EVALUATION PROCEDURES

A. BASIS FOR AWARD

The Government will make award to the lowest priced technically acceptable (LPTA) offeror in accordance with (IAW) FAR 15.101-2, as supplemented. Technical tradeoffs will not be made and no additional credit will be given for exceeding acceptability. Award will be made to the technically acceptable offeror with the lowest evaluated price, which is deemed responsible in accordance with the Federal Acquisition Regulation (FAR) and whose proposal conforms to the solicitation requirements. The solicitation requirements include all stated terms, conditions, representations, certifications and all other information required by Section L of this solicitation.

The Government intends to award based on initial offers without discussions. However, if the contracting Officer determines that discussions are necessary, then discussions may be held with each offeror in the competitive range IAW FAR 15.306 and 15.307(b).

The Government intends to select one contractor for the Stuttgart Installation Maintenance Contract. However, the Government reserves the right to award no contract at all, depending on the quality of the proposals and prices submitted and the availability of funds.

B. EVALUATION CRITERIA

THE Government will evaluate for acceptability, the factors and subfactors identified below

FACTOR I – TECHNICAL Sub-factors to be evaluated are:

Subfactor A. Management Plan

Subfactor B. Experience

Subfactor C. Transition Plan (phase in and phase out).

Subfactor D. Quality Control Plan (to include ISO certification).

FACTOR II – PAST PERFORMANCE

FACTOR III – PRICE/COST

C. EVALUATION APPROACH

All proposals shall be subject to evaluation by the Government’s Source Selection Evaluation Board (SSEB). Technical and past performance evaluations will be performed to determine acceptability. Only those offerors determined to be technically acceptable with an acceptable past performance rating, either initially or as a result of discussions, will be considered for award. A price evaluation will be performed for all offerors in accordance with Section C.3. Award will be made to the lowest evaluated priced proposal meeting the acceptability standards for the non-cost factors.

1. TECHNICAL EVALUATION RATING.

Technical Acceptable/Unacceptable Rating

Rating
Description
Acceptable
Proposal clearly meets the minimum technical requirements.
Unacceptable
Proposal does not clearly meet the minimum technical requirements.

The technical evaluation will result in an overall technical factor rating of either “Acceptable or Unacceptable”. The evaluation will be based on the offeror’s ability to meet the needs of the Government and requirements of the Performance Work Statement (PWS). Offerors shall submit a proposal that demonstrates the ability to meet all required technical subfactors. To achieve an overall “Acceptable” technical rating, all sub-factors must be assessed as “Acceptable”. The Offerors’ proposal will be evaluated consistently with the criteria contained in Section M of the solicitation. Failure to demonstrate the ability to meet any of the sub-factors will result in an “Unacceptable” rating.

a. Subfactor A: Management Plan: This subfactor is met when the offeror’s proposal demonstrates a clear and concise approach to the following Elements:

· Element 1 - The offeror’s proposed process to manage multiple task orders by Functional Area ensuring successful task completion.

· Element 2 - The offeror’s proposed manning and staffing, including all assumptions, to ensure the plan is viable and provides qualified personnel to the Stuttgart Area of Responsibility (AOR) over the life of the contract. The Government will evaluate the manning and staffing to ensure the offeror is providing a sufficient number of personnel possessing appropriate qualifications (identified in TE 1.4-001 Personnel Qualifications) to implement the offeror’s management plan.

· Element 3 - The organizational chart and the relationship between the contract management organization, the higher corporate/company management, all lower level supervisor and subordinate relationships, and relationships between the contract management organization and subcontractors, to ensure efficient and effective corporation/company contract oversight throughout contract performance.

· Element 4 – If subcontracting, the offeror’s plan to manage its subcontractors, to ensure subcontracted specialized services will meet the requirements of the PWS without any compromise in quality.

· Element 5 - The offeror’s plan to manage, track and report on the following elements: progress, status and management; contract funds status; status of government furnished property; and shop/bench stock inventories (IAW PWS, C.1.3).

b. Subfactor B: Experience – This subfactor is met when the offeror demonstrates relevant experience performing the same or similar continuous services in terms of scope, size and complexity, within the past 5 years. For purposes of this subfactor, relevant scope means contracts performed for comparable facility operation and maintenance services as identified in the PWS. Relevant size means contracts with a comparable estimated annual value. Relevant complexity means contracts for simultaneous work in multiple installations/locations and facilities, performing multiple trades.

