About this file

This document provides notice of an upcoming solicitation for an Enhanced Heavy Equipment Transport System (EHETS) trailer requirements contract. The U.S. Army Contracting Command - Detroit Arsenal intends to issue a solicitation on or after November 24, 2021 to acquire 466 EHETS trailers over five years to transport heavy tracked vehicles. The successful offeror must provide EHETS trailers meeting specifications, programmatic support, field service representatives, and configuration management. The solicitation will use best value tradeoff for awarding a single requirements contract. Proposals will be evaluated on technical, price, and small business participation factors. The technical factor, including payload capacity, maneuverability, and payload safety subfactors, is most important. Price is more significant than small business participation. Delivery will begin with five test trailers within six months of award, then 15 trailers per month starting 180 days after order receipt.

SECTION H - SPECIAL CONTRACT REQUIREMENTS

H.1 Warranty

H.1.1 Notwithstanding the Government inspection and acceptance of the trailers furnished under the contract or any provision of this contract concerning the conclusiveness thereof, the contractor shall warrant the supplies are free from defects in design, material and workmanship and will conform to Section C.1 requirements. The contractor shall warranty its trailers to include any component pass through warranties, for a period of 12 months from the date of acceptance. The warranty terms and conditions shall be IAW Attachment

0019.

H.1.2 Notification of Warranty Claim. Written notification to the contractor of a warranty claim will be provided with the contractors warranty claim form or PQDR. Either form received by the contractor, will constitute notification of the formal warranty claim process.

H.2 Contractor Responsibility for Timely Delivery of Logistics Data

H.2.1 The contractor is advised that failure to provide acceptable Logistics products required under Section C.6 of this contract constitutes a default within the meaning of FAR 52.249-8, and also may be the cause for rejection of hardware end items required under the contract. Late delivery and/or delivery of Logistics CDRLs that are non-conforming with requirements will be included in past performance assessment for the contract. If the contractor fails to deliver acceptable Logistics CDRLs products, the Government may reject hardware end items required under the contract. When the Contracting Officer determines the contractor fully complying with all associated Logistics CDRLs required under the contract, he or she will resume acceptance of hardware end items subject to consideration imposed for the default.

H.2.2 The contractor will be financially responsible for any additional costs arising out of any work stoppages resulting from the failure to deliver acceptable log products. The contractor shall perform any additional work required as a result of its failure to deliver logistics products at no additional cost to the Government.

H.2.3 The Contracting Officer may extend the contract delivery schedule for hardware end items and may negotiate consideration for the schedule delays resulting out of non-conforming Logistics CDRLs. Additionally, the contractor agrees the Contracting Officer has the unilateral right to modify the contract using one or more of the following approaches if delivered Logistics CDRLs are late or unacceptable:

H.2.3.1 If a Logistic CDRL to be delivered under Section C.6 of this contract is not delivered within the time specified under each

Logistic CDRL or is deficient upon delivery, the Contracting Officer may until such data is accepted by the Government, withhold payment to the contractor of fifteen percent (15%) of the total hardware unit price, but not more than 10% of the total contract price. Payments shall not be withheld nor any other action taken pursuant to this paragraph when the contractor's failure to make timely delivery or to deliver such data without deficiencies arises out of causes beyond the control and without the fault or negligence of the contractor.

The withholding of any amount or subsequent payment to the contractor shall not be construed as a waiver of any rights accruing to the

Government under this contract.

H.2.3.2 Suspend Performance Payments, either temporarily or permanently.

H.2.3.3 In the event that the Government modifies the contract IAW paragraph H.2.3 as a result of late or unacceptable logistics products, the Contractor shall be responsible for any storage costs on systems unable to be fielded as a result of late or unacceptable logistics products.

H.3 Federal Retail Excise Tax (FRET) Expenses. The contractor shall not include FRET applicable to each trailer in the trailer CLIN price. FRET is included in a separate FRET Firm Fixed Price CLIN. The contractor shall use Title 26, Subtitle D, Chapter 31, Subchapter

C of the United States Code when calculating FRET amounts and applicability.

H.3.1 FRET Range Pricing (CLINs 1008, 2002, 3002, 4002 and 5002). The FRET price for any delivery order shall be based on the same FRET quantity range as the associated production trailer quantity, regardless of the FRET quantity actually ordered. Example: A delivery order for 41 trailers and 15 FRET will have the FRET priced in the 41-70 quantity range (NOT the 1-15 quantity range).

H.4 TECHNICAL DATA AND BACKGROUND PATENT IDENTIFICATION AND ASSERTIONS (IDENTIFICATION AND ASSERTION OF RESTRICTIONS)

H.4.1 Definitions

Terms used in H.4 are defined in DFARS 252.227-7013, 252.227-7014, 252.227-7015, 252.227-7017.

H.4.2 Identification and Assertion of Restrictions

The Government will review the licenses to ensure that the licenses' terms are consistent with Federal procurement law and satisfy the Government's end user needs. All such commercial licenses will be made part of an Attachment to the contract.

