(ii) VOLUME III – Past Performance. This volume shall contain past performance information regarding similar contracts and task orders. Offerors shall submit Government and/or commercial contracts or task orders for the prime offeror and each major subcontractor in performance or awarded during the past five years, from the issue date of this RFP, which are relevant to the efforts required by this solicitation. Maximum of 20. Relevant efforts are defined as services/efforts that are the same as or similar to the effort (as compared to NAICS code 236220 required by the RFP. Work may include new work, additions, alterations, maintenance and repairs performed for commercial or Governmental clients. The size and scale of the projects provided will also be considered when determining relevancy. Data concerning the offeror shall be provided first, followed by each proposed major subcontractor, in alphabetical order. Major subcontractors are defined members of an offeror’s overall team who are expected to perform 20% or more of the proposed effort. Offerors shall supply a list (maximum of 20) task orders or contracts that contain a relevant renovation or construction component with a value of at least $50,000.00 and the type of work specified in the scope of work must be ongoing or must have been performed during the last five (5) years from the date of issuance of this solicitation. Offerors must include at least 5 task order or contracts valued at greater than $250K, and at least two additional task orders or contracts valued at greater than $1M. This information must include those contracts used for the Past Performance Questionnaires required below. Numerous Task Orders (TO) combined to meet the minimum construction dollar value identified herein is not acceptable for Indefinite-Delivery, Indefinite Quantity (IDIQ) Contracts.
This volume shall be organized into the following sections:
(1) Section 1 – Contract Descriptions. This section shall include the following information in the following format.

(a) For any contracts that did not/do not meet original schedule or technical performance requirements, provide a brief explanation of the reason(s) for the shortcomings and any corrective action(s) taken to avoid recurrence. The offerors shall list each time the delivery schedule was revised and provide an explanation of why the revision was necessary. All Requests for Deviation and Requests for Waiver shall be addressed with respect to causes and corrective actions. The offerors shall also provide copy of any Cure Notices or Show Cause Letters received on each contract listed and a description of any corrective action implemented by the offeror or proposed subcontractor. The offerors shall indicate if any of the contracts listed were terminated and the type and reasons for the termination.
(b) Past Performance Questionnaire. For all contracts identified in Section 1, Contract descriptions, Offerors must make a reasonable attempt to have a Past Performance Questionnaire (Solicitation Attachment 2) completed and submitted by the client. The offeror shall complete Part I of the Past Performance Questionnaire and email the questionnaire to both the Army contracting activity and technical representative responsible for the past/current contract. The POC's shall be instructed to electronically complete Part II of the questionnaire and directly email the entire questionnaire to the Contracting Office no later than the proposal due date to Barbara D. Cousins, barbara.d.cousins.civ@mail.mil and Lane Gary at lane.m.gary.civ@mail.mil. The offeror shall also include a list of all the POC’s who were sent a questionnaire in the proposal.
The POC List shall include the following information: Solicitation Number; Company Name; Contract Number; Army Agency; POC Last Name, First Name; POC Title; POC Telephone Number; POC E-Mail Address; Date E-mailed to POC (month/day).
The Government will focus its inquiries on the offeror’s (and major subcontractor’s) record of performance as it relates to all solicitation requirements, including cost, schedule, performance and management of subcontractors. A significant achievement, problem(s), or lack of relevant data in any element of the work can become an important consideration in the evaluation process. Therefore, offerors are reminded that they must, at a minimum, include the most recent and relevant efforts (performance within the past five (5) years) in their proposal. Absent any recent and relevant past performance history or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. In some circumstances Past Performance may receive a neutral rating. Therefore, when a neutral rating is assigned, it shall be assumed that the offeror will perform in an acceptable manner.
(ii) VOLUME III – Price. Offerors shall provide a fully executed Standard Form 1442, including the coefficient rate and total dollar amount for each of Contract Line Item Numbers (CLIN) 1001, 2001, 3001, 4001, and 5001. Offerors shall propose a coefficient rate for each of the base year and 4 option periods. Offerors may elect to have different rates for each year. However, once the contract is awarded, the proposed coefficient rates become capped during each contract ordering period.
This solicitation directs the contractor to utilize the Baltimore City Cost Index of RSMeans Cost Works using the RSMeans Facilities Construction Cost Data, a nation-wide cost estimating source. Cost Works estimates already have profit and overhead contained in the unit prices, known as burdened prices. Contractors have to decide whether the burdened unit prices sufficiently cover all of the contractor’s indirect costs. If in the view of the contractor, the burdened unit prices do not sufficiently cover all of the firm’s indirect costs associated with such things as office space and storage, then the contractor shall adjust the proposed coefficient rate. The coefficient is an adjustment used to decrease, increase or maintain the total cost of the estimate that Cost Works creates. To maintain the estimate without change, the contractor would propose a coefficient of 1.0. If the contractor desires to increase the estimate by 10%, the contractor would propose a coefficient of 1.10; to decrease the estimate by 10%, the contractor would propose a coefficient of 0.90
NOTE: The Government will establish the MATOC contract total ("ceiling") in the amount of $99.5M.
