BASIC PERFORMANCE WORK STATEMENT

ADMINISTRATIVE SUPPORT SERVICES

PERFORMANCE WORK STATEMENT (PWS)

ADMINISTRATIVE SUPPORT SERVICES

C.1. PURPOSE

The purpose of this effort is to establish an Indefinite Delivery Indefinite Quantity (IDIQ) multiple award contract vehicle under which Task Orders (TOs) may be issued to support the United States Army Research Laboratory (ARL) and the following Directorates: Office of the Director (ODIR), Laboratory Operations (LABOPS), The Army Research Office (ARO), Computational Information Sciences Directorate (CISD), Human Research and Engineering Directorate (HRED), Survivability, Lethality Analysis Directorate (SLAD), Sensors and Electron Devices Directorate (SEDD), Vehicle Technology Directorate (VTD), and the Weapons and Materials Research Directorate (WMRD).

The Contractor shall provide non-personal administrative support services based on TO requirements over the course of a five (5) year ordering period, in the functional areas of Program Management, Administration, Technical Support, Security, Financial Management, Logistics, Technical Publications, Technical Library, and Graphic/Audio Visual.

ARL’s diverse assortment of unique facilities and dedicated workforce provides world-class integrated research and analysis in the Army. As a Government research laboratory, ARL is responsible for basic, exploratory, and advanced research. Its mission is to create and sustain weapons-oriented basic, exploratory, and advanced technologies; to identify and eliminate technological barriers limiting development of future armament systems; and to establish and maintain expertise essential in solving technological problems in current military armament systems.

C.2 OBJECTIVE

The objective of this contract is to provide the requisite staffing needed to support specific program execution administrative requirements and other general administrative support services. These requirements may vary in duration and scope and may range from short duration and a single or a few positions to long-term requirements supporting an entire Branch, Division, or Directorate consisting of several dozen positions. The services provided by the Contractor will encompass administrative support duties listed in Appendix A – Labor Categories, but may include others not listed, based on specific requirements at the TO level. Service requirements will be conveyed through the issuance of TOs on as-needed basis. The Contractor shall provide the necessary personnel, supervision, materials, and non- personal services necessary to perform the specific tasks of this PWS to support the mission of ARL as specified and ordered under individual TOs. Each TO will identify the specific work category (or categories) to be utilized. Contractor employees assigned to perform the duties described in Appendix A shall meet all educational, experience, and other qualifications specified. The Contractor is responsible for providing the necessary training required to provide employees capable of performing the required tasks at the start of each TO requirement, and shall provide the necessary support to employees as needed.

C.3 REQUIREMENTS

The Contractor shall provide a work force possessing the skills, knowledge, and training to perform the services required. Under this contract, the Government may issue TOs for specific efforts requiring the labor categories identified in Appendix A, or others as defined in each individual TO PWS. Each TO will have an assigned Contracting Officer Representative (COR) to serve as the single individual to monitor performance of the technical requirements on that assigned TO. The work required by this contract shall be performed in accordance with each individual TO requirement and this Basic PWS.

C.3.1 Basic Directorate Support Services The Contractor shall provide administrative support services in the functional areas identified below, in accordance with, but not limited to, the labor categories described in Appendix A – Labor Categories:

• Program Management Support

• Administrative Support

• Technical Support

• Security Support

• Financial Management Support

• Logistics Support

• Technical Publications Support

• Technical Library Support

• Graphic/Audio Visual Support

C.3.2 Management & Personnel The Management Plan shall address adequate management, supervision and administration plans and processes to effectively manage performance and personnel at all task locations and across all Task Orders. The Management Plan shall describe how the offeror will provide direct supervision of all contracting employees (to include Major subcontractors, Joint Venture agreements, and DoD Army Mentor Protégé agreements), avoid the appearance of inherently governmental functions and personal services, and the successful accomplishment of all tasks assigned to contractor employees. A Management Plan that provides a unique, balanced approach to providing adequate supervision and employees capable of performing independently while also providing on-site and reach back support that results in 100% accomplishment of assigned tasks, meeting all deadlines routinely and effectively, providing status of progress, and two-way communication between Government Points of Contact (POC) and Contractors; thereby, improving the level of service throughout contract performance and avoiding inherently governmental and personal services will be assessed as exceeding acceptable performance requirements.

The Contractor shall retain and maintain key personnel as identified in the key personnel clause in both the basic contract award and individual TOs. Key Personnel shall be identified in the proposal and the qualifications approved by the TO COR. Key personnel shall include a Program Manager and may include supervisors, team leads, Task Order Leads or any other mix based on the proposed management plan. The Contractor shall sustain adequate coverage of all positions during contract performance and ensure no position is vacant for greater than 30 days.

C.3.2.1 This contract will not be used to procure personal services that are prohibited by Subpart 37.1 of the Federal Acquisition Regulations (FAR). To ensure compliance, and to preserve the non-personal nature of this contract, the Contractor shall adhere to the following guidelines in the performance of the contract:

• Provide for the direct supervision of all contract employees.

