This plan shall be an update of the plan submitted with the Contractor’s original proposal; however, there are no Management Plans required in Section L. | Are Management Plans required to be submitted with the proposal? | Yes. Section L & M has been amended to clarify.
| 33 | German labor Law - Severance. |
German labor law imposes costly severance pay requirements for any employee who is terminated for reasons other than misconduct or poor performance. Due to BGB 613a implications, the responsibility of severance payments will shift to an incoming contractor. An incoming contractor may attempt to realize Cost Savings for the government due to more efficient staffing. This places the incoming contractor at high risk for owing severance payments to those employees who are not hired as a result of the transition, or are terminated due to redundancy over the life of the contract.
| This same severance rule is in effect for customer driven changes in project scope now and in the future, even if the customer allows a 3 month notice period. | Will the customer consider establishing a cost reimbursable CLIN to cover the employee severance payments subject to BGB 613a? | The Government is still working on a response. | ||
| 34 | Section M, 3.d(e), Price/Cost Evaluation Approach. Currency: Offers submitted in response to this solicitation shall be in Euros. | |||

In point 8, Please note the entire statement; All snow removal equipment for streets and walkways that includes but is not limited to plows, blowers, loaders, and spreading equipment. It was announced during the site visit that these requirements will be part of a new contract for grounds maintenance. Did we hear this right or will the above noted requirements still be part of this contract? | No, it's not part of this contract. PWS changed.
| 36 | 613a BGB (Acquired Rights Directive) Employee Payroll Data is incomplete. | Please provide full salary information and benefits for each incumbent employee. | The Government is still working on a response. | |
| 37 | RFP paragraph 52.217-19, Order Limitations (Oct 1995), page 70 of 98. | The maximum order limitation for a single item is 1.6 million. This number seems to be unrealistically high for a single item. Please clarify. | Clause 52.216-19, $16M. The Government used this number because it is possible for the Government to fund SOO (FFP) at the beginning of the base or options by a single task order. | |
| 38 | Please provide the total spend for the last year of contract DAJA02-02-D-0001 and the first year of the current bridge contract. How much of this spend was for IJO/Project work above the Service Order (SO) limit and also not part of the Standard Operating Orders (SOOs)? Since funding allocations are different for OMA and AFH, please provide total spend for OMA and AFH separately. | The Government will not be releasing this information. | ||
| 39 | RFP paragraph 2, Proposal Volumes, Page 86 of 98 | The page limitations for the Phase-in/Phase-out plan as well as the Quality Control plan are significantly too low to provide a comprehensive discussion of what the offeror plans to deliver. Can the page limitation for the Phase-in/Phase-out be raised to at least 25 pages and the limitation to the Quality Control plan be raised to at least 60 pages. This would allow offerors to include at least one sample QC check list for SO, IJO and SOO work as well as checklists for administrative work reception, work control, supply, etc. | The page limit was evaluated and determined to be adequate for evaluation purposes. | |
| 40 | RFP Paragraph C.1.13.2, Information Security, Page C-27 | Is there any requirement for any contractor personnel to handle classified information or have a security clearance? | The Government is still working on a response. | |

Has this oc curred? If yes, has the incumbent contractor been provided with space in Building 2333. Please provide information on what facilities are in Building 2333. | This has not occurred yet.
| 47 | RFP Attachment 2, Technical Exhibit, TE 5.2-001 Fire Sprinkler Systems (Pages 71-81) | The table TE5.2-001 contains little information on the Minimax Fire Sprin kler Systems. If this information is available, please provide. Since most of the information is not in the table (TE5.2-001), does this mean that Minimax or another subcontractor is providing the PM and any SO work that is necessary? | All available information is provided in TE 5.2-001. No, this does not mean that the PM and any SO work that is necessary is performed by a sub-contractor. | |
| 48 | RFP Attachment 2, Technical Exhibit, TE 5.8-002 | The text refers to IFS, VQM Hour and Service Order Distributions for Contract Years 98 - 00 (December 1997 - November 2000). The ta ble refers to Contract Year 2007. Which is correct? | Contract Year 2007 is correct. | |

| 50 | Service Orders by definition should not exceed 40 hours per SO. Why is work exceeding 40 hours considered a Service Order. | The Government is still working on a response. | ||
| 51 | The text states "Additional VQMs greater than or equal to 25 hours are completed on a Service Order and are not reflected below" _ Since the Range Column includes SOs greater than 25 hours, the text does not make sense. Please explain. | Statement has been deleted from TEs. | ||
| 52 | RFP Attachment 2, Technical Exhibit, TE 5.8-005 | Since there is a separate Domestic Appliance Contract, we assume that the tasks listed for "Contractor" refer to the Domestic Appliance and I or Dray age Contractor not the IMC Stuttgart Contractor. Is this correct? Does the IMC Stuttgart contractor have any tasks for Domestic Appliances? | No. Tasks in TE 5.8-005 are for this Contract | |
| 53 | PWS Attachment 2, Technical Exhibit, TE 1.4-002 (Page 8) and TE 1.4-001 (Page 5 and 6) | The chart in TE 1.4-2000 references an engineer. There is no reference in TE 1.4-001 to an engineer. Please clarify the re quired CDRL263R005 requirement so that the contractor can avoid viola tion of German law. | There is no CDRL 263R005. Deliverable # 103R005 only requires the following information. "Include the number of the full-time employees, their tariff grade, seniority with the firm, age, title, and the labor rates in effect at the date of submission." This information is not specifically related to a person by name, therefore it is "Statistics" not "Personal". | |
| 56 | RFP Attachment 1, Section C, Subparagraph C 1.8.1 and C 1.8.2 (Page C-21) | Is it correct to assume that the work that may be required under C 1.8.1 and C 1.8.2 is not part of the Firm Fixed Price (FFP) of the contract and will be separately negotiated? | Yes | |

| 59 | RFP Attachment 1, Section C, Paragraph C 1.14.2.1.6, Logged After Hours Emergency Service Order Follow up (Page C-42) | The receipt of information "prior to 1000 hours" seems very late. PWS changed. | |
| 64 | RFP Attachment 1, Section C, Paragraph C 1.14.6.4.1, Accounting System (Page C-59) | The offer is divided into FFP CLINs as well as T&M CLINs. Since under the FAR other than for a formal investigation, i.e. DCA's fraud audit, there is no requirement in the FAR for a contractor to provide detailed cost information for FFP CLINs, we assume that there is no accounting necessary to be re ported for FFP CLINs. Paragraph C 4.4.3 conflicts with this requirement. Please confirm that "all" supplies and materials are accounted for under the respective material CLINs | The Government does not see a conflict.
