T1316 Telecommunications Equipment and Services - Bid Amendment No. 9

This is Bid Amendment No. 9 issued by the State of New Jersey Department of the Treasury, Division of Purchase and Property, on December 19, 2025, for solicitation #25DPP01033 (T1316 - Telecommunications Equipment and Services). The amendment extends the quote submission deadline from January 8, 2026, to February 12, 2026, and opens a second electronic question and answer period through January 8, 2026, limited to topics related to revised bid solicitation sections and the updated state-supplied price sheet. The solicitation seeks multiple vendors to provide IP PBX systems, Unified Communications as a Service (UCaaS), Contact Center as a Service (CCaaS), and ancillary equipment including labor and maintenance services to state agencies and cooperative purchasing participants. The base contract term is four years with two optional one-year extensions. A pre-quote conference was held on February 12, 2025, with electronic questions previously due by February 26, 2025, and the original quote opening scheduled for April 4, 2025.

The amendment includes responses to 433 bidder questions addressing procurement procedures, technical specifications, security requirements, insurance obligations, pricing structures, and contract terms and conditions. Bidders must submit percentage discounts off manufacturer price lists for equipment categories and fixed hourly rates for four labor categories (Installation Technician, Trainer, Project Manager, and Technical Engineer). The State intends to award contracts to all responsive bidders, potentially resulting in multiple awards per category and per brand. Key changes in this amendment include revisions to the State-Supplied Price Sheet (Attachment 3), modifications to warranty and post-warranty maintenance sections, acceptance of quarterly pricing updates instead of annual, allowance for 48-hour breach notification instead of 24 hours, and clarifications regarding the Security Due Diligence Third-Party Information Security Questionnaire requirements for hosted services vendors. The solicitation includes comprehensive security and compliance requirements aligned with state information security standards, with vendors required to protect Personal Data, maintain service level agreements, and provide detailed technical documentation and incident response capabilities.

Section Reference Question (Bolded) and Answer

1
Quote Submission
Q: Please confirm a Bidder may deliver a hardcopy quote instead of submitting a response electronically.

A: Please be advised that all Quotes shall be submitted electronically through NJSTART.

2
Quote Submission
Q: Should I check that I have properly completed and attached all of the required documents with my submitted Quote?

A: Yes. Prior to the Quote Opening Deadline, a Bidder should review the documents comprising the submitted Quote to ensure that all of the required documents have been completed and attached. Oftentimes a Quote is deemed non-responsive because a Bidder fails to attach a required form or attaches a blank form. To review a submitted a Quote, a Bidder should log into NJSTART and review each document attached to the Quote submission. Instructions on how to review a submitted Quote can be found in the Quick Reference Guide entitled How to Review a Submitted Quote, which is available on the NJSTART Vendor Support Page under Vendor Reference Guides.

PDF Documents

A: It is recommended that users utilize Microsoft Edge to view PDFs. Certain PDF forms cannot be opened in the Chrome or Firefox built in PDF viewers that are enabled by default. If using Chrome or Firefox it is recommended that the file is downloaded instead by clicking the download button in the upper right-hand corner of the browser after an error message is received. An alternative option is to disable the built in PDF viewers in Chrome or Firefox.

4
Exceptions
Q: Will the State allow Bidders to take exception to any of the Standard Terms and Conditions?

A: As stated in Bid Solicitation Section 2.2, Exceptions to the State of NJ Standard Terms and Conditions (SSTC): “Questions regarding the State of New Jersey Standard Terms and Conditions and exceptions to mandatory requirements MUST be posed during the Electronic Question and Answer period and shall contain the Bidder’s suggested changes and the reason(s) for the suggested change(s).” Moreover, as stated in Bid Solicitation Section 3.11, Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions may render a Quote non-responsive.

5
1.1 – Purpose and Intent
Q: Does the State intend to limit the number of awarded bidders?

A: The State is intending to award a contract to all responsive Bidders.

6
1.1 – Purpose and Intent
Q: 1. Section 1.1 you mention that contracts will be awarded to Bidders based on price and other factors considered. Can you share what the other factors are?

A: 1. The Bidder should provide the information that it feels is sufficient for the Evaluation Committee to determine the Bidder’s qualifications. Bidders should refer to Bid Solicitation Section 8.9 Evaluation Criteria for specific evaluation criteria.

Q: 2. It appears that this is a blanket bid for price discounts and that individual projects/purchases will be scoped and priced reflective of the referenced price discounts. Can you please confirm?

A: 2. Yes, the State is seeking Quotes for price discounts and individual projects/purchases will be scoped and priced reflective of the referenced price discounts. Final pricing to agencies are based on actual scope in accordance with price discounts submitted on the State-Supplied Price Sheet.