An “Acceptable” rating will be assigned if the offeror has one or more contracts that meet all three relevancy factors (scope, size & complexity), within the past 5 years. If the offeror does not have an individual contract that includes all three relevancy factors, an “Acceptable” rating will be assigned if, when combined, multiple contracts demonstrate the necessary recent and relevant experience in each of the three relevancy factors. An “Unacceptable” rating will be assigned if the offeror fails to demonstrate recent experience on any one of the three relevancy factors.

For experience, “offeror” refers to the proposed prime contractor and all proposed major subcontractors. A major subcontractor is defined as one who will provide services identified in the PWS equal to or above 20% of the total proposed price. The prime and all proposed major subcontractors will be assessed collectively to derive the offeror’s overall Experience rating. For the experience of major subcontractors to be evaluated, the offeror must submit a letter of commitment from the subcontractor(s) with the proposal.

c. Sub-factor C: Transition (Phase-In/Phase-Out) Plans: This subfactor is met when the offeror’s proposal demonstrates a clear and concise approach to the following:

· Element 1 - The ability to perform the phase-in period, not to exceed 60 days, to be able to assume full performance on schedule. The Government will evaluate how the offeror intends to provide training to the new workforce on all of the forms, reports, services, suspense dates and procedures. The Government will also evaluate how the offeror will finalize the draft plans: finalizing staffing issues; obtain installation passes; obtain computer access cards; acquire and position vehicles; acquire uniforms; acquire personal protective equipment; conduct a joint inventory of GFP; conduct the provisioning of offices; and perform any other actions to ensure readiness for full performance under the contract at the end of the phase-in period (PWS para C.1.3.1).

· Element 2 - The offeror’s phase-out plan to perform joint inventories; transfer existing licenses/permits or provide assistance in acquiring new ones; orient new personnel to sites, systems, and equipment; and perform any other action necessary to ensure that there is no interruption in support of installation maintenance services throughout the Stuttgart AOR during the 60-day phase-out period.

d. Subfactor D: Quality Control: This subfactor is met when the offeror’s proposal demonstrates a clear and concise approach to the following:

· Element 1 - The offeror’s approach to conducting comprehensive quality assurance methods and practices. The Government will evaluate the extent to which the offeror’s quality assurance methods are in accordance with the PWS (IAW PWS, C.1.9.2) and to ensure the provision of quality services without heavy reliance on Government inspection. The Government will also evaluate to ensure the offeror provides procedures to monitor performance, identify discrepancies, and take corrective action to prevent reoccurrences.

· Element 2 – A copy of the offeror’s ISO 9001:2008 certification.

2. PAST PERFORMANCE EVALUATION RATING.

Past Performance Acceptable/Unacceptable Rating

Rating
Description
Acceptable
Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable
Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

a.

The Performance Risk evaluation will be based on an “Acceptable” or “Unacceptable” basis. The information presented in the Past Performance Questionnaire (Attachment 4) and information obtained from other sources available to the Government will be the basis for evaluation of this factor. In this context, “offeror” refers to the proposed prime contractor and all proposed major subcontractors. A major subcontractor is defined as one who will be providing services identified in the PWS equal to or above 20% of the total proposed price. The prime contractor and proposed major subcontractors will receive one combined rating of either “Acceptable” or “Unacceptable”.

b.

The Government assessment will focus on contracts that meet the following conditions:

(i) Recency - Recent is defined as performance during the past five years from the date of issuance of the formal solicitation.

(ii) Relevancy – Relevant is defined as follows: relevant scope means contracts performed for facilities operation and maintenance services support consisting of maintenance and repair of all real property; relevant size means contracts with an estimated annual value comparable to this requirement; relevant complexity means contracts for simultaneous work in multiple installations/locations and facilities, performing multiple trades.

(iii) An evaluation to determine how well the contractor performed on the recent and relevant contracts. The past performance evaluation performed in support of this source selection does not establish, create, or change the existing record and history of the offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the offeror performed those past contracts.

Based on contracts received from the offeror, the past performance questionnaires, CPARS reports, and past performance information obtained from sources other than those identified by the offeror, to include Federal, State and local Government agencies, better business bureaus, published media, electronic data bases and personal knowledge, a determination will be made as to whether the offeror is assigned an “Acceptable” or “Unacceptable” rating as noted above. Note that no ranking is used for these criteria, only an “Acceptable” or “Unacceptable” determination as noted above.

The Government may reject a proposal if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.

c.

