About this file
This is a solicitation for the load, assembly and pack of 60mm, 81mm, and 120mm Full Range Practice Cartridges. The Army Contracting Command New Jersey is seeking to acquire the 60mm M769, 81mm M879A1 and 120mm M931 Full Range Practice Cartridge, which consist of hollow shell bodies that look identical to High Explosive Cartridges but contain no energetic fill. The cartridges utilize a center vent tube and aft shell body holes to simulate weight and allow fuze signature venting. They accept spotting charge fuzes that produce a flash/bang/smoke signature for observer feedback. The cartridges are packed one to a fiber container in wooden wirebound boxes. Offerors must bid on all three cartridge types and plan to meet a required eight month First Article Test deadline. The solicitation includes pricing matrices, evaluation criteria, and instructions for proposals due by a specified date and time.

SECTION H - SPECIAL CONTRACT REQUIREMENTS
Instructions for Economic Price Adjustment Labor and Material - Actual Cost Method
(a) In accordance with FAR 16.203-3, this firm fixed price procurement provides for an Economic Price Adjustment (EPA) for the cost of
Paper (used in the Fiber Tubes), Steel (used in the Vent Tubes) and Wood (as part of the Wire Bound Boxes). The Fiber Tubes, Vent Tubes and Wire Bound Boxes, are used in the production of the 60mm M769, 81mm M879A1 and 120mm M931 Full Range Practice Cartridge (FRPC).
(b) The amount of any increase or decrease in line item prices will be limited to the cost of the actual fluctuation in Paper, Steel and
Wood only and shall not include indirect costs and profit.
(c) The Contracting Officer will notify the contractor approximately 45 days prior to exercising any options or issuance of a Delivery
Order (out year). Within 20 days of the notice, the Contractor shall provide computations for any increases or decreases related to
Paper, Steel and Wood including related documentation (i.e. current vendor quotation) to support proposed changes. The out year unit prices will be awarded at the negotiated unit price plus or minus the contractors substantiated EPA, subject to the percentage threshold noted below, without interest.
(d) The total increase for any out year unit price shall not exceed ten (10) percent of the original proposed out year unit price, inclusive of the cost of Paper, Steel, and Wood identified in Section B. There is NO percentage limitation on the amount of decreases that may be made.
(e) EPA Formula - Contract adjustments will be based on the difference between Paper, Steel and Wood included in the Contractors end-item price at the time of contract award versus the purchase order or invoice price for Paper, Steel and Wood used to produce the end item in the relevant contract modification.
There shall be no contract adjustment for any change in the cost of Paper, Steel and Wood which would not result in a net change of plus or minus five (5) percent of each raw material item associated with the relevant contract modification. The five (5) percent limitation applies to each raw material item (paper, steel and wood).
An Example of this calculation follows:
R1 = Cost of Paper associated with Out year Price per Section B
R2 = Raw Material Adjusted per EPA
O = Out year Unit Price (Inclusive of Paper) per Section B
R1 =$50 Qty = 10,000 units
R2= $70
O = $200 (Section B Price)
Trigger Threshold for EPA = 5%
Step 1: Calculate Out year Unit Price with EPA
(R2 - R1) + O
($70 - $50) + $200 = $220 (Out year Unit Price with EPA)
Step 2: Calculate the percent change of the Out Year Unit Price with EPA from Out Year Unit Price awarded, which includes the cost of
Paper, Steel and Wood from Section B.
(R2 - R1) / O
($70 - $50) / $200 = .10 (10.0%) (Percentage change of initially awarded unit price)
Conclusion: Since the EPA is only applicable if the adjusted price is plus or minus 5% of the Unit Price initially awarded and the increase calculated above is 10.0%; the Out Year Unit Price is subject to an Economic Price Adjustment.
Based on the sample quantity of 10,000 each, the results of the EPA adjustment is as follows:
$200 * 10.0% = $20.00 * 10,000 = $200,000
(f) As the actual cost of Paper, Steel and Wood may fluctuate from the EPA substantiated cost, a final EPA adjustment may be necessary to reflect the final cost of Paper, Steel and Wood. The Contractor shall submit a final analysis, which compares actual EPA costs to
EPA substantiated costs from paragraph (c) above within 30 days following the receipt of the final invoice for Paper, Steel and Wood associated with the total out year quantity exercised. The Contractor's supporting data shall include copies of purchase orders or invoices showing the actual unit cost to include base price of Paper, Steel and Wood , any surcharges and total quantity of the applicable Paper, Steel and Wood that the contractor procured to produce the 60mm M769, 81mm M879A1 and 120mm M931 Full Range Practice
Cartridges. The Contracting Officer will modify the contract to reflect the final EPA price adjustment.
3 23
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
(g) In addition to the above, any price adjustment shall be limited to the effect on the unit price resulting from the increases or decreases in the cost for Paper, Steel and Wood. There shall be no adjustment for:
(1) Supplies or services for which the production cost is not affected by such changes;
(2) Changes in line item unit price based on materials other than Paper, Steel and Wood; or
(3) Changes in the usage quantity of Paper, Steel and Wood from that proposed for the production.
(h) The contractor must submit adequate information to establish the baseline from which adjustments will be made. The Contracting
Officer may require verification of the data submitted to the extent necessary to permit reliance upon the data as a reasonable baseline. Offerors shall provide the detailed data required by the EPA clause with their original proposal submission. Supporting documentation is also required in the form of a Vendor Quote, Purchase Order, Invoice, etc. (including any escalation applied by the contractor) to substantiate the cost for Paper, Steel and Wood as submitted in Attachment 0001 - Price Matrix.

