About this file

This is Bid Amendment No. 12 issued by the New Jersey Department of the Treasury, Division of Purchase and Property, for Bid Solicitation #25DPP01033 T1316 - Telecommunications Equipment and Services. The amendment revises the quote submission due date from March 26, 2026, to May 21, 2026, at 2:00 p.m. Eastern Time, and opens a third electronic Question and Answer period through April 10, 2026. The amendment addresses questions submitted by bidders regarding IP PBX systems, hosted services (Unified Communications as a Service and Contact Center as a Service), ancillary equipment, labor categories, and warranty provisions. Significant revisions have been made to multiple sections of the bid solicitation, including Section 3.23 (State-Supplied Price Sheet Instructions), Section 3.24 (Sample Invoice), Section 4 (Scope of Work), Section 4.2 (Hosted Services), Section 4.3 (Ancillary Equipment), Section 4.4 (Labor Categories), Section 4.10 (Warranty), and Section 9.3 (Contract-Specific Definitions). The state has provided 28 substantive answers to vendor questions, including clarifications on reseller participation restrictions for hosted services, labor category eligibility, hosted service provider definitions, and equipment requirements.

Key restrictions outlined in the amendment specify that Hosted Services awards will be made only to Hosted Services Providers, with resellers prohibited from bidding or being utilized for hosted services delivery. However, resellers may respond directly for Ancillary Equipment and labor services related to non-hosted categories. Original Equipment Manufacturers may designate up to three solutions each for various service categories and may add resellers under Section 4.1 IP PBX at a future date. Bidders quoting Hosted Services must also submit pricing for labor categories, and all billable labor for Hosted Services must align with applicable labor categories. The state clarified that Hosted Service Providers retain full operational responsibility for service delivery, Service Level Agreements, billing accuracy, and contract compliance, and they must deliver services through their own cloud-based infrastructure. The state declined proposed modifications to warranty requirements, including a request to remove overnight shipping obligations for replacement equipment. Bidders are responsible for understanding all additions, deletions, clarifications, and modifications contained in this and all prior bid amendments.

Section Reference Question (Bolded) and Answer

1
Section 3.13.6 – Service Performance within the United States
Q: Response to question #19 in T1316 Bid Amendment No.9 12.19.2025 states: A: Pursuant to N.J.S.A. 52:34-13.2, all Contracts primarily for services shall be performed within the United States. Response to question #22 states: A: The Source Disclosure Certification (N.J.S.A. 52:34-13.2) is required for Contracts that are “primarily for the performance of services.” This is a Contract primarily for products and not services accordingly the form would not be required. Please confirm your statement “This is a Contract primarily for products and not services.”

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

2
Section 3.14 – Technical Quote
Q: When does the State plan to evaluate the Service Level Agreement (SLA)? For example, will this occur after two months of engagement, at the midpoint of the warranty period, or at another defined milestone?

A: Service Level Agreements (SLAs) are required to be submitted with your Quote if bidding Hosted Services. Therefore, submitted SLAs will be evaluated during the evaluation of the Technical Quote.

3
Section 4.0 – Scope of Work
Q: Please help to confirm concurrent channels to be considered for Outbound Notification service

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

4
Section 4.1 – Internet Protocol Private Branch Exchange (IP PBX)
Q: Are you expecting the Vendor to provide an onsite- premise based IPPBX solution?

A: Yes. Section 4.1 IP PBX is a category that requires on-premises software and hardware solutions.

5
Section 4.2 – Hosted Services
Q: 1. From a reseller’s perspective, could you please clarify whether resellers may participate in Section 4.2 (Hosted Services or if the intent is that resellers not participate in Section 4.2 responses at all.

A: 1. Hosted Services awards will be made only to Hosted Services Providers, and the use of Resellers is not permitted. Any billable labor for Hosted Services shall be based upon the applicable Section 4.4 categories. Therefore, Resellers may not bid for or be utilized by awarded Hosted Service Providers for this section.

Q: 2. Additionally, please confirm whether resellers may participate by providing pricing for ancillary equipment, equipment installation, and UCaaS and CCaaS configuration, design, and testing services, while the Hosted Services Provider remains the primary and accountable respondent.

A: 2. Ancillary Equipment awards will be made to OEMs and Resellers. Resellers may respond directly. OEMs may not list Resellers under this category.

6
Section 4.2 – Hosted Services
Q: Please help to clarify where to include the price for offering managed services to support the solution for the contract term.

A: Bidders shall place their pricing for Hosted Services on the State-Supplied Price Sheet in corresponding yellow cells. Price Lines 1-7 are for IP PBX and Hosted Services. Bidders who bid on Price Lines 1-7 must also bid on Price Lines 20-23 of the State-Supplied Price Sheet. Price Lines 20-23 are for Labor.