• Maintain open lines of communicating with appropriate Government POCs such as the COR and other authorized government leads

• Provide training on and appropriately maintain communication controls between contractors and the government personnel avoiding inappropriate communication at all times.

• Maintain appropriate level of conduct and professionalism with all government employees and other contractors.

• Ensure Contractor employees are appropriately identified at all times.

• Use work orders to document and manage the work and to define the details of the assignment and its deliverables. The Government has the right to reject the finished product or result; this does not constitute personal services.

• Travel as needed when directed by the government and the program manager. All official travel shall be in compliance with the requirements in Section C.12.

• The Contractor shall provide suitable marking on all documents or reports generated, per FAR 11.106.

C.3.3 Transition Plan The Contractor shall permit a succeeding Contractor and designated employees to observe any and all functions, procedures, and operations under this contract thirty (30) workdays prior to the Period of Performance (POP) end date of the contract. The Contractor shall complete ongoing work and prepare for an orderly transition to the successor, to include providing a list of current employee names and contact information to the basic contract COR thirty (30) workdays prior the period of performance end date of the contract. The Contractor shall fully cooperate with the successor and the Government and shall not interfere with their work or duties.

C.3.4 Rapid Support Turnaround

C.3.4.1 The Contractor shall provide Rapid Support Turnaround administrative support services.

C.3.4.2 The Contractor may be required to respond to Rapid Support Turnaround Task Order Request (TOR) requiring submission of a Task Order Proposal (TOP) in less than ten (10) calendar days. The Government will specifically identify these TORs as such upon issuance.

C.3.5 Safety/Medical Requirements The Contractor shall comply with Public Law 91-596 and each occupational safety and health standard promulgated under the Act. The Contractor shall also execute constant supervision to ensure immediate compliance with pertinent provisions of applicable regulations.

C.3.5.1 Procedural Compliance The Contractor shall perform all operations in strict compliance with all applicable safety and health procedures. Specific test procedures, limitations and cautions applicable to individual test projects and/or equipment shall be followed. If safety certification is required for an activity, only those Contractor personnel who have obtained the necessary training and certification by the ARL Safety Office may perform those operations.

C.3.5.2 Occupational Health Screenings The Contractor is required to provide personnel with pre-assignment and termination physical examinations. The Contractor shall ensure contractor personnel receive an initial occupational health screening/physical examination to include as a minimum documentation of health history, vision test, hearing test, and measurement of blood pressure, pulse and respiration. Job hazards associated with specific requirements may also require tests such as lung function, blood and urine tests. For specific requirements, the Contractor shall also ensure Contractor personnel receive periodic job-related occupational health screenings to detect early evidence of changes in health related to work performed or work areas. Periodic medical surveillance monitoring may include hearing conservation, vision conservation, respiratory protection, biological material exposure, and hazard materials exposures (such as depleted uranium) and may be required on annual basis. The Contractor shall also ensure Contractor personnel assigned to Testing Designated Positions (TDP) comply with urine analysis testing requirements.

For depleted uranium surveillance monitoring, the Government shall furnish Contractor personnel radiation film badge services. For depleted uranium, physical examination shall consist minimally of the following:

• A complete blood count (CBC) with platelet count

• A twenty-four hour urine analysis for depleted uranium

• A statement from a board certified physician that the individual is physically and psychologically able to wear a respirator

• A pulmonary function

• An Electrocardiogram (EKG)

• Hearing and vision tests

• Heavy metals tests

C.3.5.3 Record of Accidents or Incidents According to 29 Code of Federal Regulations (CFR), Part 1904, AR 385-40, and APGR 385-4, the Contractor shall report accidents resulting in injury, death, or damage to Government property, supplies, and equipment immediately. The Contractor shall report through the TO COR, to the ARL Safety Office, all incidents of employee injury or occupational illness or disease, and/or damages to Government property, materials, supplies, and equipment resulting from work performed under the contract. In addition, the Contractor shall report directly to the Contracting Officer the same incidents within 24 hours of their occurrence in accordance with ARL procedures.

C.3.5.4 Safety Certifications and Qualifications The Contractor shall maintain a record of all safety certifications and training records for their employees.

Contractor personnel shall not perform any activities for which they have not been properly trained, certified, or deemed as qualified by the ARL Safety Office with responsibilities for the specific requirement being undertaken by specific Contractor personnel.

C.3.5.5 Requests for Safety Certifications The Contractor shall coordinate all requests between the TO COR and the Contractor to initiate Contractor personnel certification for TO efforts. The Contractor and TO COR in coordination with the ARL Safety Office must approve any request prior to Contractor personnel starting a certification program.

C.3.5.6 Safety Certification Authority The ARL Safety Office will coordinate safety certifications with the Contractor and TO COR for each specific requirement. Though the ARL Safety Office is the final approving authority, the TO COR must concur on the certification.

