About this file
This is a Limitations on Subcontracting compliance request letter and review form issued by the U.S. Army Mission and Installation Contracting Command, 923rd Contracting Battalion, dated 21 May 2026. The letter requests that a small business contractor complete and submit a Limitations on Subcontracting Review document to verify compliance with RFO FAR Clause 52.219-14 (Deviation 2026-O0038) by 15 August 2026 at 1000 CST, and annually thereafter upon exercise of an Option Period. The contract imposes a requirement that the contractor will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Under 15 U.S.C. § 645(g), violating this limitation incurs a penalty equal to the greater of $500,000 or the dollar amount expended in excess of permitted levels on subcontractors.
The enclosed review form (Contract W911RX26RA004) requires the contractor to certify whether it intends to self-perform all work or subcontract portions of performance. If subcontracting occurs, the contractor must provide a detailed breakout of prime versus subcontractor costs in dollars and percentages, identifying whether subcontracted work is performed by similarly situated or not similarly situated entities. For similarly situated subcontractors, the form requires submission of the subcontractor name, CAGE Code or Unique Entity ID, assigned NAICS code, and confirmation of small business status. For service contracts only, contractors may separately identify materials and other direct costs with supporting rationale. All information must be certified as true and correct by an authorized company representative. The Procurement Contracting Officer is Christopher A. Richie, and the Contract Specialist is Shannon Campbell; both are available to address questions.
