4. Added the following CLINs 0007, 1006, 2006, 3006, & 4006 to read:

Defense Base Act (DBA) Insurance

COST

DBA Insurance: Within 14 days after contract award and prior to commencing work 1 June. The amount listed by the offeror on this contract line item number (CLIN) is the estimated DBA insurance premium (estimated payroll of the Offeror and its subcontractors). The DBA insurance premium amount varies with payroll and the nature of the services. The actual amount paid by the Government under this CLIN will be based on the amount of the stamped “PAID” receipt from an approved Department of Labor (DOL) insurance carrier and submitted by the offeror after award for reimbursement. In the event of premiums are recalculated by the approved DOL insurance carrier based on actual payrolls, the contracting officer will adjust the DBA cost CLIN amount to reflect the actual premium amount paid. The U.S. Government will NOT reimburse the contractor for DBA insurance purchased from a non- Department of Labor approved insurance provider. PWS paragraph 1.6.23.4

5. All changes will be highlighted in green.

6. Revision of Attachment 1 Proposal Spreadsheet added OT section

7. Revision of Technical Exhibit F TRTC Labor Categories.

8. Revision of the Performance Work Statement.

9. All other terms and conditions remain unchanged.

10. Below are questions from Industry and the Government Answer:

Questions from Industry.

1. RFP Section Exhibit A page 21 paragraph C.1.6.11.2 and Exhibit F page 1 “Key Personnel Worksheet Tab In the draft Exhibit A PWS Paragraph C.1.6.11.2 Key Personnel, the Government has designated two positions as key: Program Manager and their alternate as key personnel. However, RFP Exhibit F TRTC Draft Labor Categories, dated 22 May 2018, lists 5 positions under a Worksheet Tab titled "Key Personnel." Positions include Site Manager, Deputy Site Manager, Travel/Admin Liaison, Chief Test Engineer, and Logistics Manager. Please clarify the number and titles of Key Personnel required in the solicitation.

Answer: Key personnel are identified as five listed in RFP Exhibit F TRTC Labor Categories.

2. Solicitation Section L paragraph L.C.2(c) In the past a smaller font size, such as 8 or 10 point, has been allowed for graphics and tables. Will the Government consider a smaller font size for graphics and/or tables?

Answer: Added sentence to the Solicitation Section L. Paragraph L.C.2 (c) “Arial 8 or 10 point font size shall be used for graphics and tables only.”

3. PWS Paragraph 1.6.4. Why the need for the U.S. Government to direct the contractor to recognize Panamanian holidays? Reason: Irrelevant and may have possible liabilities from the contract employees. The Panamanian Labor Laws are complex... In addition, see Paragraph 1. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

Answer: Holidays listed clearly identifies local national holidays that may be recognized; the Government will not exercise any supervision or control over the contract service providers performing the services herein. Offerors also must understand the legal requirements for operating in Panama and plan accordingly with those requirements. e.g. compliance with Panama’s labor laws is not optional.

4. PWS Paragraph 1.6.3. Why is first aid and medical support selective, and not equally provided to the Government and Contractor during a field emergency? May carry liabilities. Another Q. Could medical support to Government personnel be construed as personal services?

Answer: PWS paragraph 1.6.3 Medical Support Service Plan, does not selectively apply first aid and medical support during field emergencies. This paragraph outlines limited emergency medical service assistance at test sites for both Contractor and Government personnel. The liability associated with reasonable lifesaving care such as CPR, first aid and emergency evacuation are minimal. Lifesaving medical support to Government personnel does not fall into the category of personal services; this is would be considered reasonable considering remote location.

NOTE: The Government has determined that the Defense Base Act (DBA) applies to the requirement. DBA shall be added to the PWS under Paragraph 1.6.23.4 Defense Base Act (DBA) Insurance Instructions. The Contractor shall before commencing performance under this contract, establish provisions to provide for the payment of disability compensation and medical benefits to covered employees and death benefits to their eligible survivors, buy purchasing workers’ compensation insurance or qualifying as a self-insurer under the Longshore and Harbor Workers’ Compensation Act (33 U.S.C. 932 <http://uscode.house.gov/> ) as extended by the Defense Base Act (42 U.S.C. 1651 <http://uscode.house.gov/> , et seq.), and continue to maintain provisions to provide such Defense Base Act benefits until contract performance is completed.