C.3.5.7 Personnel Protective Equipment (PPE) The Contractor shall provide basic required industrial PPE for the Contractor employees in accordance with current American National Standards Institute (ANSI) and Occupational Safety and Health Administration (OSHA) standards and as necessary to fulfill the Government requirement. Basic industrial PPE includes safety glasses, safety shoes, gloves, hearing protection, lab coats, and hard hats. If needed to fulfill a requirement, the Government will furnish specialized PPE (such as loading room shoes, contaminated work area shoes, respirators, fall arrest harnesses and explosive coveralls) as specified by the operations Job Hazard Analysis (JHA) and specific Standard Operating Procedure (SOP) to be provided upon TO award.

C.3.5.8 Hazardous Conditions Hazardous conditions and/or items that may be involved in the performance of work under the contract include:

• High noise levels (impulse and steady state)

• Proximity to electrical power sources of high voltage and/or high current

• Working outside in the full range of weather conditions experienced in the APG area

• Confined space work

• Working with engines and generators fueled with gasoline and diesel

• Lifting equipment under all anticipated outdoor weather conditions

• Working at elevated altitude

• Working with laboratory chemicals that include organics, inorganics, solvents, acids, and bases

• Exposure to ionizing and non-ionizing radiation such as x-rays, lasers, radio frequency, depleted uranium, and radioactive source material

• Exposure to silica dust and iron particles

• Working with explosives, propellants, depleted uranium, lead, and ammunition

• Handling and exposure to biological materials

• Work with various forms of stored energy such as mechanical, high pressure, hydraulic, and air

C.3.5.9 Hazardous/Major Component Safety Data Sheets Hazardous/Major Component Safety Data Sheets for the typical hazardous materials will be available from the TO COR upon request.

C.3.5.10 DOD Instruction 4145.26 There is no exemption from adherence to DoD Instruction 4145.26 "Contractors Requirements for Ammunition and Explosives."

C.4 PERSONNEL

The Contractor shall provide personnel based on the basic PWS requirements, individual TO PWS requirements, and labor categories as described in Appendix A and/or the TOs. The Contractor shall provide personnel for regular scheduled services performed at the Government designated work sites. The hours of operation and place of performance will be determined by the requirements set forth in each TO. The Contractor shall sustain adequate coverage of all positions during contract performance and ensure no position is vacant for greater than 30 days.

C.4.1 Qualification Requirements

The Contractor shall provide personnel based on the duty descriptions described in Appendix A and individual TO requirements. The Contractor shall provide a workforce possessing the skills, knowledge, and training to perform the services required by TO PWS and basic PWS on day one (1) of placement at the job site. All Contractor personnel working under this contract must be U.S. citizens and shall have at least a Secret-level security clearance (reference C.5.1). Contractor personnel must be able to speak, read, write, and understand English.

C.4.2 Personnel Management The Contractor shall retain and maintain the number of key personnel, as identified in the key personnel clause in both the basic contract award and individual TO awards, who have the necessary skills, education, and experience to effectively meet basic contract and TO requirements. The Contractor shall maintain an active training, recruitment, and retention program to ensure qualified and clearable personnel sufficient to meet the contract and TO requirements are made available to support this effort (reference C.4.5).

C.4.2.1 Vacancies.

The Contractor shall ensure that no position is vacant for greater than 30 days. If the Contractor leaves a position vacant for greater than 30 days, the Government will notify the Contractor of a reduction in fee via modification equivalent to two (2) times the original un-incurred direct labor rate as specified in the Contractor’s proposal for each hour beyond the 30 days allowed to fill the position. The number of days a candidate is under review and consideration by ARL shall not count towards the Vacancy Period.

C.4.2.2 Addition/Replacement of Personnel.

The Contractor shall ensure that the personnel qualifications for each employee are adhered to In Accordance With (IAW) Appendix A and/or individual TO requirements. When an employee is added/replaced to fulfill an approved position the Contractor shall provide the COR a full resume of the employee and professional references for each experience listed (to verify scope of work experience) prior to the employee being employed under this contract.

The COR will review the resume and professional references of the proposed employee substitution to verify that the qualifications meet the requirement of the position and if so, provide their acceptance of the employee in writing to the Contractor within ten (10) working days of receipt of the request.

The Government reserves the right to perform reference checks and/or validate certifications/experience of all proposed employees prior to providing verification of personnel qualifications. If the COR verifies that the proposed personnel qualifications do not meet the required personnel qualifications, the COR will notify the PM of the reasons in writing based on a comparison of aforementioned regulations, as well as the personnel qualifications, and the resume of the proposed employee.

C.4.3 Key Personnel The Contractor shall provide at least a Program Manager (PM) (key personnel) servicing ARL, during normal work hours (reference C.7).

C.4.3.1 To facilitate efficient operations under this contract, the Contractor shall ensure the PM:

C.4.3.1.1 Serves as the main point of contact for all Contractor personnel.

