PATRIOT Security Classification Guide SECTION 1

GENERAL

1.0 General

1.1 Purpose

The purpose of this document is to provide classification policy, guidance and procedures for information and material pertaining to the Phased-Array Tracking to Intercept of Target (PATRIOT) Air and Missile Defense System (to include the PATRIOT Advanced Capability-3 (PAC-3) and PAC-3 Missile Segment Enhancement (MSE) missiles).

1.2 Authority and Scope

a. This guide is issued pursuant to provisions of Department of Defense (DoD) Regulation 5200.1-R, Information Security Program, Army Regulation (AR) 380-5, Department of the Army Information Security Program and DoD Manual 5220.22-M, National Industrial Security Program Operating Manual. Information classified according to this guide, including operations and activities that reveal such information, shall be safeguarded in accordance with (IAW) applicable agency security directives. This guide includes requirements established by Executive Order (EO) 13526, Classified National Security Information.

b. This guide constitutes authority for government and industry holders and shall be cited as the basis for classification, re-grading, and declassification of information and material associated with the PATRIOT program. Changes in classification required by application of this guide are effective immediately for all material created, updated, or finalized after the effective date of this guide.

Documents generated under EO 13526 shall be marked to comply with applicable agency policy directives for implementing the EO.

There is no requirement to retroactively re-mark existing classified PATRIOT documents; however when updated, revisions must conform to the classification levels and marking requirements assigned by this guide. The classification shown within this guide is the highest level anticipated.

1.3 Office of Primary Responsibility (OPR)

The Lower Tier Project Office (LTPO) has primary responsibility for overall management of the PATRIOT program. Inquiries, challenges, suspected compromises of information, and suggestions concerning this guide and its interpretation should be addressed to Program Executive Office Missiles and Space (PEO MS), ATTN: SFAE-MSLS-LT-SO, 106 Wynn Drive, Huntsville AL 35806, Commercial 256-955-2062, DSN 645-2062.

1.4 Classification Challenges

Data/information that suggests tactics that have a high probability of defeating the system must be referred to the LTPO Security Manager for classification determination. The information will be protected as SECRET with access limited to essential personnel pending LTPO classification determination, where the appropriate classification will be determined.

If there is substantial reason to believe the security classifications prescribed in this guide impose requirements that are impractical or, if this guide requires updating due to the technological changes in the state-of-the-art or progress attained during the execution of the PATRIOT program, then communicate such to the LTPO Security Manager. Pending final decision, handle and protect the information at its current classification level or at the recommended change level, whichever is higher. Point of contact for classification determinations or to challenge a classification decision regarding PATRIOT information should be directed to PEO MS, ATTN: SFAE-MSLS-LT-SO, 106 Wynn Drive, Huntsville AL 35806, Commercial 256-955-2062, DSN 645-2062. Include sufficient description to permit identification of the specific information under challenge with reasonable effort. Include detailed justification outlining why the information is improperly or unnecessarily classified.

1.5 Reproduction, Extraction, and Dissemination

This document provides authority to reproduce, extract from, and or disseminate the security classification guide (SCG) as necessary to those supporting the effort, including industry. Reproduction, extraction, and dissemination are limited to the restrictions of the Distribution Statement applied to this SCG. Distribution is authorized to DoD agencies and their contractors for administrative and operational use.

1.6 Determination of Classification

a. The security classification system should deny foreign governments information regarding United States (US) capabilities and intentions that would permit them to modify their military systems and plans in a manner to lessen the effectiveness of US systems and devalue the US investment in the acquisition of that system. Information that requires application of national security considerations include: effectiveness, countermeasure susceptibility, limitations, and concepts for potential operational deployment and tactics. Equally important is the protection of information that, if known by a foreign country, could reduce the time, cost, and risk of developing a viable defense system or similar technology for weapon system application. Critical data needed to accomplish program goals require higher security classification. Information shall be classified based on context as well as content.

b. Generally, the following information is classified:

(1) Quantitative and other detailed information relative to specifications, performance parameters, and overall performance capabilities.

(2) Information concerning breakthroughs, significant technical advances, or advantages in technology and applications. A breakthrough occurs when a technological development is imminent or is achieved that constitutes a marked or sudden deviation from a trend or shows unexpected progress in relation to time and is not predictable qualitatively; or when an increase in performance or capability appears to open a field of application to new military system uses. A significant technical advance is defined as an advance of sufficient magnitude to have potential use in an operational or advanced system that results in a definite military advantage.

