1) We would like to know if this is a brand-new contract OR if there is (was) an incumbent performing these services.

a. Brand new contract.

2) Must a quoter hold each of the three licenses/certifications listed above at the time of quote submission, or may a quoter that is not currently licensed in the State of Hawaii submit a quote supported by a written commitment and a documented plan to obtain the required licensure prior to the contract start date, consistent with PWS 3.2?

a. The licensing requirements are treated differently based on whether they are company-level or personnel-level, in accordance with the amended Addendum to FAR 52.212-1, paragraph 3.e. The State of Hawaii C-18 Contractor License is a company-level requirement and must be active and submitted with the quote. The EPA Section 608 Certification and Hawaii EJ/ES Electrician Licenses are personnel-level requirements. For these, offerors must submit a written commitment and a detailed staffing plan demonstrating their capability to furnish fully credentialed personnel within ten (10) calendar days of contract award. Actual personnel licenses are not required with the quote.

3) If licensure is required at the time of quote submission, does the Government intend the C-18 requirement to apply to the quoter as the prime contractor specifically, or may the requirement be satisfied by a proposed first-tier subcontractor holding a current C-18 who will perform the licensed portion of the work? If the latter is acceptable, what documentation of the teaming arrangement should accompany the quotation?

a. Yes, the C-18 requirement may be satisfied by a proposed first-tier subcontractor. As stated in the amended Addendum to FAR 52.212-1, Subfactor A, if an offeror is utilizing a subcontractor to meet this requirement, they must include a copy of the subcontractor’s valid C-18 license along with a signed Teaming Agreement or Letter of Intent (LOI) with their quote.

4) With respect to the EPA Section 608 certification and the Hawaii EJ/ES electrician license, PWS 2.1.11.1.4 refers to work performed by "employees or subcontractor personnel." Please confirm that technicians employed by a subcontractor who hold these credentials satisfy the Subfactor A requirement.

a. Technicians holding the required EPA and State of Hawaii licenses who are employed by a designated prime or subcontractor fully satisfy the personnel licensing requirements. The contractor is responsible for ensuring all personnel, including those of subcontractors, are properly credentialed within the timeline specified in PWS 3.2.

5) If a plan to obtain licensure is acceptable in lieu of current licensure, what evidence would the Government consider sufficient — for example, a submitted DCCA application, a letter of intent from a qualifying individual, or an executed teaming agreement?

a. A plan to obtain licensure is not acceptable in lieu of a current, active license for the State of Hawaii C-18 Contractor License, which must be submitted with the quote. For the personnel-level certifications (EPA 608 and EJ/ES), a credible written commitment and a detailed staffing plan is the required evidence, as outlined in the amended Addendum to FAR 52.212-1.