C.4.3.1.2 Is responsible for overall management of the basic contract and each TO award.

C.4.3.1.3 Conducts regularly scheduled meetings with both the basic contract COR and TO CORs at least once per month or at the discretion of the COR.

C.4.3.1.4 Has a technical background that facilitates understanding of Government technical requirements and communication with the COR.

C.4.3.1.5 Has a management background that facilitates supervision of contractor personnel’s performance.

C.4.3.1.6 Ensures that all work performed meets the TO PWS requirements within the funding, timing and staffing constraints of the contract.

C.4.3.1.7 Works closely with COR-specified personnel to facilitate effective planning and accomplishment of critical objectives in a timely manner.

C.4.3.1.8 Responds to inquires within twenty-four (24) hours and has emergency contact information available to the COR at all times.

C.4.3.1.9 If the Contractor uses subcontractors, manages all subcontractor interface requirements.

C.4.3.1.10 Notifies the CORs, immediately, of any problems or issues that will affect contract performance.

C.4.3.2 The Contractor shall provide a qualified PM candidate(s) with an appropriate mix of the below education/experience requirements:

C.4.3.2.1 (Mandatory) A minimum of ten (10) years of supervisory experience to include at least two (2) years of experience supervising at least ten (10) personnel in positions similar to those listed in Appendix A, in which the PM provided supervision, direction, and control of personnel.

C.4.3.2.2 (Mandatory) Active Secret security clearance.

C.4.3.2.3 (Mandatory) At a minimum, a Bachelor’s degree from an accredited school. Accredited schools are those reported to the US Department of Education and maintained within the Secretary of Education’s database.

C.4.3.2.4 An active Program Management Institute - Project Management Professional (PMP) certification. A Defense Acquisition University (DAU) DAWIA Level III certification in Program Management; or a Master of Business Administration (MBA) /Master of Science (MS); or graduate certificate in Program or Project Management (PMI accredited) with nine (9) graduate credit hours; or Project Management with 35 hours of project management education.

C.4.3.2.5 Experience working with Department of Defense and the complex administrative and operational requirements associated with appropriately supervising contractor personnel mixed with Government personnel.

C.4.3.3 Additional Key Personnel

The Contractor may propose additional key personnel (management or supervisory) and shall identify the additional key personnel in the Management Plan and individual TOs.

C.4.4 Coverage The Contractor shall ensure ARL is supported by providing full coverage based on staff workload, peak call times, and any Contractor absences. At all times, the Contractor shall be required to provide the personnel necessary to fulfill the requirements contained in the contract. The Contractor is responsible for notifying the Government of planned absences and vacancies and shall provide the Government with advanced warning of leave, absences or projected vacancies exceeding one (1) business day and provide a backfill plan for positions deemed necessary. The Government will identify the requirements of a back-fill plan in individual TO requests. The Contractor shall ensure the management plan adequately explains backfill and vacancy fill plans.

C.4.5 Recruitment and Retention The Army Research Laboratory faces unique challenges with administrative support of routine laboratory functions.

Government Personnel are focused on accomplishment of the various technical missions and rely on the professionalism and expertise of administrative support personnel. A stable, well-trained, proficient, experienced administrative support staff provides the necessary continuity and support required to allow Government personnel to focus on inherently governmental tasks.

The Contractor shall provide a recruitment and retention plan sufficient for recruiting, attracting, hiring and retaining high caliber employees with the necessary experience, to meet the personnel qualification requirements of the basic PWS and individual TO requests. Success results in a plan that adequately describes how program and performance risk will be avoided to allow Government employees to focus on the mission without worry of how and if all administrative support tasks will be accomplished. Proposals that describe in a detailed, logical and concise manner how the Recruitment and Retention Plan support the Management & Personnel Plan effectively resulting in an approach that provides quality administrative support to the government free of the need for government intervention will be rated higher than acceptable. This plan shall be an active document and maintained and re-submitted to the COR on an annual basis from contract award.

This plan should include an assessment of the local area labor markets including availability of qualified, cleared personnel, competition among competing contracts, labor rates and pay bands and adequately describe how the proposed plan will support the recruitment and retention of quality employees in these markets. The plan should also adequately describe how the Contractor’s Recruitment and Retention plan approach is unique and how it provides the best value to the government as compared to industry standards. At a minimum, the plan should also include an adequately detailed description of the following:

• Procedures used to incentivize and capture candidates who might not otherwise accept the position under the basis of its standard offer (etc. financial and nonfinancial incentives such as pay raises, awards, and recognition).

• Procedures to verify the qualifications of candidates prior to placement.

• Procedures to ensure Contractor personnel meet and maintain the skills/expertise necessary to fulfill the requirements established in each TOR and this PWS on day one (1) of placement at the job site.

• A Quality Assurance Surveillance Plan (QASP) that ensures proper oversight of personnel, training, certifications, subcontractors, and compliance with Operational Security requirements (reference C.13).