(iv) VOLUME V – SOLICITATION, OFFER AND AWARD DOCUMENTS AND CERTIFICATIONS/REPRESENTATIONS
Certifications and Representations – Each offeror shall complete (fill-in and signatures) the solicitation sections indicated below using the file (without modification to the file) provided with the solicitation. An authorized official of the firm shall sign the SF1442 and all certifications requiring original signature. Offerors are required to acknowledge all amendments (SF 30) in accordance with (IAW) FAR 52.215-1. Offerors also must complete Online Representations and Certifications Application (ORCA) registration IAW FAR 52.212-3. An Acrobat PDF file shall be created to capture the signatures for submission.
Joint Venture (JV) Offerors: If the offeror is a joint venture, the offers shall provide all requirement solicitation information for all parties including a copy of the signed joint venture agreement with the proposal. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the joint venture. If the joint venture is comprised of 8(a) firms, you shall provide a copy of the Small Business Administration (SBA) approval letter with your solicitation. If the offeror is proposing a new Joint Venture, then the JV Company must be entered and active in the System for Award Management (SAM.gov) at time of proposal submittal.
NOTE: ACC-APG understands that some SBA District offices will not approve new JVs until proposals are submitted and the contracting agency submits a written request for JV review and approval and an eligibility determination. For newly proposed JVs where this is the case with the offeror’s SBA office, SBA JV approval is not required prior to proposal submittal. However, the Government reserves the right to make initial MATOC awards to other offerors while awaiting the SBA’s decision. Once approved, a successful JV offeror selected for the MATOC will be awarded a contract and may begin competing on task orders. The Period of Performance of the contract (e.g. end of base year PoP) will not be extended for any offerors whose entry onto the MATOC was delayed pending SBA action.
Teaming Offerors: If the offer is based on a teaming/partnering relationship, the offeror shall provide all required solicitation information for all parties including a copy of the teaming/partnership agreement. The agreement shall include information, which identifies the responsibilities for each entity under this contract. The agreement shall demonstrate the relationship between firms and identify contractual relationships and authorities to bind each entity of the teaming/partnering relationship.
BASIS FOR AWARD
BASIS FOR AWARD AND FACTORS/SUB-FACTORS TO BE EVALUATED
A. BASIS FOR AWARD
Awards will be made to the offerors who provide the best proposals that are determined to be the most beneficial to the Government, with appropriate consideration given to the following three (3) evaluation factors: Technical (Factor I), Past Performance (Factor II), and Price (Factor III). Technical (Factor I) and Past Performance (Factor II), when combined are significantly more important than Price (Factor III). Past Performance is the most important factor. The Technical subfactors are all weighted equally. The Government will complete its evaluation by performing a best value trade-off among Technical, Past Performance, and Price. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factor and the Past Performance factor must be rated at least Neutral. Offerors are cautioned that the awards may not necessarily be made to the offerors offering the lowest pricing (co-efficient). Price will be evaluated in accordance with FAR 15.404-1. The Government will not conduct price realism. The Government intends to evaluate proposals and make awards without discussions.
Approximately five (5) awards are anticipated, but the Government reserves the right to make greater than or fewer than five awards if appropriate. Offerors should ensure the completeness of their proposals and offer their best terms and conditions with their initial proposals. If negotiations are considered necessary, they will be conducted with those offerors in a competitive range. The determination of the competitive range will be the responsibility of the Contracting Officer and the Source Selection Authority.
If appropriate and necessary to reach the desired number of MATOC awards, the Government reserves the right to make initial awards to the most qualified offerors and then to establish a competitive range with additional unawarded offeror(s) who would be given an opportunity to submit a revised proposal for a Phase 2 evaluation and award. Any offeror receiving a Phase 2 award would be added to the MATOC and become eligible to compete for task order requirements once they are bonded and have approved post-award submittals such as the Safety Plan and Quality Control Plan. Factors and sub-factors under this solicitation are not numerically weighted.
In order to be considered for award, offerors must be registered in the System for Award Management (SAM) under NAICS 236220 (Size Standard $33.5M) prior to contract award.
B. FACTORS AND SUB-FACTORS TO BE EVALUATED
Awards will be made to the offerors whose proposals are most advantageous to the Government based upon an integrated assessment of the evaluation factors and sub-factors described below.
Evaluation of the offeror’s proposal shall address each sub-factor as it applies to the Performance Work Statement (PWS). A detailed explanation of the criteria for the evaluation is set forth in the “Evaluation Approach”, Paragraph C of this section. During evaluations of each proposal, the Government evaluation team will review each subfactor. Strengths, Weaknesses, and Deficiencies will be documented for Subfactors a, b, and d. Subfactor c - Key Personnel will only be evaluated for deficiencies. It is a pass/fail subfactor.
For the Technical Factor, each sub-factor will be evaluated to determine if the information provided and the proposed approach associated with each factor meets or does not meet the minimum performance or capability requirement. To receive an overall “Acceptable” Technical factor rating, all sub-factors must not contain deficiencies. Numerous identified weaknesses, could cause the overall Technical Factor to be rated as Marginal or Unacceptable. Based on the evaluations of the technical subfactors and noted strengths, weaknesses, and deficiencies, the Government will then assign an overall color/adjectival rating for the Technical Factor.