DBA FAR insurance is a form of workers compensation insurance, and is generally required for all public works contracts performed overseas (see FAR 52.228-3 & FAR 52.228-4 for more information), unless a waiver is granted by the Secretary of the Department of Labor (DOL).

DOL policy and practice does not apply waivers to citizens or legal residents of the U.S. or to employees hired in the United States.

The contractor shall purchase DBA insurance only from carriers that are authorized to provide such coverage by the United States Department of Labor (DOL). This requirement also applies to all subcontractors. The DOL maintains a website that contains a complete list of authorized insurance carriers:

http://www.dol.gov/owcp/dlhwc/lscarrier.htm. Carriers authorized to provide DBA insurance are identified with the letters “DB” in the column titled “Acts Covered.” The following providers are for information only and do not represent an endorsement by the US Government. The list is NOT all inclusive. These companies are known to provide insurance in Afghanistan:

(1)Insurance Providers. The companies listed below have identified themselves as providing DBA insurance for contracts in Afghanistan. Contractors are encouraged to review the DOL website or to contact insurance brokers, in paragraph (2), to identify other companies that are authorized to provide DBA insurance coverage in Afghanistan. This list is not all-inclusive.

ACE Group: http://www.acegroup.com/us-en/businesses/international-advantage-defense-base-act-program-dba.aspx AIG: http://www.aig.com/Defense-Base-Act_3171_417691.html CNA: http://www.cna.com Chubb: http://www.chubb.com/ Zurich: http://www.zurich.com/ Allied World Insurance: http://www.alliedworldinsurance.com/ Starr Companies: http://www.starrcompanies.com/

(2) Insurance Brokers. Insurance brokers are representatives of insurance providers and sell insurance to contractors. The companies listed below have identified themselves as brokers for insurance providers offering DBA insurance for contracts in Afghanistan. The brokers listed below are for information purposes only and do not represent an endorsement by the US Government. This list is not all inclusive and may NOT be current. The insurance policy has to come from Continental Insurance Company (CNA) and no other insurance company.

Otherwise the policy is invalid.

(3) Cost CLIN: DBA insurance shall be a separately cost DBA CLIN and only actual cost based on copy of paid premium invoice. A copy of the paid invoice from the Contractor shall be given to the Contracting Officer or COR within 14 days before the Base year and all four Option Years. The DBA insurance premium will not be paid without proof (paid invoice). Contractor fails to maintain and provide DBA Insurance, the Contracting Officer shall issue a cure notice to the Contractor for action, Next, will be a show cause notice. Not having the DBA insurance is both breach of contract and a labor law violation. A termination for default/cause may be warranted.

5. PWS Paragraph 1.6.4 During contract performance, overtime requirements shall be identified in test plans and shall be approved in advance by the Contracting Officer. Why has this changed from the COR level? Will the CO have the capability to approve daily operational requests?

Answer: The Contracting Officer has the authority to commit funds, overtime requirements should be planned and requested with as much lead time as possible. In the event of emergency test requirements, the communication chain described in PWS 5.1.2 applies.

6. PWS Paragraph 1.6.5 Will a bid with a very bare-bone, basic overseas presence, (4 individuals working from home, for example), be an accepted proposal? In other words, a possible bid may be to bring all test personnel and equipment on TDY from CONUS and return to a bare-bone station after completion of test?

Answer: No, this will not be acceptable. Offerors must understand that the Army’s TRTC has been based in Panama since 1962 and stayed after the Carter-Torrijos Treaty of 1977 precisely based on a scientific study determining Panama as the best Tropical test environment. Overall, the Army has been testing in Panama since World War I. To further clarify, change to PWS Paragraph 1.6.5 shall read… TRTC’s OCONUS test sites are not serviced by nor receive support from a local US Embassy, garrison, or military installation, all services must be borne by the contractor on a continual basis. Additional government technical support not provided by the contractor due to the nature of a particular test will be sourced through Yuma Test Center. The contractor is to maintain a local permanent working cadre capable of supporting the functional areas described.