• Procedures for addressing Contractor staff performance issues in terms of not meeting quality, timeliness, professionalism and other related performance requirements associated with the performance of duties under this PWS.

• Procedures for identifying and removing any personnel not adequately performing required activities.

• Procedures to minimize disruption to Government requirements caused by employee turnover or employee vacation or sick leave.

C.4.6 Mandatory Training Contractor personnel shall attend Army designated mandatory training upon COR request. In some instances, specific safety certification(s) may be necessary to support the TO requirements. All previously obtained safety certifications are subject to Government review to ensure compliance with Army and ARL standards. Contractor personnel may be required to attend training sessions pertaining to technical projects.

C.4.7 Surge Requirements The Contractor shall provide a level of effort after normal work hours as prescribed by the TO COR with as little as four (4) hours’ notice to perform. These types of efforts will be when there is an urgent requirement that needs to be fulfilled and time is of the essence to perform such requirements. The TO COR may authorize Situational Telework for Contractor Employees to satisfy surge requirements.

C.4.8 Installation Access All vehicles and personnel are subject to search and seizure of contraband or unauthorized Government property according to AR 190-13.

C.4.9 Access Control Cards (ACC) ACCs will be issued to Contractor personnel upon receipt of a valid security clearance at least to the SECRET level.

The Contractor employee shall prepare an ARL Form 40/APG In-processing Form, Security Badge/ID Card Application, (provided by the TO COR). The TO COR will complete blocks 19-24 and submit to the appropriate Government point of contact for processing. The Contractor employee shall return the ACC to the TO COR upon termination of performing under this contract.

C.4.10 Common Access Card (CAC) All Contractor employees having access to the APG installation or a Government computer system are required issuance of a CAC. Contractor employees shall establish an AKO account. The Contractor employee shall complete the required information at https:www.us.army.mil, by pressing the “I’m a New User” tab then pressing “Next” in the “Guest Accounts” section. The Contractor employee shall enter the name of the COR at the “AKO User Name of your Army Sponsor” prompt. After obtaining an AKO e-mail address, the Contractor employee shall complete the ARL form 225 (provided by the COR). The TO COR will sign and submit to the appropriate Government point of contact for processing. The Contractor employee shall return the CAC to the TO COR upon termination of performing under this contract.

C.4.11 Automated Data Processing (ADP) Security The Contractor shall ensure information systems are protected according to Army Regulation (AR) 380-19. The

Contractor shall ensure fullest consideration of those measures required providing operations security and to protect the integrity of data being handled according to AR 25-2.

C.4.12 Handling of Classified/Sensitive Information The Contractor shall handle all classified and sensitive information in accordance with DOD, Army, ARL, and other regulations.

C.4.13 Departing Employees The Contractor shall ensure all personnel turn-in any issued Government-Furnished Property (GFP), security badges, and identification cards to the TO COR at the completion of their employment. The Contractor shall develop an employment or installation clearance form to include signature blocks for the TO COR to certify that the employee has properly cleared before leaving employment by the Contractor. The Contractor shall be responsible for all Government issued GFP to Contractor employees. The Contractor shall have internal processes established for routine accountability inspections for the Government issued GFP.

C.4.14 Signing for Incoming Documents or Deliveries Contractors may receive and sign for incoming documents or deliveries that have already been processed and paid for by the US Government. This acceptance is for incoming items only and no financial obligation may be made on the part of the Government.

C.5 SECURITY REQUIREMENTS

The ability of each individual contract employee to obtain a DOD SECRET security clearance is required.

Contractor personnel shall have a personal security clearance of SECRET to support the majority of work under this effort. For all efforts requiring access to SECRET information, the Contractor shall adhere to the DD Form 254 in Section J of the Contractor’s TO award. The Contractor shall handle all classified and sensitive information in accordance with DoD, Army, ARL, and other regulations. All personnel must have a valid security clearance at least to the SECRET level before being assigned to a requirement and reporting to the job site or commencing work. The Contractor shall certify an employee’s security clearance with the ARL Security Office prior to an employee’s performance of service. The Contractor will not be funded for work while a Contractor employee is awaiting a required security clearance. All Contractor/Subcontractor employees supporting this contract must be U.S. citizens.

C.5.1 Security Clearance A minimum-security level of SECRET shall be required by all Contractor Personnel to support the work on this effort.

C.5.1.1 Failure to Provide Cleared Personnel Failure to provide qualified, cleared personnel will cause a severe impact on the U.S. Government’s mission. The Government maintains its right to exercise the Termination clause or other rights granted by the terms of this contract or by law if the required cleared personnel are not provided to perform.

C.5.1.2 Certification of Contractor Employee Clearance The Contractor shall certify an employee's security clearance and/or investigation to the ARL Security Office at APG prior to employee's performance of service. Certification shall be written on paper containing the company letterhead and include the following information.

