor to properly train employees and personnel, resulting in unsatisfactory performance of this Contract, will be grounds for termination of the Contract. To ensure that all potential Contractors have an adequate opportunity to compete for award, Contractors and their employees and personnel may attend training prior to the start of services. Such training is provided free of charge by the Government and contractor attendance shall be free of charge to the Government. Normally this is accomplished over a two-day period during the five (5) days prior to start of services. Training will be provided on location at the booths by one of the Park Rangers.

C.1.10 QUALITY CONTROL (CONTRACTOR’S RESPONSIBILITY). Each Contractor shall develop a Quality Control Plan designed to demonstrate how that Contractor will meet the needs of the Project. The Quality Control Plan shall document how the Contractor will identify and correct performance shortfalls. Complete records of all inspection work performed by the Contractor must be maintained and made available to the Government during contract performance

C.1.11 QUALITY ASSURANCE (GOVERNMENT’S RESPONSIBILITY).

C.1.11.1 QUALITY ASSURANCE PLAN (QAP). A Quality Assurance Plan will be used during the life of each contract to ensure that Contractors perform the services required by this PWS in an acceptable manner. The Government develops the QAP, and the Project Office administers the plan.

C.1.11.2 GOVERNMENT SURVEILLANCE PLAN. The Government will monitor

Contractor performance using quality assurance procedures developed by the Government. Typical procedures might include random sampling, checklists, and customer complaints. This should not be considered an exhaustive list. A primary objective of Government Quality Assurance will be to determine the effectiveness of the Contractor’s quality control system.

C.1.11.3 INSPECTIONS. According to the Inspection of Services clause (52.246-4 Inspection of Services-Fixed Price), the Government reserves the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The Government will perform inspections in a manner that will not unduly delay the work. The government will perform random recreation fee audits throughout the summer.

C.1.11.4 UNSATISFACTORY PERFORMANCE. If any of the services do not conform to contract requirements, the Government may request the Contractor to perform the services again, where appropriate, in conformity with contract requirements, at no increase in contract amount. When the defects in services cannot be corrected by re-performance, the Government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements, and (2) reduce the contract price to reflect the reduced value of the services performed. NOTE: If the contractor fails to promptly re-perform the services or to take the necessary action to ensure future performance in conformity with contract requirements, the Government may by contract, or otherwise: (1) perform the services and charge to the Contractor any cost incurred by the government that is directly related to the performance of such service, or (2) terminate the contract in whole or in part.

C.1.12 OTHER CONTRACTORS. Contractors shall not commit or permit any act which may interfere with the performance of work by another Contractor or Government staff.

The EM-385-1-1 is hereby incorporated by reference, and the Contractor is required to perform this contract in accordance with the standards set forth therein. Any equipment or materials not in conformity with this manual shall be removed from Government property immediately. The Contractor will be expected to take a vital interest in safety, hazard, and to educate their employees to work and plan their work safely.

C.1.17 Payment.

Payment will be made monthly by the Disbursing Officer, U. S. Army Engineer District, Millington Tenn. in accordance with the Prompt Payment Act (Public Law 97-177). This is a flood control project. Occasional retention of floodwaters may inundate portions of the park area, other areas, or access roads thereto, being serviced by this purchase order. In the event that inundation materially affects the scope of work, the Contractor will be requested to submit a pricing proposal covering the unserviceable or affected portion of his work in order that an equitable adjustment to purchase order price can be negotiated and an adjustment made in accordance with the appropriate contract clause entitled “changes”.