A: 3. The State currently uses multiple platforms to support voice telecommunications requirements, including Centrex, Stand-alone PBX systems, an NJOIT hosted VoIP system that is built upon an Avaya infrastructure, and Microsoft Teams. Migrations involving these platforms will continue to occur, but this is not a Bid for a forklift migration or upgrade. 8
1.4 – Order of Precedence of Contractual
Q: "Respondent takes exception to the order of precedence of contracting documents and proposes the negotiated contract, including the Service Attachments submitted with Respondent's, shall govern the order of priority of documents and come first in line unless otherwise required or prohibited by applicable law. • [Bidder] Level Agreement • [Bidder] for Zoom Service Schedule • [Bidder]for Contact Center Genesys Cloud FedRAMP Service Schedule • [Bidder] for Contact Center Genesys Cloud Service Schedule • [Bidder] Contact Center Services Service Schedule • Enterprise Voice SIP Based Service Schedule • Zoom Service Level Agreement"

A: The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms. It is clearly stated in Section 1.4 of the Bid Solicitation that the New Jersey Standard Terms and Conditions (SSTCs) take precedence over any third partythird-party documents. In the event of any conflict between the terms of a document incorporated by reference, the terms and conditions of the Bid Solicitation and the SSTCs shall prevail.

9
2.1 – Electronic Question and Answer Period
Q: Will the State please allow for a Question & Answer period Round 2?

Q: Reference: T1316 – Bid Solicitation Section 2.2 Exceptions to the State of NJ Standard Terms and Conditions (SSTC) Question: Can the Bidder also pose exceptions to mandatory requirements that are in the Bid Solicitation and provide suggested changes with the reason for the changes?

A: Yes, Bidders can make suggested changes to requirements of the Bid Solicitation but only during the Question and Answer Period. Please see the answer to Question #14.

13
2.2 – Exceptions to the State of NJ Standard Terms and Conditions (SSTC)
Q: Section Reference: T1316 – Bid Solicitation Section 2.2 Exceptions to the State of NJ Standard Terms and Conditions (SSTC) Question: Request the State consider allowing Bidders to submit proposed exceptions to mandatory requirements in the form of an uploaded redline document that will include the original RFP language, suggested changes to the language, and justification for the changes, rather than in the Q&A format. Allowing vendors to upload proposed exceptions in as an attachment redline format will be beneficial for both the vendor and the State, allowing for ease of review and organization. This method will also provide a work around for uploading exceptions in multiple parts when Q&A field character limits are reached.

A: The State declines to alter or modify the Questions and Answer process and format. The State does not accept attachments and or redlined documents during the Questions and Answer process. All questions during the Question and Answer period must be submitted via the Q&A tab on the Bid Solicitation in NJSTART.

14
2.2 – Exceptions to the State of NJ Standard Terms and Conditions (SSTC)
Q: Reference: Solicitation Document (Section 3.11) Request: We would propose to add our licensing and terms of use terms and conditions as an attachment to the Contract (our General Terms). Rationale: We respectfully request this add as the contract is currently missing critical licensing and terms of use language, as well as our Security Exhibit and Data Protection Agreement (which are also available via our General Terms), applicable to the goods and services proposed under the contract.

A: As stated within Section 3.11, Bidder Additional Terms Submitted with the Quote, a Bidder may submit additional terms as part of its Quote. However, any Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions will render a Quote non-responsive. It is incumbent upon the Bidder to identify and remove its conflicting proposed terms and conditions prior to Quote submission. Quotes including Bidder proposed additional terms that do not conflict with the Standard Terms and Conditions may be accepted, rejected, or negotiated, in whole or in part, at the State’s discretion.

15
2.2 – Exceptions to the State of NJ Standard Terms and Conditions (SSTC)
Q: As vendors may require answers back from the State regarding other clarification questions to build out their strategy, can the State provide an extension beyond the Q&A deadline for vendors to provide suggested changes to the Terms and Conditions?

A: All suggested changes to the Terms and Conditions must have been submitted within the Question and Answer period. The State has opened a second round of the Question & Answer period, but only for sections of the Bid Solicitation that were changed by this Bid Amendment. Please see the cover page for the restrictions related to the second Question & Answer period.

16
2.2 – Exceptions to the State of NJ Standard Terms and Conditions (SSTC)
Q: • If a vendor has concerns regarding specific State Standard Terms and Conditions (SSTC), is negotiation possible, and if so, when should requested changes be submitted?