• Name of individual, social security number, date of birth, place of birth, and citizenship

• Purpose of visit

• Level of security clearance, date granted clearing agent.

• The type of investigation, date completed, agency, which conducted investigation

• Point of contact at APG

• Length of time required

C.6 PLACE OF PERFORMANCE

On-site support will be at the ARL Aberdeen Proving Ground (APG), Maryland (including Aberdeen and Edgewood areas),the ARL located at the Adelphi Laboratory Center (ALC) in Adelphi, MD, and ARL located at the White

Sands Missile Range (WSMR) in New Mexico, in support of the U. S. Office of the Director (ODIR), Laboratory Operations (LABOPS), The Army Research Office (ARO), Computational Information Sciences Directorate (CISD), Human Research and Engineering Directorate (HRED), Survivability, Lethality Analysis Directorate (SLAD), Sensors and Electron Devices Directorate (SEDD), Vehicle Technology Directorate (VTD), and the Weapons and Materials Research Directorate (WMRD). The individual TOs will specify the location where work is to be performed. Travel to other facilities shall be coordinated with and authorized by the TO COR (reference C.12).

C.7 HOURS OF OPERATION

C.7.1 Normal Work Hours Normal work hours at ARL facilities are from 0745 through 1615, Monday through Friday. The Contractor shall allow the use of flexible work schedules to include, but not limited to, Alternate Work Schedule (such as, eight 9-hour days and one 8-hour day in a two week pay period), Regular Duty Hours starting before 0745 each day, or Regular Duty Hours extending past 1615 each day, or four 10-hour work days per week. All Contractor employees shall be present during the core hours of 1000 to 1400 during days worked. Contractor employees will not be permitted to start work earlier than 0500 or end their day later than 2100. The Contractor may further limit the employee workday start and stop times and the flexible work schedule options. ARL provides Alternate Work Schedules and the TO COR may approve for Contractor personnel to operate under similar schedules with TO COR concurrence. To meet the demands of the office it may be necessary, from time to time, for contractor personnel to work outside the normal duty hours during the course of the year; these hours shall be authorized by the TO COR and chargeable at the rate set forth in the schedule.

C.7.1.1 The TO COR may authorize regular and/or ad hoc/situational Telework for Contractor Employees.

TOs that are telework eligible will be specifically identified as such upon TO issuance. The nature of the work being performed will be considered in determining telework eligibility. Positions eligible for telework are those involving tasks and work activities that are portable and do not depend on the contractor personnel being at the traditional worksite. To determine telework suitability, the job content of the positions will be reviewed in addition to the demonstrated personal characteristics (i.e. dependability, responsibility, performance, quality of work, etc.) of the contractor personnel. The Contractor shall provide a telework plan that includes sufficient training and administrative oversight of telework capable contractor personnel. The Contractor employee shall complete the ARL MOA – Remote Access Request, ARL-M 25- 5 Appendix B (provided by the TO COR upon TO contract award). The TO COR will forward the MOA to the appropriate Government points of contact for remote access. The Contractor employee shall have a current property pass for any Government equipment that will be transported away from the primary duty station.

C.7.2 Extended Workweek The Contractor workweek is eighty (80) hours bi-weekly; part-time positions are anticipated. Work hours shall be scheduled in agreement with the TO COR. The TO COR will determine if a position allows for work to be accomplished outside of the APG facilities. The Contractor shall obtain written approval from the Contracting Officer prior to incurring any billable extended hours in excess of the Contractor workweek.

C.7.2.1 All extended work over eighty (80) hours for an employee must be authorized in advance by the TO COR, on a per effort basis (Reference Section I, FAR Clause 52.222-2). This approval will first come from the Government POC, with a justification for the added hours and then be approved by the TO COR.

This approval process then requires notification to the Contractor Program Manager (PM) on the contract.

C.7.3 Holidays Contractors will not be permitted to work on Saturdays, Sundays or legal holidays (or hours/days on which the installation is officially opening late, closing early, or is closed entirely, for any reason), unless otherwise authorized by the TO COR. The TO COR may authorize ad hoc/situational Telework for any Contractor Employee for requirements that must be completed when installation access is not available. Furthermore, if the Contractor chooses to pay its' employees for these days, such costs shall not be charged as a direct expense to this contract.

The following legal holidays will be observed:

January 1st

3rd Monday of January 3rd Monday of February Last Monday of May July 4th 1st Monday of September 2nd Monday of October November 11th 4th Thursday of November December 25th

When one of the above designated legal holidays falls on a Sunday, the following Monday will be observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday by U.S.

Government Agencies.

Unplanned closing of ARL such as inclement weather conditions may occur from time to time. The TO COR may authorize Situational Telework) for requirements that must be completed when the installation is not available. The Government will pay only for hours worked by Contractor personnel. Furthermore, if the Contractor chooses to pay its' employees for these days, such costs shall not be charged as a direct expense to this contract. ARL installation closings will be conveyed by public announcement.