7. PWS Paragraph 1.6.11.2. The Government has identified the Program Manager and their (change “their” to “his”) alternate as key personnel. The Contractor shall provide a Program Manager and an alternate Program Manager who shall be able to read, write and speak English and Spanish at the DLI Level III, possess a Bachelor’s degree in Civil, Electrical, or Mechanical engineering and has a minimum of ten years of direct management experience in leading a team of personnel in an international environment. Does this mean both individuals have to have an engineering degree? Do not see a requirement for them to be U.S. Citizens? The requirement to have a valid Panamanian work VISA? A clearance required? No requirement for ATEC experience? According to 5.2.1.1.2. and 5.2.2 it is required?

Answer: See Exhibit F-TRTC Labor Categories for Program Manager (PM) and alternate PM education/experience requirements. Both must be a U.S. Citizen with a valid Panamanian work VISA, if applicable. The PM and Alternate PM are required to have a Secret clearance.

Related PWS change to read… The Government has designated the positions identified in RFP Exhibit F TRTC Draft Labor Categories as key personnel. The Program Manager (PM) and the alternate PM shall be U.S.

citizens. The Program Manager and Alternate PM shall have a Secret Clearance. The Contractor shall provide a Program Manager who shall be able to read, write and speak English and Spanish at the Defense Language Institute (DLI) Level III, possess a Bachelor’s degree in Civil, Electrical, or Mechanical engineering and haves a minimum of ten years of direct management experience in leading a team of personnel in an international environment.

8. PWS Paragraph 1.6.12.2. Why isn’t workspace, warehouse, and maintenance facility standardized to a size or amount? This could lead to an unfair or minimal proposal.

Answer: The Government response will be published in the next Amendment.

9. PWS Paragraph 1.6.13. Will the Panamanian contracted employee be required to travel and work in the U.S?

Another Q: Previously travel was approved by CO only when cost was greater than $3000. Is the COR out of the loop?

Answer to first question: Yes, Panamanian contractor employees may be required to travel and work in other locations including the U.S. to support testing events (See PWS paragraph 1.6.13.5 Travel).

Answer to second question: All contractor travel related to performance under this contract shall be submitted to the Contracting Officer and the COR either as part of the Test Plan or as a stand-alone requirement (e.g., attend a conference at USAYPG) no later than 10 work days prior to the planned departure date. The contractor shall not incur travel costs prior to receipt of the Contracting Officer’s written travel approval in accordance with paragraph 1.6.14.6.

10. Why isn’t the maintenance facilities and office space quantified? This may lead to discrepancies.

Answer: The Government response will be published in the next Amendment.

11. PWS Paragraph 1.6.21. Is the Government the final authority on selecting personnel for vacancies? May contradict PWS 1. General. This is a non-personal services contract to provide Tropic Test Support Services (TTSS) for the Tropic Regions Test Center. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn, is responsible to the Government.

Answer: No.

12. PWS Paragraph 4.4. The Contractor shall arrange for facilities. All leases must be approved in advance by the Contracting Officer. Q: Recommend the government provide a more detailed facility requirement. Reason: Leads to discrepancies and to a minimum amount.

Answer: The Government response will be published in the next Amendment.

13. PWS Paragraph 4.3. Please eliminate the last “to the Government at USAYPG and other locations”. Reason:

redundant and limiting.

Answer: No change will be made to this PWS paragraph.

14. PWS Paragraph 5.1.1. Why is the government recommending a private organization for advice on one of the links?

Answer: The link was only an example. The following sentence has been deleted from the PWS 5.1.1 which read “An example of a link of many such links from the U.S. Embassy portal is as follows:

https://www.propanama.org/copia-de-quienes-somos .”

15. PWS Paragraph 5.1.2 Is the contractor not allowed to communicate at all to the TRTC Director, the TD, or CDR? Reason: Restrictive and may cause mission failure. Might contradict 1.6.12.

Answer: Follow guidance at PWS paragraph 5.1.2, United States Government chain or as directed by COR.

16. PWS 1.6.1.3.5 Previous travel approval by CO was only when cost was greater than $3000. Is the COR now out of the loop?

Answer: All contractor travel related to performance under this contract shall be submitted to the Contracting Officer and the COR either as part of the Test Plan or as a stand-alone requirement (e.g., attend a conference at USAYPG) no later than 10 work days prior to the planned departure date. The contractor shall not incur travel costs prior to receipt of the Contracting Officer’s written travel approval in accordance with paragraph 1.6.14.6.