H.5 Range Pricing for Production Trailers (CLINs 1004, 2001, 3001, 4001 and 5001). The unit price for any delivery order will be determined based on the range price associated with the individual order quantity. The order quantity is NOT cumulative for pricing purposes.

L.1.4.2.4 Method of Submission

Proposals submitted via e-mail will not be accepted. Proposals shall either be hand-carried or submitted via US mail. Hand-carried submissions* include proposals delivered by commercial carriers such as FedEx, UPS, or services other than the US Postal Service.

Proposals must be delivered to the Detroit Arsenal (DTA) Mail Handling Facility (Building 255) between the hours of 8:00AM and 1:00PM local Warren, MI time. The package(s) will be dated and time stamped at the Mail Handling Facility and the Government will be responsible for forwarding the package(s) to the appropriate personnel. Offerors should ensure that any commercial carrier it uses has a tracking system that can provide documentation that will prove the date and time of delivery to the Government. If the proposal is hand-carried by other than a commercial carrier, the delivery person (even if an employee of the offeror) must be a US citizen, and must obtain a signed receipt, indicating date and time of delivery, from the Mail Handling Facility personnel. The delivery person must provide the receipt since the Mail Handling Facility personnel do not have them.

*Directions to DTA: From Van Dyke Avenue, travel west on East Eleven Mile road to railroad track. Immediately after crossing railroad track turn right into DTA main gate and follow security officer directions to the Mail Handling Facility (Building 255). It may be necessary for the delivery person to obtain a visitors badge prior to being allowed to enter the installation. If so, the security officer will advise the delivery person of the procedures to follow.

L.1.4.2.4.1 Exterior envelopes must identify the solicitation number and date specified for receipt of proposals.

L.1.4.2.4.2 Offerors are cautioned that approval to enter the installation must be obtained prior to the closing date and time for receipt of proposals. Due to security procedures, delays are probable at the entry point and offerors must plan to accommodate them. It is the offerors responsibility to plan sufficient time to clear Detroit Arsenal security and ensure proposals reach the intended destination.

L.1.4.3 Single Proposal Submission

Offerors are limited to submitting one proposal with one approach to meeting the requirements of this solicitation. An offeror is defined as an entity competing independently that does not share a common parent with any other offeror or, does not have a parent/subsidiary relationship with any other offeror, or is not affiliated with any other offeror. For the purposes of Section L.1.4.3

(Single Proposal Submission), the Government will consider affiliation to exist if associated business concerns or individuals, directly or indirectly, either controls the other or can control the other (control can exist through common ownership, common management, or a contractual relationship such as a joint venture, where members have the power to control performance of the contract); or a third party controls or can control both.

L.1.4.4 Organizational Conflict of Interest

L.1.4.4.1 The provisions of FAR Subpart 9.5, Organizational Conflict of Interest (OCI), apply to any award under this Request for

Proposal (RFP). Potential offerors should review its current and planned participation in any other Government contracts, subcontracts, consulting, or teaming arrangements where it may be in a position of actual or perceived bias or unfair competitive advantage.

L.1.4.4.2 Offerors shall disclose any potential OCI situations to the PCO as soon as identified including prior to proposal submission.

The disclosure should include the facts and an analysis of the actual or perceived conflict and a recommended approach(s) to neutralize or mitigate the potential conflict. The preferred approach to potential conflicts is to negate/obviate the conflict. Mitigation is considered only if it is not practical to negate/obviate the conflict. The PCO will promptly respond to resolve any potential conflicts.

L.1.5 All or None

Offers in response to this solicitation must be submitted for all the requirements identified in the solicitation. Offers submitted for less than all the requirements called for by this solicitation may be rejected or ineligible for award. Proposals that contain alternate terms and conditions may be considered as taking exception to the requirements of the solicitation. See Section M.1.7.

L.2 Evaluation Factors: Offerors proposal shall address the following three Factors, one of which has three sub-factors:

(a) Technical

(b) Price

(c) Small Business Participation

L.2.1 Volume I Technical

The Technical Volume submission shall not exceed thirty (30) pages. The thirty (30) pages does not include substantiating data. The

Offeror shall submit the Technical Volume as a separate document in MS Word or PDF format. The Technical Volume shall include a narrative describing the proposed design approach to deliver an EHETS Trailer that meets the EHETS Trailer requirements stated within

Attachment 0006 EHETS Trailer Performance Specification. The technical proposal should demonstrate the Offerors understanding of the project requirements and shall provide sufficient detail and analysis to support how the Offeror will meet the EHETS Trailer requirements as defined in L.2.1.4 through L.2.1.6. It is the offeror's responsibility to submit detailed and complete information so the Government may evaluate its Technical volume. The Government does not assume the duty to search for data to cure problems it finds in proposals. While the Government may elect to consider data obtained from internal and external sources other than the proposal, the burden to provide thorough and complete technical information rests with the offeror.