C.8 RELEASE OF INFORMATION

C.8.1 Release of Information Release of any information on this contract to any person or organization who is not a party to this contract is prohibited without the prior written permission of the COR and the Information Office. This information includes proprietary information, news stories, articles, sales literature, TV-radio spots, advertisements, etc., on unclassified contracts, as well as classified contracts, which are governed by the DD Form 254, Contract Security Classification Specification. The request for public release of information should be addressed to the COR as designated in the individual TO. Prior to accessing proprietary information and IAW FAR 9.5, all Contractor employees or subcontractors performing work under this contract shall be required to sign Non-Disclosure Agreements.

C.8.2 Distribution Statements

C.8.2.1 The Contractor shall distribute this PWS in accordance with the following distribution statement:

• Distribution Statement A: Approved for public release; distribution is unlimited.

C.8.3.2 The Contractor shall ensure that all information generated from this PWS is distributed in accordance with the following distribution statement:

• Distribution Statement C: Distribution authorized to U.S. Government Agencies and their contractors (Administrative or Operational use) (18 August 2016). Other requests for this document shall be referred to (RDRL-LOA).

C.9 CONTRACT DELIVERABLES

Contract Data Requirements Lists (DD Form 1423) will be provided as exhibits in each individual Task Order. The Contractor shall use commercial standards and practices, when available, in lieu of these documents with the exception of the Department of the Army (DA) or DoD Technical Architecture documents, which are mandatory.

C.9.1 Management Plan The Contractor shall prepare a Management Plan. The Contractor shall submit the Management Plan to the TO COR for review, both electronically and hard copy, thirty (30) calendar days after issuance of the Contractor’s first TO.

The TO COR will provide approval or comments within two (2) weeks of receipt. The Contractor shall submit a final Management Plan to the COR both electronically and in hard copy within one (1) week of receipt of approval.

Management Plan Content: The Management Plan shall address at a minimum:

• Personnel Management Plan (see Section C.4)

• Recruitment Plan (see Section C.4.5)

• Retention Plan (see Section C.4.5)

• Occupational Safety and Health Program (see Section C.3.5)

• Safety Plan (see Section C.3.5)

• Telework Plan (see Section C.7)

• Additional contractor procedures for ensuring efficient operation of this contract

The Management Plan shall be maintained and implemented. The Contractor shall update and submit to the TO COR electronically and in hard copy a revised Management Plan on a bi-annual basis at a minimum.

C.9.2 Notification of Program Manager (PM) Three (3) calendar days after issuance of the Contractor’s first TO, the Contractor shall provide the Government, in writing, the name and contact information of the PM in C.4.3 and other management or supervisory personnel employed to perform work under this contract.

C.9.3 Financial Reports The Contractor shall provide the monthly financial report to the COR, electronically, NLT the tenth day of every month, after issuance of the Contractor’s first TO. The financial reports shall include the breakdown of labor hours per contract employee by day, labor expenditures, travel expenditures, remaining funds and estimated date of funds running out at current rate. The Contractor shall ensure the financial report includes a written summary report of all costs to include incurred labor hours per contract employee, materials, travel expenditures, subcontracts, overhead expenses, and fees, remaining funds and estimated date of funds running out at current rate broken out by area of focus. The Contractor shall include detailed copies of all invoices submitted to date for payment from both the Prime Contractor as well as all Subcontractors. The Contractor shall ensure each invoice details the labor categories, labor rates, labor hours, and all Other Direct Costs (ODCs).

C.9.4 Task Order Deliverables Reports and deliverables will be identified in each individual TO PWS. The Contractor shall submit all reports and TO deliverables to the TO COR for inspection and acceptance. The Contractor shall provide all reports and deliverables in accordance with the DD Form 1423, Contract Data Requirements List (Exhibit A, Section J of the contract) in hard copy, submitted via electronic disk or secure communications only. The Contractor shall adhere to the distribution statement as specified in specific TO. Some of the anticipated deliverables are as follows:

• Status Reports: The Contractor shall provide monthly reports summarizing current program accomplishments as required in each individual TO. The Contractor shall deliver the monthly report to the COR and assigned TO COR, accordingly, on the tenth day of each month. The Contractor shall ensure that the monthly reports include a description of the tasks that all Contractor personnel worked on under the TO contract and the outcomes, identification of any unresolved technical problems, meetings attended, planned activities, issues and recommendations for a path forward in each area of focus. The Contractor shall also answer the following questions within the monthly reports:

• Is the job progressing on schedule?

• What is the percent of completion?

• What is the dollar value completed?

• What is the total number of contract employees currently on contract?

• What is the total number of new employees placed on contract this month?

• Trip reports: The Contractor shall provide a trip report consisting of a written report of the interactions, pending actions, and suggested actions resulting from any TDY trip taken in connection with this contract to the TO COR within three (3) workdays of the TDY trip.

• Safety Report: The Contractor shall provide a Safety Report that lists the safety certifications and training records for all Contractors working under this contract to the TO COR on a quarterly basis.