17. Solicitation Section M Page 86 Factor 3 Cost d. In section M of the current RFP, it states:

The Government has provided the opportunity for the Offeror to propose overtime as part of its lead worker strategy as instructed on Section Labor-Cost Detail, Attachment 1. Offerors are advised that proposed overtime will be evaluated as part of the cost realism analysis. That conflicts with the cost spreadsheet that says not to change the 2,080 hours. Please advise on how to resolve this conflict.

Answer: The 2080 is available hours. However, the available hours should not be touched, since it calculates automatically based on the number of productive hours. The revised Attachment 1 includes section for overtime.

The offeror shall only input overtime hours and overtime salary rate in the yellow fill in box of the section for overtime.

18. Solicitation Section L Page 70. Considering the number of topics and 100 page limitation of the Mission Capability Volume II, would the Government consider excluding the Executive Summary (unscored or evaluated) from the page count for this volume? Would the Government consider excluding resumes for key personnel as well?

Recommend a 5 page limit for Executive Summary.

Answer: No, the page limitations remain unchanged, please follow the solicitation’s requirements.

19. Solicitation Section L Pages 70 & 73-75 Table 2-Volumes identifies a page count limitation for Tab G, Specific Relevant Contracts Format. Please confirm that the preliminary information identified in Section L for the Past Performance Volume - Tabs A through F are excluded from the page count.

Answer: The Tabs A through F are excluded from the page count.

20. I am inquiring about Solicitation W9115118R0063 to see if there is an incumbent currently or previously completing this requirement? Or is this a new requirement?

Answer: The requirement remain unchanged from the previous contract.

21. Does the Combined Synopsis/Solicitation posted as solicitation number W9115118R0063 on FBO contain requirements similar to an existing contract or will this be a new requirement? If possible, please provide the current contract number.

Answer: This is a follow on requirement to contract number W9124R-11-C-0009 and the contract was awarded to TRAX International Corporation on 13 January 2011. The proposed requirement remains unchanged from previous contract.

22. Solicitation Section M. Page 86 Factor 3 Cost d. In section M of the current RFP, it states:

d. There are no instructions in Attachment 1 that address either overtime or lead to worker ratios. Please advise on how to resolve this conflict.

Answer: Refer to the Answer for question 17.

23. Solicitation Section B, Page 3, 5, 8, 10, & 13. CLINs 0003, 1002, 2002, 3002, and 4002 are ODC CLINs with Government provided plug numbers. The CLIN language states, “….plus any proposed and agreed to material handling rate. No other indirect costs will be allowed to be charged under the ODCs CLIN.” Some contractors do not use Material Handling (MH) rates and charge general and administrative cost (G&A) in its place, this is in accordance with their disclosed business practices. Would the Government clarify that the charging of G&A to ODC cost, in absence of MH, is acceptable and allowable.

Answer: Whatever business practices the Offeror uses are acceptable when pertaining to what is charged on top of ODCs, as long as they are allocable and allowable in accordance with FAR Part 34, and any other FAR governing charges on top of ODCs.

24. Solicitation Section L.3 page 76 Paragraph 2. CLINs: 0004, 0006, 1003, 1004, 2003, 2004, 3003, 3004, 4003, 4004 are Contractor Acquired Property (CAP) CLINs for equipment and materials. Section L indicates these are Government provided Not to Exceed (NTE) and offerors should “use the NTE amount in Attachment 1.” There are not NTE amounts included in Attachment 1 or in Section B CLINs. Would the Government please revise Attachment 1 and Section B to incorporate the Government provided plug numbers.

Answer: Section L paragraph 3 page 76 change shall read, “Except for all CAP CLINs, the pricing for ODCs CR CLINs shall be based on the amount provided by the Government. CAP CLINs will be used for the purpose of receiving material and delivery of CAP only. No cost shall be proposed for these CLINS 0004, 0006, 0007, 1003, 1004, 1006, 2003, 2004, 2006, 3003, 3004, 3006, 4003, 4006, and 4004.