A: There will be no post-Quote opening negotiations or discussions regarding the Contract Terms beyond those outlined in Bid Solicitation Section 8.11 Negotiation. Pursuant to Bid Solicitation Section 3.11 Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions will render a Quote non-responsive. It is incumbent upon the Bidder to identify and remove its conflicting proposed terms and conditions prior to Quote submission. If a Bidder intends to propose terms and conditions that conflict with the State of New Jersey Standard Terms and Conditions, those Bidder proposed terms and conditions shall only be considered if submitted and agreed to pursuant to the electronic question and answer procedure.

17
2.3 – Bid Amendments
Q: Will the State consider releasing responses to procedural questions (including those related to the process of submitting proposed exceptions/modifications) that will impact how the bidder’s response is prepared, in a separate addendum to be released at the State’s earliest convenience, prior to the release of substantive and scope of work-related responses to questions?

A: All answers to the questions received during the electronic Question and Answer period are provided within this Bid Amendment.

18
2.3 – Bid Amendments
Q: • Will any clarifications or changes to the RFP be issued via NJSTART only, or will vendors be notified directly via email?

A: Pursuant to Bid Solicitation Sections 2.1 and 2.3, all answers to the Questions and Answers submitted will be through the Bid Amendment process and uploaded to NJSTART. Any clarifications or changes to the Bid Solicitation will be issued via NJSTART through the same Bid Amendment process.

19
3.7 – Joint Venture
Q: Respondent has commercial offerings that do not fully meet CONUS requirements, or IRS PUB1075, and would the State allow Respondent to bid these solutions as alternative offerings if a customer can waive CONUS requirements for a specific application?

A: Pursuant to N.J.S.A. 52:34-13.2, all Contracts primarily for services shall be performed within the United States. The State does not accept this proposed modification. Terms and conditions on publicly bid procurements must be consistent for all potential Bidders, and cannot be based on a single vendor’s terms.

20
3.11 – Bidder Additional Terms Submitted with the Quote
Q: Vendor requesting that the following sentence is removed: "Bidder proposed terms or conditions that conflict with those contained in the State of New Jersey Standard Terms and Conditions will render a Quote non-responsive." Section 1.4, "Order of Precedence of Contractual Terms" that "[in the event of any conflict between the terms of a document incorporated by reference, the terms and conditions of the Bid Solicitation and the State of New Jersey Standard Terms and Conditions shall prevail."

A: The State declines to alter or modify the Bid Solicitation Section 3.11 Bidder Additional Terms Submitted with the Quote.

21
3.13 – Forms, Registrations and Certifications to be Submitted with Quote
Q: Section states that "A Bidder is required to complete and submit the following forms." However, many of the forms listed in this section indicate that the form "should" be submitted. Moreover, Attachment 2 only has a few forms that are checked as "required." Please confirm that the only forms that are required to be submitted with the bid proposal are those checked on Attachment 2.

A: Any submission requirement designated as a “must” or “shall” within the Bid Solicitation is mandatory and must be made part of the bid submission. Failure to submit mandatory Quote submission requirements will deem the Bidder’s Quote non-responsive. Other requested information designated as a “should” will also be utilized to evaluate the Quote. Unless it is a mandatory submission requirement, the State may request that a Bidder submit a missing form after Quote Opening. The Bidder should review the requirement for Section 3.13 and submit all forms required according to the instructions.

22
3.13.6 – Service Performance within the United States
Q: While we are working diligently to provide all onshore compliant products and solutions, would the State be amenable to certain product exceptions that are not 100% onshore support? Or would the State prefer to have these listed out on the Source Disclosure form?

A: The Source Disclosure Certification (N.J.S.A. 52:34-13.2) is required for Contracts that are “primarily for the performance of services.” This is a Contract primarily for products and not services accordingly the form would not be required.

23
3.13.6 – Service Performance within the United States
Q: Please confirm that the State considers this contract a contract that is primarily for products, and as such, this section would not apply.

24
3.13.6 – Service Performance within the United States
Q: As a clarification, while Respondent’s commercial offerings from third parties like Genesys and Zoom may ensure that all data is processed and stored within the U.S, from a support perspective, the State understands that if it purchases Enterprise/Commercial SKUs which have a Global Support team, there may be instances where Genesys and Zoom information security and technical personnel located outside the U.S. may have to access customer data as necessary to troubleshoot security or technical-related issues.

A: This is not a question and cannot be answered as posed.

Question: Does the requirement to list all Subcontractors that the Bidder intends to use apply only to Subcontractors, only to resellers, Dealers/Distributors, or both?

A: The requirements of Bid Solicitation Section 3.13.8 Subcontractor Utilization Plan apply only to Subcontractors.

See Bid Solicitation Section 9.2, Definitions:

Any authorized Dealer/Distributor must agree to all terms and conditions contained within the Bid Solicitation and must agree to provide all products and services in accordance with the Contract specifications, terms, conditions and pricing." If a Bidder is intending to utilize dealers/distributors, then a Subcontractor utilization form is not required.