Factor 1: The Technical factor is further divided into the following sub-factors:
a. Bonding Capacity and Rate
b. Safety Record
c. Selected Key Personnel
d. Contract Management Plan (CMP)
Factor 2: Past Performance: Each offeror’s past performance will be reviewed to determine relevancy and confidence assessment.
Factor 3: Price: Price (coefficient) will be evaluated per FAR 15.404. Examples of methods that may be used include a comparison to previous prices (coefficients) paid, comparison to the IGCE coefficient, and comparison to the other competitive coefficients received in response to the solicitation. Offeror pricing will be evaluated based on their average (mean) proposed coefficient rate for the entire contract (base and four options). The Contracting Officer shall use the average of the proposed coefficient rate from line items 1001, 2001, 3001, 4001, and 5001 as the only basis for determining price of these line items, since future task orders will be issued on a competitive basis. Coefficients must be balanced between years.
C. EVALUATION APPROACH
All proposals shall be subject to evaluation by the Source Selection Team (SST). The SST will first evaluate Technical Subfactors a and b from below. Any proposal containing a deficiency for Subfactor a or Subfactor b may not be evaluated further. No notification to offerors is required to Offerors by the Government until the eventual MATOC awards are made or unless a competitive range is established.
1. The overarching evaluation approach for all factors and subfactors is as follows:
Technical Evaluation Method:
2. The Technical factor is divided into the following sub-factors and will be evaluated on an overall basis using the following color/adjectival ratings:
Table A – Combined Technical/Risk Rating Method (ref. DoD Source Selection Procedures Guide)
Color Rating
Adjectival Rating
Description
Blue
Outstanding
Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Purple
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Yellow
Marginal
Proposal has not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Red
Unacceptable
Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
a. Subfactor a: Bonding Capacity and Rate
The Government will evaluate the offeror’s ability to provide documentation from a certified and approved Surety demonstrating that it currently has or can obtain $5 Million of payment and performance bonds per year specifically for this MATOC.
The minimum (threshold) amount of bonding required is $5M. Offerors who can demonstrate significantly greater than $5M of bonding capacity/ability may earn an evaluated strength which could increase the Technical Factor rating.
The Government will also evaluate the offeror’s proposed bonding premium rate based on documentation submitted from its surety. A maximum percentage rate is not in place, although a weakness may be assigned for rates that are higher than industry average. Offerors who can demonstrate low bonding rates, may earn an evaluated strength. The objective for a bonding rate premium is less than 1%.
NOTE: Surety companies utilized for the proposal and contract must be listed on the U.S. Department of the Treasury website.
Reference https://www.fiscal.treasury.gov/surety-bonds/list-certified-companies.html
b. Subfactor b: Safety Record
The Government will evaluate the offeror’s (to include major subcontractors and both JV partners, if a JV is proposed) record of safe operations based on its Experience Modification Rate (EMR) for the previous five (5) year operating period. NOTE: An EMR of greater than 1.0 during any portion of the previous five (5) year operating period will be considered unacceptable (a deficiency). A major subcontractor is defined as a subcontractor which is expected to perform 20% or more of the total work on the contract.
The minimum acceptable EMR is 1.0 for each of the previous 5 year operating period. Offerors who demonstrate EMRs of less than 1.0 during the previous 5 year operating period with an emphasis on the most recent operating years may earn evaluated strength(s) which could increase the Technical Factor rating.
The Government will evaluate the offeror’s (to include major subcontractors) recent record of safe and regulatory compliant operations based on its OSHA recordable injuries/illnesses reports for the previous five (5) years. NOTE: The offeror’s cumulative Lost Work Day Incidence Report (LWDI Report) average shall be at or below the national average LWDI for the SIC codes for General Construction (SIC codes 1541 and 1542) for the previous two years. A major subcontractor for this subfactor is defined as a subcontractor which is expected to perform 20% or more of the total work on the contract.
The minimum requirement is an LWDI at the national average for SIC codes 1541 and 1542 for the previous two (2) years. Objective is an LWDI below the national average for SIC codes 1541 and 1542 for at least the previous two (2) years and up to the previous five (5) years. Offerors who demonstrate low LWDI figures may earn evaluated strength(s) which could increase the Technical Factor rating.
Subfactor c: Selected Key Personnel (Reference PWS paragraph 1.6.11 and subparagraphs)
(IMPORTANT NOTE: Qualifications, education, and other information as outlined below and in the "Proposal Submission Requirements" must be clearly demonstrated by documentation submitted or by information provided in resumes. The Government will not make assumptions or fill-in the blanks)
Quality Control Manager (QCM):
The Government will evaluate the offeror’s ability to provide at least one prime contractor Quality Control Manager (QCM) that possesses the following experience/qualifications:
· Minimum of ten (10) years of experience in the construction field and five years’ experience as a QCM on industrial, Governmental, or commercial construction contracts.
· QCM experience on at least three (3) projects in excess of $500,000 or for projects such as new building…