25. Solicitation Section L.3. Page 77 Paragraph 7(3)(i)(b). The Government provided the staffing by labor category and contract period in Exhibit F. “Offerors shall not deviate from Exhibit F except as instructed on the Exhibit to account for lead workers and straight time overtime.” There are no instructions on Exhibit F that address either overtime or lead worker ratios. The Government further states in attachment 1 that; (4) Available hours are all hours including holidays, vacation, and sick leave. And (5) Net productive hours are the available hours less any holiday, vacation, or sick leave allowed by the offeror. The resulting hours per employee for each contract year are 1672. Are overtime hours included in the 1672 hours per employee? Are offerors to use the net productive hours of1672 hours per employee per year as the delivered hours exclusive of overtime?

Answer: Question 1. No overtime hours are not included in the 1672 hours per employee.

Answer: Question 2. No. Attachment 1 has been revised to address overtime hours and overtime salary rate.

26. Attachment 1: Attachment 1 includes the labor category and quantity for all staffing included on Exhibit F and required for pricing. Are all the employees exempt employees as indicated on Exhibit F?

Answer: It is the responsibility of the offeror to specify whether their proposed labor categories are exempt or non-exempt.

27. Attachment 1, Phase out Tab. Attachment 1 includes a tab after the Option 4 tab called “Phase-out”. Is this an erroneous pricing sheet? There is no guidance in Section L, no guidance in Exhibit F, and no guidance in Attachment 1 that explains the requirement for pricing “Phase-out” cost. Please provide guidance or remove the tab from the workbook.

Answer: The Option 4 tab called “Phase-out” pricing cost will be deleted. However, the solicitation does mention a phase in cost.

28. Attachment 1, Base Year – Option 4 tabs. Can the offeror edit the workbook pricing tabs for the Base year through Option 4 to account for the different fringe benefit elements and any overheads required by Panamanian law or the contractor’s business practices?

Answer: Yes, the offeror should modify the spreadsheet to cater to their specific business practices and accounting practices.

29. Section L Page 76. Section L states that the “Service Contract Labor Standards (SCLS) minimum monetary wage and fringe benefits will be made part of any resulting contract.” It further states, “The Government incorporated the applicable Area Wage Determination (AWD) and CBA.” There was no AWD or CBA issued with the Final RFP. In addition, since all work occurs overseas and not on a US Government Base or facility, the FLSA and SCA would not apply. Would the Government please clarify the applicability of the SCA to this RFP?

Answer: Fair Labor Standards Act (FLSA) generally does not apply to work performed in a workplace within a foreign country. However, if an employee performed work both the United States and overseas in the same workweek, the United States Department of Labor has taken the position that the FLSA will apply to all time worked during that workweek. The Government will not be incorporating Collective Bargaining Agreement

(CBA).

The following sentences have been deleted from the Section L Page 76:

“Service Contract Labor Standards (SCLS) minimum monetary wage and fringe benefits will be made part of any resulting contract.” And “The Government incorporated the applicable Area Wage Determination (AWD) and

31. PWS Paragraphs 1.6.5. 1.6.7.1.4, and0 1.6.7.2.4. The PWS makes reference in several places that the US citizens or US Based employees will work in positions on this contract. In particular, this requirement is stated in the PWS paragraphs related to OPSEC, Information Assurance, DoD networks, etc. In addition, key management personnel must regularly interface with the US Embassy, US Customs Office, USSOUTHCOM and other DoD users, and visit USAYPG officials that monitor the contract. Please clarify, is it a requirement on the contract for both the Program Manager and Deputy Program Manager to be US Citizens? 32. Solicitation Section L. Page 73 Paragraph L.C.3 Tab 2 Factor 2 The test plan format required by the Government, in sample scenarios Attachment 2 and Attachment 7, includes mandated parts with a combined page count of 64 pages. Will the Government either expand the overall page limit of 100 pages for Volume II to accommodate the test plan; or will the Government consider excluding the test plan from the Volume II page count?

Additionally, the sample test plan is provided in Times New Roman size 12 font. Are we expected to change the font to Arial size 12 to adhere to section L instructions, which will further increase the page count as Arial takes up more space than Times New Roman, or shall we leave the font and font size as provided in the sample/template test plan?

Answer: The overall page limit has changed from “100” to “150” for Volume II-Factor 1 Mission Capability (Technical Approach) page 70. There will be no change to the font size.