(3) Technical and non-technical information that could provide another country with significant assistance in the development of similar equipment, thus reducing the requirement for commensurate expenditure of resources, as compared to US efforts, and reducing US lead-time advantage.

(4) Information that could significantly assist a potential enemy in the quantitative assessment of US actual and planned systems.

(5) Test results from an operational weapon system test; weapon-like test bed; simulations; technology demonstrations; and component, prototype, or subsystems test.

(6) Information regarding damage and vulnerability to US weapon systems, including theoretical analysis.

(7) Information concerning the development of countermeasures or counter-countermeasures that reveal US weapon systems vulnerability or current US judgment as to the effectiveness or efficiency and possible weapon systems application.

(8) Reasons for Classification: Information may be initially classified only by an original classification authority and only when the information’s unauthorized disclosure could reasonably be expected to cause damage to our national security. To be eligible for classification, information must fall within one or more of the categories outlined in EO 13526. The classification decisions contained in this guide are based on the following: 1.4 a – military plans, weapon systems, or operations.

1.7 Public Release

a. The fact that this guide shows certain details of information to be unclassified does not authorize automatic public release of such information. Separate from classification, there are other reasons why information may not be releasable including national-level policy implications. Other important release restrictions are governed by the provisions of the Freedom of Information Act (FOIA), Operation Security (OPSEC) and regulations that apply to technical or other export-controlled data FOIA requests shall be processed through established FOIA channels as described in DoD Regulation 5400.7-R, DoD Freedom of Information Act Program, with Change 1. Strictly control distribution of the material until reviewed and approved for public release by the US Army PEO MS.

b. Any proposed release into the public domain of information pertaining to PATRIOT from outside of the LTPO or other PEO MS office will be submitted through Commander, US Army Aviation and Missile Command (USAAMCOM) Life Cycle Management Command, ATTN: AMSAM-PA, Redstone Arsenal, AL 35898-5020, IAW Chapter 5, AR 360-1, The Army Public Affairs Program.

Releases which require referral to the Office of the Assistant Secretary of Defense (Public Affairs) as set forth in DoD Manual 5220.22-M; DoD 5230.9, Clearance of DoD Information for Public Release and DoD Regulation 5400.7-R, shall be submitted 60 days in advance to allow sufficient time for processing. No material will be released until clearance is granted.

c. All material proposed for public release will require an OPSEC review by PATRIOT OPSEC personnel and a technical review by a PATRIOT subject matter/technical expert before release to the general public. After OPSEC and technical reviews, material will be submitted to the PEO MS Security Office for final OPSEC review and approval.

d. The PEO MS Security Office is responsible for coordinating requests for public releases received from the USAAMCOM Public Affairs Office. The PEO MS Security Office will maintain a record of all public releases by PEO MS personnel.

1.8 Foreign Disclosure

a. Release of any information on this program to any foreign government, foreign nationals, representatives of a foreign government or nation, or US citizen residing in a foreign country is subject to the provisions of AR 380-10, Foreign Disclosure and Contacts with Foreign Representatives. Any government activity or defense contractor receiving a request for classified or unclassified official information pertaining to this program from any foreign government, foreign national, representative of a foreign government or nation, or US citizen residing in a foreign country shall advise the requestor to make an official request through his Embassy to the Department of Army, Deputy Chief of Staff for Intelligence. Questions should be directed to the LTPO Security Office, telephone:

(256) 955-2111 or 2062.

b. For classified military information, the disclosure authority is the PEO MS Foreign Disclosure Officer and the Headquarters, Department of the Army, G2. Such material must be consistent and supported by an appropriate release mechanism (i.e., Foreign Military Sales (FMS) case or Delegation of Disclosure Authority Letter ).

c. For Controlled Unclassified Information (CUI), the disclosure authority is the respective Program Manager IAW the PEO MS Memorandum, subject: Authority to Disclose Technical Controlled Unclassified Information, 20 June 2007.

d. FMS issues will be considered during the review of all classification guides. Issues will be coordinated with foreign disclosure officers and security assistance/foreign military sales representatives.

