About this file

This document contains an amendment to a solicitation for multiple award task order contracts for construction services at Aberdeen Proving Ground in Maryland.

The amendment extends the proposal due date to November 5, 2019 at 11:00 AM Eastern Time. It adds back content inadvertently removed in a previous amendment. It revises answers to questions and instructions for proposal submission to allow offerors to request DoD SAFE site drop-off codes up to 36 hours before the due date. The amendment also corrects language in the evaluation criteria and removes page limits for past performance volumes. A list of additional questions from offerors is attached without answers, with answers to be provided in a future amendment. The solicitation will result in awards of firm fixed price MATOC contracts for a base year and four option years for construction, renovation, and repair services at Aberdeen Proving Ground, with a minimum value of $2,500 but not exceeding $100 million total. The competition is open to certified 8(a) small businesses.

SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

AMENDMENT 0007 CONTINUATION

The purpose of this Amendment 0007 is as follows:

a.) Extend the due date of proposals until 5 November 2019 at 11:00AM ET.

b.) Add the “Amendment 0003 continuation” section from Amendment 0003 back into the solicitation so that it will appear in the conform/rollup copy of the solicitation. It was inadvertently deleted on page 2 of Amendment 0004.

c.) Revise the answer to Question #6 from Amendment 0005 as well as the “Instructions to Offerors, Proposal Submission Requirements” to allow for a DoD SAFE site dropoff code request to be sent to the Government up until 36 hours prior to the final due date of proposals. Requests must be sent to Ms. Barbara Cousins at barbara.d.cousins.civ@mail.mil and Mr. Lane Gary at lane.m.gary.civ@mail.mil.

Offerors may provide up to two (2) POCs with email addresses to receive the dropoff codes from the Government. Each dropoff link may only be used once. The Government is sending each email address two (2) dropoff codes to use.

d.) Correct Section C. Evaluation Approach, b. Subfactor b: Safety from: “The Government will evaluate the offeror’s (to include major subcontractors) recent record of safe and regulatory compliant operations based on its OSHA recordable injuries/illnesses reports and its Days Away Restricted or Transferred (DART) rate.”

to: “The Government will evaluate the offeror’s (to include major subcontractors and both JV partners, if a JV is proposed) recent record of safe and regulatory compliant operations based on its OSHA recordable injuries/illnesses reports and its Days Away Restricted or Transferred (DART) rate.”

NOTE: The document section will be updated in the final Amendment to the solicitation.

e.) Remove Factor 2 – Past Performance from the 150 page limit on proposals outlined in the Proposal Submission Requirements (Instructions to Offerors). The Past Performance Volume/Factor no longer counts against the proposal page limits. This RFP section will be updated in the final Amendment to the solicitation.

The Government has received 46 additional questions by the 28 October 2019, 11:00AM ET cutoff. Attached are those questions without answers. If any potential offeror has submitted questions that are not on this list or were not included in a previous Amendment list, you are instructed to resubmit those questions to Ms. Cousins and Mr. Gary by 29 October 2019 at 11:00AM ET. The Government anticipates releasing a final Amendment on or about 30 October 2019 to provide all answers and any document updates required.

ADD'L Q'S 10282019 -UNANSWERED

Questions Answers

1. Will any of the task orders require Builders’ Risk insurance?

2. If builders' risk insurance is required, will the entire facility need to be covered or only the portion of the building being built?

3. If only the portion of the building being built is needed to be covered, will the Government cover any portion of the existing building for the contractor where utilities are being connected when those utilities are in separate locations away from the area being built?

4. Amendment 0006, pages 3-16 show wage determination 2015-4266 and accompanying fringe benefits costs that are different from the second wage determination MD20190030 (8/9/2019) and fringe benefit costs. Please advise which rate takes precedence when an awardee will be responding to a task order.

5. Please explain how the government expects the successful 8(a) contractor(s) to maintain a required general management staff for this contract without a guarantee of work to support over $450,000 in qualified personnel payroll staff as listed in the PWS, paragraph 1.6.11.6. and .7 ----1.6.11.6 …. Since the awards will be Indefinite Delivery – Indefinite Quantity contracts, with no guarantee of task order awards, contractors must be able to adjust and augment their staffing as necessary based on their workload.