L.4.2.4 Unbalanced Pricing. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The greatest risks associated with unbalanced pricing occur when (a) Startup work, mobilization, first articles, or first article testing are separate line items; (b) Base quantities and option quantities are separate line items; or (c) The evaluated price is the aggregate of estimated quantities to be ordered under separate line items of an indefinite-delivery contract. Offerors shall provide documentation, including

L.4.4 VOLUME IV Small Business Participation
L.4.4.1 The Small Business Participation Factor Volume is comprised of a single chapter. Offerors are responsible for including sufficient detail to permit a complete evaluation. Any information provided as part of the Small Business Participation Factor Volume may be used to correlate the evaluation of the other proposal volumes.
L.4.4.2 This provision applies to every Offeror (U.S. and non-U.S.), regardless of size status or locations of working facilities or headquarters. For proposal preparation purposes, the Offeror's Small Business Participation proposals shall be consistent with any subcontracting references/identification contained elsewhere in any other Factor Volume. Percentages are calculated using proposed total contract price as calculated IAW L.4.2. This price becomes the denominator and include first-tier subcontractors only. For the purpose of evaluating Small Business Participation, the total contract price is determined by multiplying the unit price for a single 60mm, 81mm, and 120mm FRPC from Ordering Period 3. For the 60mm and 120mm FRPC, utilize range 10,000-59,999 times 100,000 mortar cartridges.
For the 81mm FRPC, utilize 10,000-69,999 times 100,000 mortar cartridges. Offerors shall also explain their rationale as to why the percentage of SB participation being utilized for this effort is appropriate for their company. Offerors shall describe their approach and efforts undertaken to utilize SB. SB targets will be incorporated into any resulting prime contract and contractors will be required to report SB participation.
L.4.4.3 All Offerors, including Offerors who are themselves U.S. small business concerns based on the NAICS code assigned to this requirement, are to identify the extent to which U.S. small business concerns will be utilized as first-tier subcontractors in the performance of this proposed contract. U.S. small business concerns are defined (1) in FAR 2.101 and (2) by the criteria and size standards in FAR 19.102 for the applicable NAICS code. U.S. small business concerns include SBs, SDBs, WOSBs, HUBZone SBs, VOSBs, and
SDVOSBs.
L.4.4.4 If the Offeror (to include any U.S. small business concerns who are proposing as part of a joint venture or teaming arrangement) is itself a U.S. small business concern, the Offeror's own participation as a SB, SDB, WOSB, HUBZone SB, VOSB, or SDVOSB will also be considered small business participation for the purpose of this evaluation. In this event, the extent of the Offeror participation as a
U.S. small business concern shall be detailed in the same manner as subcontracts to first-tier U.S. small business concerns.
L.4.4.5 Small Business Amounts: All Offerors shall address anticipated U.S. Small Business concern participation and subcontracting based on the total contract dollars proposed by the Offeror.
L.4.4.6 The Offeror shall provide information for Small Business participation and subcontracting in a table format IAW the following example:
Total Contract Price: $43.00M
| Business Category | $ Cost All Contracts | % of SB Participation | Cost Total Subcontractors |
| SB | $10.34M | 24.00% | $10.34M of $43.00M |
| SDB | $2.86M | 6.65% | $2.86M of $43.00M |
| SDB | $2.36M | 5.50% | $2.36M of $43.00M |
| WOSB | $1.55M | 3.60% | $1.55M of $43.00M |
| HubZone SB | $1.08M | 2.50% | $1.08M of $43.00M |
13 23
Name of Offeror or Contractor:
PIIN/SIIN MOD/AMD
| VOSB | $1.55M | 3.60% | $1.55M of $43.00M |
| SDVOSB | $1.46M | 3.40% | $1.46M of $43.00M |
L.4.4.6.1 Guidance for filling in the above "Small Business Participation" Table:
a. Include first-tier subcontractors only. Please note that members of a joint venture may be considered the Offeror or the first tier subcontractors, depending on the legal form of the joint venture as defined in its agreement document.
b. If the Offeror is a U.S. Small Business concern, detail the extent of the Offeror participation as an U.S. Small Business concern in the same manner as subcontracts to first tier U.S. Small Business concerns.
c. Percentages should be rounded to the nearest hundredth of a percent.
L.4.4.6.2 Additional Guidance for particular Business Categories:
a. For "Total Contract Price": Include the Offeror's proposed Total Contract Price on this line.
b. For SB: Include U.S. Small Business concerns from all categories (i.e. SB, SDB, WOSB, HUBZone SB, VOSB, and SDVOSB) in the dollars and percentage on this line. The SDB, WOSB, HUBZone SB, VOSB and SDVOSB are subcategories of SB and the dollars in each of these may not add to match the total dollars in the SB line due to the following: In some cases the same dollars may be reported in more than one block (i.e., a $10,000 subcontract to a Woman-Owned Small Business that is also a Service-Disabled Veteran-Owned Small Business should be entered on four rows: $10,000 under SB, $10,000 under WOSB, $10,000 under VOSB and $10,000 under SDVOSB). Be sure that the dollars are counted in the SB line only once and not four times (e.g. $40,000 representing the same firm participating at $10,000 in differing categories). Note that the SB percentage is not simply a total of the percentages of each SB subcategory and must be calculated separately as shown in the chart.
c. For HUBZone SB: Include only "SBA certified" HUBZone SBs. Note that this is different from some of the state HUB certifications.
L.4.4.7 Small Business List: All Offerors shall provide the names and CAGE codes of small business concerns (including the Offeror if a small business concern) who would participate in accomplishing the proposed contract; the small business classification of each U.S.
small business concern (i.e. SB, SDB, WOSB, HUBZone SB, VOSB and SDVOSB); a short description of the specific…