1.9 Marking of Material

a. Material Classified IAW this SCG: Most classified documents are derivatively classified, in that the classification is based on classified material being incorporated from one or more classified source document(s) or from a security classification guide. The classification of material based on the guidance outlined in this SCG is considered to be derivatively classified and will be marked with the classification level reflected in the “CLASSIFICATION” column of sections 2 through 8. Other markings as required by AR 380-5, will be as follows:

CLASSIFIED BY: PATRIOT Air and Missile Defense System Security Classification Guide DECLASSIFY ON: _________ (Insert data from “Declassify” column in Sections 2 through 8 or a date 25 years from the date of the SCG) DATE OF SOURCE: _________ (Insert date of this SCG)

b. Markings Based on Incorporation of Classified Material from Sources Other than this SCG: The classification and markings on documents derived from other sources will be based on the source document(s). The derivative classification shall indicate the source document or classification guide on the “CLASSIFIED BY” line, including the agency, activity or command, the office of origin, and the date of the source document or SCG. When material is classified derivatively on the basis of more than one source document or classification guide, the “DERIVED FROM” line shall read “Multiple Sources” and the derivative classifier shall keep a list of the sources with the file or record copy of the derivatively classified document. This list should be provided with all copies of the document, if practicable. When a specific date or event is listed on the source document or classification guide, the derivatively classified document will show that date or event after the “DECLASSIFY ON” line. When multiple sources are utilized, the date or event on the derivatively classified document will reflect on the “DECLASSIFY ON” line, the most distant date among the multiple sources.

If the information in the document has been extracted from a document marked “Originating Agency’s Determination Required” or “OADR,” place the statement “Source marked OADR” on the “DECLASSIFY ON” line, followed by the date of the document after the words “DATE OF SOURCE.” When using multiple sources of information marked “OADR,” the “DATE OF SOURCE” line will reflect the most recent date (the document with the latest date). For example, one source is dated 3 May 1999 and one document is dated 1 June 2003, the newly created derivatively classified document will be marked:

CLASSIFIED BY: Multiple Sources DECLASSIFY ON: Source marked OADR DATE OF SOURCE: 1 June 2003

c. Distribution Statements on Technical Documents: Classified and unclassified technical documents, including FOR OFFICIAL USE ONLY (FOUO) documents, shall be marked on the cover with an appropriate distribution statement IAW DoDD 5230.24, Distribution Statements on Technical Documents. The majority of LTPO documents will be marked with “Distribution Statement D” as follows.

DISTRIBUTION STATEMENT D. Distribution authorized to the Department of Defense (DoD) and US DoD contractors only; Critical Technology; _______________ (date of this SCG).

Other requests for this document shall be referred to Lower Tier Project Office (LTPO), ATTN: SFAE-MSLS-LT-SO.

d. Computer Read Information: The requirement for identifying and marking computer information is the same as marking a hard copy. Computer information includes document files such as .pdf, Word, Excel, Powerpoint, etc. and should be annotated with the appropriate classification on each page IAW this SCG. Software programs to include input/output text files should be marked with the appropriate classification.

1.10 Explanation of Columns used in Sections 2 through 8 of this Guide

a. The “ELEMENT” column identifies the item to which security classification guidance is being provided.

b. The “CLASS” column in each section reflects the highest anticipated classification level of the information set forth in the “ELEMENT” column. Abbreviations for classification levels are: S = SECRET, C = CONFIDENTIAL and U = UNCLASSIFIED.

c. The “DECLASS” column specifies how long the classification shall remain in effect.

(1) Declassification date will be 25 years after the original classification decision, determined using the following criteria:

(a) For documents or material deriving classification from the SCG, whether the topic is specific or general, the effective date of the guide will be the basis for determining 25 years of age.

(b) For documents or materials classified by an original decision where an SCG does not apply, the date of the official record that documents the decision will be the basis for determining 25 years of age.

(c) For documents or materials deriving classification from multiple sources, the date of the most recent source cited will be the basis for determining 25 years of age.

(d) In situations where the above instructions cannot be applied, the date of the document or the item itself will be the basis for determining 25 years of age.

(2) Changes to markings on existing documents and material for declassification will be accomplished on an “as needed” basis, but must be done the next time the item is handled or reviewed. All newly created classified information will reflect the appropriate date for declassification based on this guide.

d. The “REMARKS” column includes further explanation of the guidance and/or reference “Notes,” which provide additional specific details to assist SCG users in accurately determining classification of information.

e. Questions about marking classified material IAW this SCG should be referred to the LTPO Security Manager, SFAE-MSLS-LT- SO, Commercial 256-955-2062, DSN 645-2062.
