About this file
This document provides details for an upcoming solicitation seeking a five-year requirements contract for Enhanced Heavy Equipment Transport System (EHETS) trailers. The Army Contracting Command - Detroit Arsenal intends to award a single contract to provide 466 EHETS trailers over the period of performance from fiscal year 2022 through 2027. The solicitation will require delivery of five test trailers within six months of award for testing and evaluation, followed by production delivery of 15 trailers per month beginning 180 days after order receipt. Pricing will be on a firm-fixed-price basis for test and production trailers. The Army will evaluate proposals based on technical factors prioritizing payload capacity, maneuverability and safety, as well as price and small business participation, with technical factors significantly more important than price. The solicitation is expected to be issued on or after November 24, 2021.

Question Answer
1 RFP Section I‐140, Section I‐141, 52.216‐19, 52.216‐21, Section B, Attachment
The solicitation includes the Order Limitations clause 52.216‐19 which details that the Offeror is not required to honor a minimum order of less than 1 or maximum order of more than 146 trailers. The solicitation also includes the Requirements clause 52.216‐21 which details that the quantities in the solicitation are estimates only and that should the Government not order the estimated quantities, it is not the basis for an equitable price adjustment. Section B of the Solicitation states that there is no minimum guarantee under this requirements contract. Attachment 002 Pricing Workbook requests a single EHETS Trailers Production Price per ordering year based on an estimated quantity of trailers per ordering year that ranges between 18‐146. The solicitation allows the Government to order any quantity of trailers between 1 – 146 in a single order but is only requesting a single price per order year in the pricing workbook to cover that quantity range. While the pricing workbook includes estimated quantities, the Government is not obligated to order these quantities and whatever quantity is ordered will be at the single price per year proposed in the pricing workbook. This solicitation language incentivizes offerors to propose higher production prices to cover the risk of the Government ordering as few as a single trailer per order rather than offering lower prices aligned with the estimated quantities in the pricing attachment. Requirements contracts generally request range pricing or include a minimum order quantity to mitigate this cost risk. Will the Government adjust the solicitation language or pricing workbook to address this disconnect?
The Government will amend the solicitation in order to incorporate range pricing.