3.13.12 – State of New Jersey Security Due Diligence Third-Party Information Security Questionnaire
Q: The Security Questionnaire (Section IV) includes detailed controls like 14.0 ICS/SCADA/OT Security and 15.0 Internet of Things Security. Are these sections applicable to bidders offering only telecommunications hosted services (e.g., UCaaS/CCaaS), can we mark them as 'N/A' if our solution does not involve such systems? Please clarify which control areas are mandatory for telecommunications-focused proposals

A: Any section not applicable to your organization can be marked as “N/A” with a brief explanation.

32
3.13.12 – State of New Jersey Security Due Diligence Third-Party Information Security Questionnaire
Q: Section 9 of the Security Questionnaire requires details on data hosting (e.g., cloud provider, location). For UCaaS/CCaaS solutions relying on third-party cloud providers (e.g., AWS, Azure), does the State expect bidders to submit the provider’s security certifications (e.g., FedRAMP) in addition to our own, or is our attestation of compliance sufficient?"

A: The State expects Bidders to provide attestations of compliance for their own environments, not third-party cloud providers.

33
3.13.12 – State of New Jersey Security Due Diligence Third-Party Information Security Questionnaire
Q: The solicitation states that this form should be completed "only if the Bidder intends to bid on Section 4.3 of the Bid Solicitation." Section 4.3 is "Ancillary Equipment." Should this requirement be applicable to vendors bidding on Section 4.2, "Hosted Services" instead?

Q: Can the State of New Jersey confirm that the Security Questionnaire is only required to be completed by vendors proposing premise-based services/hardware for section 4.3?

36
3.14 – Technical Quote

37
3.14 – Technical Quote
Q: Can bidders submit pricing and a technical response for more than one OEM platform?

A: Section 4.1 (IP PBX) awards will only be made to OEMs, and the use of Resellers is permitted. Section 4.2 (Hosted Services) awards will only be made to Hosted Services Providers, and the use of Resellers is not permitted. Hosted Services Providers can quote up to three (3) UCaaS and CCaaS solutions. Section 4.3 (Ancillary Equipment) awards will be made to OEMs and/or Distributors. Bidders awarded Section 4.3 are not permitted to utilize Resellers. Ancillary Equipment Bidders can quote up to five (5) brands per Price Line represented on the Price Sheet.

38
3.14 – Technical Quote

Section 3.14 suggests that the Technical Quote is primarily to describe our approach to the SOW (Section 4). If not as part of the Technical Quote, please clarify where the State prefers Bidders include responses to sections 3.16 through 3.22.

A: Any requirement designated as a “must” or “shall” within the Bid Solicitation is mandatory and must be made part of the bid submission. Failure to submit mandatory Quote submission requirements will deem the Bidder’s Quote non-responsive. Bidders can submit the information in a manner deemed appropriate by the Bidder including in its Technical Quote. Quotes missing mandatory requirements may be deemed non-responsive. Not submitting requested information (“should”) may impact the technical evaluation score.

39
3.14 - Technical Quote
Q: Does the state want to see service SLA’s for this service being bid? Does have any special requirements for service SLA’s?

A: Pursuant to Bid Solicitation Section 3.14, Bidders who propose Hosted Services must include their Service Level Agreement(s) with their Quote. Bidders must remove any terms and conditions in a Service Level Agreement that conflict with the terms and conditions of this Bid Solicitation or the State Standard Terms and Conditions.

40
3.14 - Technical Quote
Q: RFP Section 3.14 states that we can offer our own SLA in regards to the hosted products and services; will the State consider that as a clarification of the Time-to-Respond and Time-to-Repair requirements for hosted services?

A: No, the State will not consider that as a clarification of the Time-to-Respond and Time-to-Repair requirements. Per Section 3.14, Bidders that quote Hosted Services must include a description of the SLAs associated with those services. Time-to-Respond and Time-to-Repair commitments should be part of those SLAs. 42
3.14 - Technical Quote
Q: 1. What are the specific penalties for non-performance or failing to meet SLA commitments?

A: 1. As per Section 5.7(B) of the State of New Jersey’s Standard Terms & Conditions, repeated performance issues could lead to termination of a Contractor’s contract.

Q: 2. Can vendors propose alternative SLA structures based on industry standards

A: 2. Yes, for Hosted Services. As per Section 3.15, Bidders who propose Hosted Services must include their SLAs associated with that/those services.

Section 4.10, Warranty, of the Bid Solicitation has been amended. This section is specific to Equipment Categories, and alternatives to those associated performance related requirements, however, will not be accepted.

Post-Warranty Maintenance requirements of the Bid Solicitation have also been amended.