• Final Reports: The Contractor shall provide a final report summarizing the Contractor personnel activities and endorsed by the TO COR indicating that the work has been satisfactorily accomplished to the Contracting Officer within sixty (60) days following the end of the TO period of performance.

• Employee Roster: A roster of employees who will be performing under the contract will be submitted to the TO COR ten (10) days following TO contract award and updated within twenty-four (24) hours of any change.

C.9.5 Other Deliverables Other deliverables will be specified by the Government in each individual TO issued under this basic contract. The Contractor shall submit all reports and deliverables to the COR for inspection and acceptance. The Contractor shall provide all reports and deliverables, as requested by the COR, in hard copy or submitted via electronic means.

C.10 MATERIALS

The Government may authorize the Contractor to purchase small scale laboratory supplies, office supplies, or other necessary goods in support of contract execution under individual TOs for which is required for Contractor personnel to complete the requirements of the Tasks. Any purchased material shall become the property of the Government. All purchases, to include purchases made by subcontractors, that are not covered in the original proposed bill of materials shall be approved by the Contracting Officer prior to purchase (to be determined at the TO level). All contract products shall be delivered to the Government locations specified in the basic PWS and the applicable TOs. Authorized Government personnel as identified in the TO award will accept delivered products via Contractor prepared DD Form 250.

C.11 GOVERNMENT FURNISHED PROPERTY AND SERVICES

The Government will provide the facilities, equipment, materials, and services for performance of this contract and individuals TOs. The Contractor shall not use property provided by the Government for any purpose other than the performance of this contract and individual TOs.

C.11.1 Government Furnished Property

C.11.1.1 Government-Furnished Facilities The Government will furnish or make available facilities or portions thereof as required in performance of this contract. No alterations to the facilities shall be made without specific written permission from the TO COR. In the case of alterations necessary for compliance with the OSHA, such permission shall not be unreasonably withheld. The Contractor shall return the facilities to the Government in the same condition as received, fair wear and tear and approved modification excepted. The Government will provide preventive maintenance and repairs. Unless otherwise required, maintenance will be provided according to Government maintenance schedules. The Contractor shall notify the TO COR if emergency maintenance is required.

C.11.1.2 Government‐Furnished Vehicles/Equipment The Government will furnish vehicles and provide fuel, maintenance, and associated equipment necessary for accomplishment of this contract. The Contractor shall not modify, disassemble, or make any changes to the Government‐furnished vehicles or equipment. The Government will provide maintenance for Government‐owned vehicles and equipment unless otherwise specified. The Contractor shall arrange for maintenance and deliver items to the designated maintenance areas. The Contractor shall record any missing equipment or equipment not in working order and notify their TO COR.

C.11.1.3 Identifying Government Vehicles and Equipment

The Government will furnish magnetic placards for each Government‐owned vehicle or equipment stating Government‐owned, contractor‐operated and the contract number. The Contractor shall ensure that all Government vehicles and equipment operated by Contractor personnel are marked on both sides of the vehicle when in use.

C.11.1.4 Government Furnished Information Management Systems The Government will furnish information management systems required to support this contract. All Contractor personnel using Government computers will be required to sign an Acceptable Use Policy (AUP) and take mandatory training. The Contractor shall use these systems inclusive of changes, modifications, or replacement of the systems, in whole or in part, throughout the period of performance. Recommended alternatives or changes to existing systems shall be submitted to the COR for approval. The Contractor shall contact the ARL Help Desk (301‐394‐4357 for ALC, 410 278‐0699 for APG, 575 678‐4357 for WSMR) for ARL supported systems, hardware, or application problems.

C.11.2 Government Furnished On-Site Facilities Materials and Supplies The Government will furnish the following materials and supplies for performance of this contract.

C.11.2.1 Office Furniture & Equipment Any Contractor working at a Government owned and operated work-site shall adhere to all standard operating practices and procedures in place at their particular facility. The Government may provide workspace, furnishings, and equipment including office automation (e.g. computers, printers) and telephones, for on-site Contractors in ARL buildings. ARL Operations will determine space allocation in ARL buildings. Coordination for space, furnishings, and equipment shall be the responsibility of the TO COR and will be addressed in each individual TO award.

C.11.2.2 Keys The Government will provide the Contractor with a set of keys to facilities and equipment to be used in the performance of this contract. The Contractor will be responsible for any expense incurred by the Government to replace lost keys or reconfigure locks because of lost or damaged keys.

C.11.2.3 Forms and Publications The Government will provide all Government forms and publications required for the performance of this contract.

C.11.3 Government Furnished Services

C.11.3.1 Utilities The Government will provide all fuel, oil, electricity, sewage, and water as required for Government‐furnished facilities. The Contractor shall operate under conditions that preclude waste of Government‐furnished utilities.

C.11.3.2 Telephone Service The Government will provide telephone services for the transaction of official business only.