Offerors may provide information on problems encountered on the contracts identified in their past performance submissions and the offerors’ corrective actions (FAR 15.305). The offeror will have the opportunity to respond to any adverse past performance through communications/discussions, unless the offeror has had an opportunity to respond to the adverse information previously (FAR 15.306(b)(1)(i)).

d.

The offeror shall submit, along with the information required in this paragraph, a consent letter, executed by each subcontractor, teaming partner, and/or joint venture partner, authorizing release of past performance information to the offeror so the offeror can respond to such information. For each identified effort for a commercial customer, the offeror shall also submit a client authorization letter, authorizing release to the Government of requested information on the offeror's performance.

3. PRICE/COST EVALUATION APPROACH

a. The pricing criteria used for evaluation are (1) completeness, (2) price reasonableness, and (3) Total Evaluated Price (TEP).

b. Completeness – The Government will review the pricing submissions for completeness and compliance with Section L of the RFP. Incomplete price submissions may not be evaluated and the proposal may be eliminated from the competition.

c. Price Reasonableness – The offerors price proposal will be evaluated using one or more of the techniques defined in FAR 15.404-1 (Proposal Analysis Techniques). Generally, adequate price competition will satisfy the criteria of price reasonableness.

d. Total Evaluated Price (TEP) – The TEP will be calculated as the sum of the offeror’s proposed prices, Exhibits 1-9, for the base year and all option years, and prices for the six month period covered by FAR clause 52.217-8, Option to Extend Services. Materials, CLIN X006 and X012, will be included in the TEP using the annual estimate. The FFP IJO profit and G&A proposed rates from Exhibit 9, for CLINs X005 and X011, will be applied to a notional amount of €250,000 per year for evaluation purposes only. All unit prices and rates that comprise the TEP are contractually binding except Material, and thus all prices must be populated. Evaluation of the options shall not obligate the Government to exercise such options. An omitted rate may result in proposal elimination.

(i) Price Exhibits - The Government will evaluate the proposed prices for the specified Price Exhibits submitted for the base and option years as part of the TEP. Offers received without completed Price Exhibits will be considered non-conforming and may not be considered for contract award.

(ii) (v) The Government will include the Option to Extend Services under FAR Clause 52.217-8. For evaluation purposes, the Government will take one-half of the offeror's final option year price and add it to the offeror's total price. Thus, the offeror's total price for the purpose of evaluation will include the base period, all options and one-half of the final option year. Offerors shall not submit a price for the potential one-half year extension of services period.

(iii) List of Price Exhibits required to calculate TEP:

Exhibit 1 – Phase-In/Transition; includes all costs associated with phase-in/transition period.

Exhibit 2 – OMA Standing Operations Orders (SOO); monthly cost shall include all costs associated with routine contract management and administration.

Exhibit 3 – OMA Fixed Priced Items (FPI); unit price shall include all associated material costs.

Exhibit 4 – OMA Service Orders (SO) and Priority 1 Individual Job Orders (IJO); composite labor hour rate only, material CLIN X006 will support direct material used for SO and Priority 1 IJO tasks.

Exhibit 5 - AFH Standing Operations Orders (SOO); monthly cost shall include all costs associated with routine contract management and administration.

Exhibit 6 - AFH Fixed Priced Items (FPI); unit price shall include all associated material costs.

Exhibit 7 - AFH Service Orders (SO) and Priority 1 Individual Job Orders (IJO); composite labor hour rate only, material CLIN X012 will support direct material used for SO and Priority 1 IJO tasks.

Exhibit 8 – OMA & AFH Firm Fixed Price (FFP) Service Orders (SOs) unit price only, material CLINs X006 and X012 will support direct material used for FFP SO tasks.

Exhibit 9 – OMA & AFH Firm Fixed Price (FFP) Individual Job Orders (IJOs)

1. For Internal FFP IJOs, composite labor rate only.

2. For External (Subcontracted) FFP IJOs, the proposed percentages for both profit and G&A.

(iv) CLINs covering Contractor Manpower Reporting (CMR), will not be evaluated as these are Not Separately Priced CLINs.

e. Unbalanced Pricing – Offerors are cautioned against submitting an offer that contains unbalanced pricing. Unbalanced pricing may increase performance risk and could result in payment of unreasonably high prices. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or subline items. Offers that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.

Currency: Offers submitted in response to this solicitation shall be in Euros. Offers received in other than Euros shall be rejected.