7
Section 4.2 – Hosted Services
Q: Regarding the response to Question #37 in Bid Amendment No. 9, Section 4.2 (Hosted Services) specifies that awards are limited to Hosted Service Providers and that the use of resellers is prohibited. Could the State clarify if OEMs will be permitted to add partners or resellers at a later stage in the procurement process, or is it the State’s intent that all subsequent orders be placed directly with the OEM?

A: Under Section 4.1 IP PBX, OEMs may add Resellers at a future date. However, adding Resellers under this Bid Solicitation is limited to Section 4.1 IP PBX.

8
Section 4.2 – Hosted Services
Q: Our company is a solution integrator and partner with several UC and CC providers. Are we allowed to bid on hosted services under this contract?

A: Solution integrators may not bid on hosted categories if they are not a hosted provider. Hosted categories require the Bidder to deliver the service through their own cloud-based infrastructure. See definition for Hosted Service Providers in Section 9.3. Hosted providers may subcontract a solution integrator to provide enhanced services.

9
Section 4.2 – Hosted Services
Q: Clarification Question – Section 4.2 Hosted Services (Bidder vs. Procurement Model) Section 4.2 states that awards will be made only to Hosted Services Providers and that the use of Resellers is not permitted. Please confirm that this restriction applies only to bidder eligibility (i.e., the Prime Bidder of record) and does not prohibit the State or Using Agencies from procuring hosted services under the awarded contract through authorized channel partners for transactional or fulfillment purposes, provided the Hosted Services Provider remains fully responsible for service delivery, SLAs, billing accuracy, and contract compliance.

A: Hosted categories do not support the use of Resellers. Per the Hosted Service Provider definition in Section 9.3, Bidders for hosted categories must deliver the service with their own cloud-based infrastructure.

10
Section 4.2 – Hosted Services
Q: Follow-Up Clarifying Question (Only if Answer to the question above with subject “3.14; Comment 37; Comment 250 (Q12)” Is “No” Reseller Prohibition Rationale) If the response to the prior clarification confirms that Resellers are not permitted in any capacity under Section 4.2 (including acting as a procurement or transactional channel partner), please clarify the rationale for this requirement. Specifically, please confirm whether the prohibition is intended solely to ensure that the Hosted Services Provider remains the Prime Contractor with full operational, security, billing, and Service Level Agreement (SLA) accountability, or whether there are additional policy, risk, or procurement considerations driving the restriction.

A: Please see the answer to Question #9.

11
Section 4.2 – Hosted Services
Q: Follow-Up Clarifying Question – Section 4.2 (Procurement Channel vs. Service Delivery) Clarification Request – Section 4.2 Hosted Services (Procurement Channel vs. Service Responsibility) The solicitation and subsequent clarifications state that Resellers are not permitted to be used by Hosted Service Providers for any Hosted Service, including UCaaS and CCaaS. Please clarify whether this restriction is intended to prohibit Resellers from delivering, operating, managing, or being responsible for the hosted service itself, or whether Resellers may be utilized solely as a procurement or transactional channel (e.g., receiving purchase orders or facilitating ordering) for the purpose of procuring the Hosted Services Provider’s offering, provided that the Hosted Services Provider remains the Prime Contractor and retains full Service Level Agreement (SLA), security, billing, data handling, and contractual responsibility for the service.
12
13
Section 4.2.1 – Hosted Services with Labor
Q: Per the State's response to question 37, Hosted Services Providers can quote up to three (3) UCaaS and CCaaS solutions. Can you clarify if that is three solutions for each category (up to three solutions in each of Sections 4.2.1.1 and 4.2.1.2) or up to three solutions total under Section 4.2.1?

A: The Bid Solicitation supports three (3) solutions each for Sections 4.1, 4.2.1, 4.2.2, 4.2.3, 4.2.4, 4.2.5, and 4.2.6.

14
Section 4.2.1 – Hosted Services with Labor
Q: Please help to provide more clarity on the statement ‘UCaaS awards will be made only to Hosted Services Providers, and the use of resellers/distributors is not permitted ‘ and ‘CCaaS awards will be made only to Hosted Services Providers, and the use of resellers is not permitted

A: Hosted categories do not support the use of Resellers. Per the Hosted Service Provider definition in Section 9.3, Bidders for hosted categories must deliver the service with their own cloud-based infrastructure.

15
Section 4.3 – Ancillary Equipment
Q: Please help to confirm sizing specifications for ancillary equipment o For Session Border Controller Concurrent Calls Capacity Transcoding capacity o For Analog Gateway Port Count (FXS) LTE/5G Capability Handoff required

A: Using Agencies will determine their requirements for ancillary equipment.

