All prices for this acquisition shall be stated in current U.S. dollars, rounded and displayed to two decimal places.

(Current U.S. dollars shall be interpreted to include escalation where appropriate.) It is noted that the terms of FAR 52.222-43, Fair Labor Standards Act and Service Contract Act – Price Adjustment (Multiple Year and Option Contracts shall be considered when proposing rates. DISCUSSIONS

The Government intends to evaluate proposals and award a contract without discussions with Offerors (except clarifications as described in FAR 15.306(a)). Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

In accordance with FAR 15.306(d), discussion sessions with each Offeror may be held. If discussions are conducted, the Contracting Officer will send electronic discussion letters to each Offeror’s POC. The discussion letter will specify information requested and when responses are required.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

SECTION M

BASIS FOR AWARD (Section M)

The Government will make one award based on the evaluation on the two step selection process that includes three phases and three (3) factors: Contract Management Personnel, Experience/Past Performance and Price. The basis of award includes an acceptable/unacceptable rating for Phase 1 and a trade-off analysis between Phases 2 and 3 as outlined in the following paragraphs.

Phases/Order of Importance:

Phase 1/Factor 1 – Contract Management Personnel is rated as acceptable or unacceptable. Only Offerors who are found to be acceptable will advance to Phase 2 – Experience/Past Performance and Phase 3 – Price Evaluation

Phase 2/Factor 2 – Experience/Past Performance is more important than price. The government will evaluate both Relevancy and Confidence as outlined below.

Phase 3/Factor 3 – Price Evaluation

Evaluation:

Phase1/Factor 1 – Contract Management Personnel (Acceptable/Unacceptable)

The Contract Management Personnel will be evaluated on an acceptable/unacceptable basis. The Government will conduct its analysis by evaluating the information submitted in response to the requirements set forth in Section L of the solicitation for “Volume 1 – Factor 1, Contract Management Personnel.” If an Offeror is found to be acceptable in Phase 1/Factor 1 – Contractor Management Personnel, the Offeror will move forward to the Phase 2.

Phase 2/Factor 2 – Experience/Past Performance

The Government shall consider the recency, relevancy, source and context of the past performance information it evaluates as well as quality, general trends in performance, and demonstrated corrective actions. A significant achievement, problem, problem resolution, or lack of relevant data can become an important consideration in the assessment process. A negative finding in any element may have an impact on the assessment and the Past Performance rating.

The rating for Phase 2 is more important than price. The Government is willing to pay a higher price for a higher relevancy and confidence rating.

In Factor 2, the Government will evaluate and rate Experience/Past Performance Information using a two rating scheme process as follow:

1. Relevant Company Effort

2. Quality of Past Performance. The past performance information of the Prime Contractor named on the signed Standard Form 1449, will be evaluated in combination with all the other required information submitted in Factor 2.

A relevant project that has both (a) the “Relevant Company Effort” and (b) the required PPIRS or PPQ record of quality. Only RFP compliant projects will be included in step two, Past Performance Relevancy Rating. The Governmen t will compare each compliant effort to the effort to be acquired, reach a consensus, and assign a relevancy rating. The SSEB will also evaluate the quality of the effort accomplished. The SSEB determines relevancy and, in making this determination, the following definitions for relevancy will apply:

Rating Description Very Relevant Present/Past performance e f f o r t involved e s s e n t i a l l y the same scope and magnitude of effort and complexities this solicitation requires.

Relevant Present/Past performance e f f o r t involved s i m i l a r scope and magnitude of effort and complexities this solicitation requires.

Somewhat Relevant

Present/Past performance effort involved some of the Scope and magnitude of effort and complexities this solicitation requires.

Not Relevant Present/Past performance effort involved l i t t l e or none of the scope and magnitude of effort and complexities this solicitation requires.

When the recent/relevant performance record indicates performance quality problems, the Government will consider the number and severity of the problems and the appropriateness and effectiveness of any corrective action taken.

Based on the Past Performance Relevancy assessment phase of the evaluation, the government will conduct an overall Performance Confidence Assessment rating. The overall Performance Confidence Assessment rating is an overall rating which takes into consideration the level of relevancy of each recent, rated project, the quality ratings of those rated projects, and the general trend of the recent, rated efforts have to the effort required by this RFP. The more relevant the recent projects are the stronger predictor of successful performance. The overall Performance Confidence Assessment Rating reflects the Government’s assessment of the Offeror’s probability of successfully performing the solicitation requirements. One of the following ratings will be assigned.

Adjectival Rating Description

Substantial Confidence Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.

Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.

Neutral Confidence No recent/relevant performance record is available or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.

The offeror may not be evaluated favorably or unfavorably on the factor of past performance.

Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.

No Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.

If the Offeror has little or no record of recent/relevant past performance information, or the record is so sparse that no meaningful confidence assessment rating can be reasonably established, or for whom information on past performance is not available, the SSEB shall treat the Offeror neither favorably nor unfavorably. Such an Offeror shall be rated “Unknown Confidence (Neutral)”.

Phase 3/Factor 3 –Cost/Price

The offeror’s proposed price will be evaluated as follows:

Price analysis techniques will be used to determine price reasonableness. The price factor will be evaluated, but not adjectively rated. FAR requires that contracts be awarded at prices that are fair and reasonable. The Contracting Officer is responsible for the determination of price reasonableness. The cost proposals will be evaluated using price analysis in accordance with FAR 15.404-1, Proposal Analysis Techniques.

The Government intends to evaluate price reasonableness in accordance with FAR Part 15.404-1(b), relying primarily upon competition. The Government expects adequate competition and a comparison will be made of total evaluated prices received in response to the solicitation.

The total evaluated price will be the sum of the Base Year, the subsequent four Option Years, and the Option to Extend Services, IAW FAR 52.217-8, using the information submitted in the pricing matrix. The total price for the Base Year and each Option Year, respectively is the sum of the prices for all CLINs within the respective ordering period.

Recent Director of Defense Policy states that contracting officers will no longer use the standard at FAR 15.403- 1(c)(1)(ii) or (iii) to determine that the offered price is based on adequate competition when only one offer is received. In the event where only one offer is received in response to the solicitation, certified cost or pricing data or other than certified cost or pricing data may be required.

Unbalanced Pricing – As part of the cost evaluation, proposals may be reviewed to identify any Unbalanced Pricing.

In accordance with FAR 15.404-1(g), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk

The methods of evaluation noted above may include the use of information from sources such as (but not limited to) the Defense Contract Audit Agency (DCAA) and the Defense Contract Management Agency (DCMA).