----1.6.11.7 The Contractor shall be able to maintain a general management staff at the APG off site location to include at a minimum, a Contract Manager, a Quality Control Manager, Contract Safety Manager, and a Site Superintendent (see 1.6.11 Key Personnel Qualifications).

This minimum staff shall be maintained during the life of the contract to respond to new task order requirements and management of awarded task orders. Additional APG off-site management staff, including Project Managers, Quality Control staff, Site Safety Officer and Site Superintendents, shall be added as presented in the offeror’s proposal and as required to support workload.

A full-time task order specific Site Safety and Health Officer may be required for task order requirements with high or extremely high risk.

----This requirement will be included in the request for proposal (RFP). All staff provided under the contract shall meet the minimum experience set forth in Section 1.6.11.

6. Is it possible for the 8(a) contractors to submit non-named, minimum requirements for potential personnel instead? It is virtually impossible for most 8(a) contractors to carry this amount of staffing “hoping” that they will be awarded task orders to cover the staff cost especially since we will be competing on each task order after award. The cost of estimating and putting together the cost proposals alone are a tremendous cost to absorb.

7. Price realism is not being conducted per the RFP however, please confirm that the contractor is using the burdened line items amount from RS Means Cost Works in composing their coefficient?

8. In amendment 005, the “SEED TO” was removed from the PWS. Does this mean that we need to remove CLIN 1004 as the SEED TO will not be priced?

9. In the PWS under Key Personnel, the PM, SS and QCM now must be able to communicate in English and be able to translate for a non-English speaking staff member. Does this mean that these three key personnel must speak another language such as Spanish so he/she can interpret to non-speaking staff?

10. In the Volume II - Past Performance requirements section, submitted projects are to follow these instructions "Offerors must include at least 5 task order or contracts valued at greater than $250K, and at least two additional task orders or contracts valued at greater than $1M.". Is the total project count to be 7 projects or do 2 out of 5 need to be at the greater than $1M value?

11. In the Volume II - Past Performance requirements section, a total of 20 projects can be submitted. If we choose to submit 20 projects between the prime, JV partners, and/or subcontractors, this can result in 120 pages just for the Past Performance Information and the Past Performance Questionnaires (we plan on submitting PPQ's) not including any narrative. This severely limits the overall proposal. As a JV, the safety section along with subcontractors also have a large base page count due to multiple entities that need to submit forms. We would request the page limitation be changed to 200 pages to account for these large sections of the proposal.

12. In the Volume II - Past Performance requirements section, there are no requirements called out if the offeror is a JV. If the JV does not have 7 (or 5 based on the above response) projects to submit as the JV, would the JV be submitting projects from each respective JV partner? If so, is there a requirement for each JV member to submit a certain number of projects from each partner? Is there a requirement for each JV member to submit a certain size project in relation to the 2 projects over $1M? If there are a certain number of projects required for each JV partner, then that would certainly drive us up to the 20 projects limit and therefore necessitate the increased page count as well.

13. Amendment 0003 eliminated some CLINs (Bonding CLINs and 1003 through 5003) and also added the CLIN for the base for the Seed Task Order Pricing. However, a new pricing section with revised CLINs was not issued. Do you intend to issues a revised Pricing Section with the applicable CLINs? If mot, please provide instructions to offerors on how to submit the pricing. If the offeror is responsible to delete and add CLINs, please provide direction on doing so.

14. Per the PWS Section 1.1.1 Start Up Period states that within 30 calendar days after receipt of award, the contractor shall be fully operational and capable of immediately starting work. If work is in a restrictive area badge applications required approximately six (6) weeks for processing after receipt of application. Will the Army give the client additional time to obtain the badge?

15. The PWS states that DA Form 1602, Application for Identification Card must be completed for each employee requiring access. I can’t locate this document. Can you share a copy so we can see what information is required?

