Performance Requirements Summary.
1. General: The rights of the Government and remedies described in this section are in addition to all other rights and remedies set forth in this solicitation. Specifically, the Government reserves its right under the Inspection of Services and Termination for Default clauses. Any deductions pursuant to the Performance Requirements Summary (PRS) shall reflect the reduced value of service performed under the contract. The Contractor shall not be relieved of full performance of the services hereunder and may be terminated for default based upon inadequate performance of service even if a deduction was previously taken for inadequate performance. The Government may modify the type and frequency of inspection of items.
2. Purpose: The Performance Requirements Summary is designed to:
2.1 List the contract requirements considered most critical to acceptable contract performance (Column 1).
2.2 List the contract paragraph number(s) which describe the requirements (Column 2).
2.3 Define the standard of performance for each required service specified (Column 3).
2.4 Show the maximum allowable degree of deviation or Acceptable Quality Levels (AQLs) from perfect performance for each required service that will be allowed by the Government before contract performance is considered unsatisfactory, and the lot used in surveillance (Column 4).
2.5 Explain the quality assurance methods the Government will use to evaluate the Contractor's performance in meeting the contract requirements (Column 5).
2.6 Show the percentage of the total contract work that each listed contract requirements represents (Column 6).
3. Performance Requirements Summaries: The Performance Requirements Summaries list those services/tasks for which the Government will make deductions from payment due the Contractor when services/tasks are found to be unsatisfactory during inspections made using the checklists.
4. Quality Assurance Procedures: The Government's primary quality assurance procedures are based on random sampling of the recurring critical output products of the contract using the sampling concepts of ANSI/ASQC Z1.4 or other methods as prescribed by the Government. Other areas will be reviewed periodically (i.e., monthly, quarterly, semi-annually). Inspection and evaluation of the Contractor's performance of required services will be conducted by the Contracting Officer's Representative or other authorized representatives of the Government. The Government reserves the right to increase the number of inspections as deemed necessary by the Contracting Officer to assure that contract requirements are being met or to reduce the number of inspections when deemed appropriate by the Contracting Officer.
5. Criteria for Acceptable and Unacceptable Performance:
5.1 Criteria for requirements were derived from estimates of the level of performance experienced when the service was done by Government personnel or are the levels of performance deemed acceptable to the Government. Performance in a required service is considered satisfactory when the number of defects found by the Quality Assurance Evaluator (QAE) during the contract surveillance does not exceed the number of defects allowed by the AQL in Column 3.
5.2 When the number of defects in the Contractor's performance discovered by the QAE exceeds the AQL, the Contractor's performance is considered unsatisfactory. The Contractor shall be required to complete a contract discrepancy report (CDR). The CDR will require the Contractor to explain in writing why performance was unacceptable and how recurrence of the problem will be prevented in the future.
5.3 Determination of the Number of Defects that Renders a Service Unsatisfactory.
5.3.1 For services surveilled by random sampling, the number is determined from the ANSI/ASQC Z1.4 charts.
5.3.2 For services surveilled by other than random sampling.
5.3.2.1 If the AQL is a constant number of defects (e.g., 2 defects), the reject level equals one plus the AQL (e.g., 3 defects).
5.3.4 If the AQL is a percentage value, it is multiplied against the lot size to determine the number of defects allowed for satisfactory performance. If the resulting value has a decimal fraction, it will be rounded off to the next higher whole number if the fraction is
.5 or greater and to the lower whole number if the fraction is less than .5. One or more additional defects renders the performance unsatisfactory.
6. Reduction in Payments:
6.1 Each month Contractor performance will be compared to the contract standards and AQLs using the Quality Assurance Surveillance Plan (QASP).
6.2 If performance in any required service is unsatisfactory, and the poor performance was not directly caused by Government interference or Government failure to provide requirements, the percentage cost of the service as stated in Column 6 of the Performance Requirements Summary will be withheld from the Contractor's monthly payment as adjusted for quantities actually accepted.
7. Computation of Reductions: Monthly payment will be computed using the following methods:
7.1 For Areas Surveilled by Sampling: Assume the AQL is 10 percent, a lot size of 450 units, a resulting sample size of 50 units, and that 20 defects were found. The payment computation would be as follows:
(1) Maximum contract payment per month $40,000
(2) Maximum payment percentage for service (Column 5) x 20%
(3) Maximum payment for acceptable service $8,000
(4) 20 defects exceeds reject level of 11 defects
(5) Percentage of sample found unacceptable = 40%
(20 divided 50, or defects divided by sample size times 100)
(6) Percentage of sample found acceptable (100% minus Line 5) x 60%
(7) Payment for percentage of acceptable services (Line 3 times Line 6) $4,800
(8) Deduct for unacceptable service (Line 3 minus Line 7) $3,200
7.2 Services Not Surveilled by Sampling: Assume an AQL of 5 percent, a lot size of 50 units, and that 5 defects were found. The payment would be computed as follows:
(1) Maximum contract line payment per month $40,000
(2) Maximum payment percentage for service (Column 5) x 20%
(3) Maximum payment for acceptable service $8,000
(4) 5 Defects exceeds reject level of 3 defects
(5) Percentage of sample found unacceptable = 10%
(5% of lot size of 50 minus 2.5 defects rounded to 3)
(6) Percentage of lot found unacceptable = 10%
(7) Percentage of lot found acceptable = (100% minus Line 5) x 90%
(8) Payment for percentage of acceptable service (Line 3 times Line 6) $7,200
(9) Deduct for unacceptable service (Line 3 minus Line 7) $800
7.3 For Those Areas Surveilled Less Often Than Monthly:
7.3.1 For those services that are surveilled on a less than monthly basis, any deduction from unsatisfactory performance will be taken from the month's invoice when that service was scheduled to be completed. Since a monthly percentage of the service price will be accumulated to reflect the actual number of months that the surveillance covers (i.e., for a quarterly check, multiply the monthly percentage in Column 6 by three to determine the quarterly value. This is the amount to be used for deducting computation). It is possible for the deduction to be larger than the one-month price for the service. Because surveillance is not completed in the early months, the Contractor is paid during those months as if the service will prove satisfactory for all months. The final adjustment is done during the month surveillance is completed.
7.3.2 Example. Assume that the surveillance is semi-annual, the AQL is 5, and the lot size is
50. If 10 defects were found, the payment computation would be as follows:
(1) Monthly Contract Price $10,000
(2) Percent for exceeding the AQL (Column 5 of PRS) 4%
(3) Number of months represented by surveillance x 6
(4) Total percent of six months of service of the Contract effort against one month's invoice (Line 2 times Line 3) x 24%
(5) Total six-month period cost of service (Line 1 times Line 4) $2,400
(6) Percentage defective (10 defects divided by lot size of 50) x 20%
(7) Total deduction from that month's invoice $480
8. Other Areas of Inspection: All areas of this contract will be subject to inspection.
Required services not listed on the Performance Requirements Summary will be inspected under the Inspection of Services clause.
