Executive Summary: This executive summary highlights some of the important features of this solicitation. If conflicts exist between this summary and the provisions of the solicitation, the provisions of the solicitation govern.

1. Introduction: The United States (US) Army Contracting Command New Jersey in support of the Office of the Project Manager Combat

Ammunition Systems has a requirement for the 60mm M769, 81mm M879A1 and 120mm M931 Full Range Practice Cartridge (FRPC). The 60mm M769, 81mm M879A1 and 120mm M931 FRPC consist of a hollow shell body with no energetic fill, and except for the color, looks identical to the

High Explosive (HE) Cartridges. The FRPCs utilize a center vent tube to simulate the weight of the HE fill and allow the fuze signature to be vented through a series of holes in the aft shell body. The cartridge bodies accept the M775 Practice Fuze for the 60mm FRPC, the

M751 Practice Fuze for the 81mm FRPC, and M781 Practice Fuze for 120mm M931 FRPC; which contain a spotting charge that ignites upon ground impact. The practice fuze produces a flash/bang/smoke signature that provides audio and visual feedback to forward observers.

The plastic ogive simulates the contour and the four function settings of the M734A1 multi-option fuze used on the service mortars. The

FRPCs currently use four increments as the propelling charge system is initiated by the ignition cartridge. The cartridges are packed one to a fiber container which are packed into a wooden wirebound box.

2. Acquisition Strategy: The contractor shall manufacture and produce the 60mm M769, 81mm M879A1, and 120mm M931 FRPCs in accordance with the Statement of Work (SOW) found within Section C and all Request for Proposal (RFP) requirements. The proposed acquisition strategy will be limiting competition to contractors within the US, its outlying areas, or Canada only in accordance with FAR 6.302-

3(a)(2)(i). Major components for this procurement to be supplied as Government furnished material are: shell bodies, fins, fuzes, ignition cartridges, and propelling charges. These major components may be purchased from vendors outside the US, its outlying areas, or

Canada. This acquisition may result in up to three (3) awards of Indefinite Delivery/Indefinite Quantity (ID/IQ) contracts with Firm

Fixed Price (FFP) delivery orders over five (5) one (1) year ordering periods, with a maximum contract value of $132,687,189.50 for all awardees combined. The guaranteed minimum of $50,000.00 for each ID/IQ contract will be satisfied by awarding the first delivery order to each potential awardee. The Government reserves the right to make a single award if it is determined to be in the best interest of the Government. The anticipated award for this acquisition is Fiscal Year 2023, Quarter 1(FY23Q1).

Best Value Subjective Trade-off procedures in accordance with FAR 15.101-1 will be utilized. The Government plans to evaluate

Technical, Price, Past Performance, and Small Business Participation factors. For evaluation purposes, the Technical Factor is more important than the Price Factor, the Price Factor is more important than the Past Performance Factor, and the Past Performance Factor is significantly more important than the Small Business Participation Factor. The Technical Factor has four (4) Subfactors: Quality

Assurance and Safety Critical Characteristics Plan, 60/81/120mm FRPC First Article Test (FAT) and Production Schedule, Manufacturing

Plan, and Management Plan. Of the four (4) Technical Subfactors, the Quality Assurance and Safety Critical Characteristics Plan is slightly more important than the 60/81/120mm FRPC FAT and Production Schedule and the Manufacturing Plan, which are of equal importance and are each slightly more important than the Management Plan. The basis for award of a contract resulting from this solicitation will be the results of the evaluation factors and subfactors. This process permits trade-offs among cost or price and non-cost factors and allows the Government to accept other than the lowest price proposal.

3. Technical Data Package (TDP): The Technical Data Package (TDP) is marked Distribution D, for this solicitation and any resulting contract includes documents that are proprietary to the Government. Disclosure and use of the TDP are restricted by the Non-Disclosure and Non-Use Agreement (Section J, Attachment 0014) and any potential offeror(s) are required to execute prior to accessing the proprietary TDP.

The offeror shall not reproduce, duplicate or copy the TDP, or any portion thereof, except to the extent necessary for, and then only in connection with (i) the preparation and/or submission of proposals related to this procurement being affected by the United States

Government, or (ii) the manufacture within the United States, Canada, or its outlying areas or under a contract with the United States

Government.

This solicitation contains technical data whose export is restricted by the Arms Export Control Act (Title 22, U.S.C., Sec 2751, et seq.) or the Export Administration Act of 1979, as amended, Title 50, U.S.C, App. 2401 et. seq. Violations of these export laws are subject to severe criminal penalties. Disseminate in accordance with provisions of DoD Directive 5230.25. This also applies to distribution of the TDP to all SUBCONTRACTORS at every level. To be eligible to gain access to export controlled TDP whether it is via

CD or online, you must have a current DD 2345 (Section J, Attachment 0017), Militarily Critical Technical Data Agreement certification on file with the Defense Logistics Information Service (DLIS). To obtain certification, go to www.dla.mil/HQ/LogisticsOperations/Services/JCP.aspx , click on documents, and follow instructions provided. Processing time is estimated at three days after receipt. Upon receipt of certification, you may request the TDP.

SECTION B - SUPPLIES OR SERVICES AND PRICES/COSTS

Whenever the Government uses the singular word contractor, it also means contractors if there are multiple awards.

CONTRACT MINIMUM / MAXIMUM__________________________

The guaranteed minimum for this ID/IQ contract will be $50,000.00 satisfied through the award of the first delivery order to each potential awardee.

The maximum contract value is $132,687,189.50 for all awardees combined. The period of performance shall be 60 months from contract award or when the maximum contract value is reached, whichever comes first.

ORDERING PERIODS________________

Award(s) made as a result of this RFP will be five (5) year ID/IQ, FFP contract(s) with one year ordering periods. Contract(s) will be awarded in FY23, with five (5)-One (1) Year Ordering Periods through FY28. The U.S. Government reserves the right to make more than 1 award in each ordering period.

An Ordering Period/Year is defined as:

Ordering Period 1 (OP1) is defined as the period of 12 months from the date of contract award; and

Ordering Period 2 (OP2) is defined as the period of 12 months from the end of Year 1; and

Ordering Period 3 (OP3) is defined as the period of 12 months from the end of Year 2; and

Ordering Period 4 (OP4) is defined as the period of 12 months from the end of Year 3; and

Ordering Period 5 (OP5) is defined as the period of 12 months from the end of Year 4.

Note: The terms "Year" and "Ordering Period" are used interchangeably.

FIRST ARTICLE TESTS___________________

Initial FAT: The initial FAT is the very first FAT awarded on the contract for each contractor receiving an award. This FAT is in accordance with the complete FAT requirements in the RFP. The U.S. Government plans to award an initial FAT no more than once per contract for each item.

Additional FAT (AFAT): An Additional First Article Test is a FAT ordered in accordance with the SOW. Because this is an Additional FAT, existing processes and existing equipment are expected to be utilized to the maximum extent possible. Existing approved CDRL submissions from the Initial FAT may be utilized provided they are unaffected by the changes.

PLACING OF ORDERS_________________

Orders will be placed by Army Contracting Command - New Jersey (ACC-NJ).

CUMULATIVE PRICING__________________

The resultant contract (if a single award is determined) will include a Multiple Ordering Window of 90 days. In the event that the

Government has a requirement for a delivery order to be placed within 90 days of a previously issued delivery order for the same item(s), the quantity of the current order will be combined with the quantity from the preceding order to arrive at a cumulative quantity. The current delivery order will be priced at the contract price from the appropriate range and ordering period for the cumulative quantity.