16. Question 29’s answer states that the PM must have a degree, however the requirements are “ Possesses one of the following: engineering degree, construction science or construction management degree, architectural degree or be a Certified Construction Manager or equivalent experience of minimum total of 8 years on construction projects which 5 years is in construction management as described above. The way I interpret this is that if the PM can have a degree OR equivalent experience of the 8 years and 5 years. Please confirm that the in lieu of the degree the 8 years of experience is sufficient.

17. We kindly ask that the proposal due date be extended one week to give the contractors enough time to incorporate changes in their proposal based on the Q&A released on 23 Oct 2019.

18. DA Form 1602, Application for Identification Card is the form the contractor needs to complete for access to restrictive areas. This form is not online. Can the Army please share this form.

19. Per PWS 1.4, The contractor “..shall provide all services, materials and supplies.”. Is there a dollar value for services, materials, and supplies above which the contractor can ask the government for relief on the cost? Significant / huge projects can be unwieldy to fund.

20. Do our subcontractors need to be approved by the government if they have not worked on military contracts previously? How long will it take to get them approved?

21. Will the Government provide guidance on regulations required for each project / task order? Between the state of Maryland, OSHA, and Army regulations, that is a very extensive list and any assistance would be appreciated.

22. Will one Environmental Management Plan (EMP) cover all APG work or will we need to develop additional EMPs for other work? For perhaps specialty or UXO projects?

23. It’s probable that our Volume 1 Technical file will be over ten (10) MB. How can we provide to the Government?

24. Amendment 0005 Q&As said that the Past Performance PPQs are not included in the page count. Two questions – if we include the answered PPQs in our proposal, how do we tell you, so they won’t be counted as part of the 150-page limit? If they are going to be counted, how do we find out what PPQs you have received so they are not part of our submitted proposal?

25. Amendment 5 Question 12 answer states “Bonding rates are no longer being evaluated with the solicitation.” We’ve worked hard to obtain and maintain favorable bonding rates.

Will a favorable bonding rate while not evaluated, provide a plus for having one?

26. Since there is a requirement to provide proof of contracts and the PPQs, can we add an Appendix (or two) to the Proposal for these documents and keep them out of the page count? There is no desire to put information in an appendix to be evaluated, merely to have necessary documents that provide proof of something. Key personnel certificates and proof of education would be another example of documents to put in an unevaluated appendix. QCM certificate(s).

OSHA DART forms. DD214’s

27. Amendment 5 Question 35, “The offeror must ensure that employees are qualified to obtain security to the installation within the required timelines.” Where are the regulations that define these qualifications?

28. PWS 5.37.3.2.6.3 “The Contractor shall provide a single point of contact from their organization as a Schedule Specialist.”

a. As a required person, what are the government requirements for this individual? Are there educational and / or experience specifications for this position?

29. For Design/Build Task Orders, will these Task Orders be in two parts? In other words, will we be given the parameters, then price the design. After design is awarded and completed do, we then price the Construction, or will Design/Build Task Orders require complete pricing prior to design?

30. Addendum 5 discussed UXO. It says that when starting a job in AA or EA there may be Unexploded Ordinance. It says that the area will be inspected for UXO by the Contractor by preapproved EOD personnel employed by the Contractor, prior to any work starting, including a site visit. How are we to price this into our Task Order proposals? If UXO is found, Is the removal of the UXO in this Contract. This is confusing, are we to carry pricing for the inspection only? And how do we price that?

31. It states in Addendum 5 that If an MDE Sediment and Erosion Controls Permit or an NPDES permit needs to be obtained then the Contractor is responsible for all costs associated with submitting the proper documentation required to obtain the permit. This is fine if it is a Design/Build project, we will be designing and therefore obtaining all permits. However, if the job is designed already and the permit application is inadequate it says that we will be responsible for all costs associated with redesign and resubmission required to obtain the permits. How will we be compensated for fixing someone else’s inadequate design.

32. Would the Government consider bonding each awarded task order in accordance with the Miller Act (>$100,000) as opposed to tying up $1,000,000.00 in bonding per year for a contract that has a $10,000.00 guarantee (considering its an 8a set-aside requirement)?

33. Will the Government increase the maximum page limit to 220 pages?

34. How long does a typical badge take to obtain from the security office? Are there any restrictions to badging (Citizenship, criminal record, etc.)?

35. What is the typical turn around time on Submittals?

36. When will the drop-off codes for DoD Safe be sent out?

Can you use the code more than once, if you want to test it before actual submission?

37. Can this requirement be postponed?

38. Do we need to add the CLIN 1004 on SF1442 ourselves?

If this is for the Seed project, then where is the Seed project for us to price? If the seed project will be given at a later stage after award, then it means that the current proposal does not have to include price for CLIN 1004. Is this correct?

39. Please confirm if major in any degree for the Project Manager will be acceptable?

40. Please confirm that the proposal for the seed project is to be the true cost to prepare the plans or $10,000, whichever is higher. Is the minimum amount for CLIN 1004 $10,000?

41. Please clarify whether the PPQ’s are in, or not in the 150 page count per amendment 5, question 42.

42. Please confirm that the offeror shall only submit 5 PPQ’s or if the offeror is allowed to submit additional PPQ’s.

43. Please acknowledge that an extension will be granted for the proposal submission.

44. In response to Q&A question #21 on Addendum 5, Please clarify that PPQ does not have to come directly from the client ?

45. Given that the Task Orders for this MATOC will all be FFP type contract, is there a need for manpower reporting?

Please advise.

46. For the positions of Superintendent and Project Manager (per Subfactor C: Selected Key Personnel), please confirm that the MDE Certification for Maryland Sediment and Erosion Control is a requirement after contract award and not required at time of proposal submission.

AMENDMENT 0003 CONTINUATION

The purpose of this Amendment 0003 is as follows:

a.) Bonding CLINs 1002, 2002, 3002, 4002, and 5002 are removed. Bonding Capacity remains a submittal requirement and evaluation factor (reference Instructions to Offerors & Basis for Award); however actual bonds will be required at the task order level for those task orders that meet the thresholds outlined in FAR Part 52.228- 15.

b.) CLINs 1003, 2003, 3003, 4003, and 5003 are deleted.

c.) Solicitation Scope/Instruction section is updated.

d.) Delete Minimum Guarantee paragraphs. A new Minimum Guarantee section will be added in a subsequent Amendment which outlines the Minimum Guarantee and a Seed Project which will be the first task order awarded for each awardee.

e.) Delete or update certain solicitation clauses.

f.) Update Instructions to Offerors and Basis for Award sections.

g.) Note that Past Performance Questionnaires (PPQs) are no longer required for all past performance contracts submitted. PPQs are highly encouraged for potential offerors without a substantial past performance history in CPARs or where that CPARS past performance history does not cover the wide ranging size and scope of projects required by the PWS of this MATOC. Aside from reviewing the PPQs received, the Government intends to use CPARs as a primary tool for acquiring past performance information. It is up to each offeror to submit sufficient documentation to the Government to make the strongest case for its past performance rating. As clearly outlined in the Basis for Award section of the RFP, Past Performance is the most important factor for this solicitation.

Some of the changes made by this Amendment address RFI/Questions received by the Government. The Government’s responses to questions received will be posted in a subsequent Amendment along with changes to the PWS. The Government anticipates releasing that Amendment during the week of 14 October 2019. The Government will provide potential offerors with a period to ask additional or follow-on questions. Please note that when changes are made in the Government’s PD2 contract writing system, the resultant Amendment will be formatted in an random manner. The Government has limited ability to re-format Amendments. The Government is adding a MS Word version of the original RFP document posted to FBO along with a MS Word version of this Amendment. This is intended to facilitate solicitation section comparison by potential offerors.

The due date of proposals is not changed by this Amendment.

SECTION 00010 - SOLICITATION CONTRACT FORM

The required response date/time has changed from 31-Oct-2019 11:00 AM to 05-Nov-2019 11:00 AM.