16
Section 4.3.1- Ancillary Equipment
Q: Are you expecting either on-site premise; fully Hosted System or both?

A: Using Agencies will determine their requirements for on-premises solutions, hosted solutions, or hybrid solutions.

17
Section 4.3.2 – Ancillary Equipment with Labor
Q: Are you requiring the Vendor to provide all equipment listed for on-premises solution?

A: Yes. Any equipment sold under Contract must be quoted from a State approved pricelist.

18
Section 4.4 – Labor
Q: in relation to question #37 in the Bid Amendment No. 9 document, can the state confirm that resellers are able to provide labor for the hosted offerings listed in section 4.2 as needed? As it reads in Section 4.4, can the state confirm that resellers must bid directly on their own for these labor/service items?

A: The answer for question #37 states “Section 4.2 (Hosted Services) awards will only be made to Hosted Services Providers, and the use of Resellers is not permitted.” That means that Resellers cannot bid directly under Section 4.4 Labor Rates as it relates to hosted categories. However, Resellers may bid on Section 4.4 for Ancillary Equipment.

19
4.4 - Labor
Q: Section 4.4 states “Resellers designated by OEM’s under Section 4.1 IP PBX may use OEM’s labor rates”. Doesn’t that imply that the Resellers are providing the labor under Category 4.4 - even though the use of Resellers are not permitted under Category 4.4? If not, then under the second bullet of the Note in Section 4.1, can you provide clarifying language that Section 4.1 can include the provision of labor categories set forth in Section 4.4, and that resellers may provide that labor using the OEM’s labor rates?

A: Reseller’s designated by OEMs under Section 4.1 may utilize the labor rate pricing submitted by the OEM. All pricing quoted by the Reseller must come from the OEM approved price list, including labor rates.

20
4.4.1- Labor Categories
Q: Section 4.4 states “Labor awards will be made to OEMs, Hosted Services Providers and/or Resellers”. Did you mean to add “Resellers may respond directly” to Section 4.4, as you did in Section 4.3.2?

A: Yes, the State intended Section 4.4 Labor to allow Resellers to respond directly to the applicable other scope of work sections that may directly respond. Resellers designated by OEMs under Section 4.1 IPPBX must use OEM labor rates.

21
Section 4.5.5 – Purchasing
Q: Also in relation to question #37 in the Bid Amendment No. 9 document, can you confirm that the State’s mention of this being a Cooperative Purchasing Partner in Section 4.5.5 will mean using agencies will not be required to follow New Jersey’s procurement requirements surrounding three competitive bids?

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

22
Section 4.5.11.2 – Using Agency Error
Q: Clarification Request – Section 4.5.11.2 Using Agency Error Clarification Question – Section 4.5.11.2 Using Agency Error Section 4.5.11.2 addresses returns resulting from Using Agency error and requires Contractors to accept returns and provide full credit under specified conditions. To ensure consistent interpretation across all potential Bidders, please clarify whether this provision is intended to distinguish between: (a) No-fault errors (e.g., incorrect shipment, product misidentification, or fulfillment error by the Contractor or manufacturer), which under industry-standard commercial practice are return-eligible without restocking fees; and (b) Buyer or Using Agency ordering errors (i.e., buyer’s remorse), which under industry-standard commercial practice are not return-eligible, particularly where Using Agencies are provided no-cost pre-purchase consulting and order validation to support accurate ordering. Further, please confirm that where a return request arises from Using Agency ordering error, Contractors are not obligated to accept the return, and that any return approved by the Contractor in such circumstances may be subject to restocking fees, consistent with uniform, industry-standard practices applied equally to all customers. Finally, as the provision does not explicitly define when a Using Agency error must be identified, please clarify whether the State intends that any return eligibility be subject to a reasonable, industry-standard time period from product receipt, consistent with enterprise telecommunications procurement practices.

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

23
4.10 - Warranty
Q: Section 4.10 states “Warranty for Section 4.3.2 equipment shall be based upon a mail-back process, and replacement equipment will be sent overnight to the Using Agency by the Contractor, and the using Agency will mail back the defective equipment.” Would you agree to remove the “overnight” shipping requirement, as many vendors cannot guarantee an overnight shipment, where shipping times could vary depending upon sourcing, availability, and the timing of the return?

A: The State does not accept this proposed modification.

24
Section 5.4 – Ownership of Material
Q: Given the State's responses to Questions 226, 227 and 349, it will be necessary for a Contractor to obtain agreements from third-party suppliers accepting the State's contract terms and order of precedence. In the event that such agreements cannot be obtained prior to the submission deadline, will the State consider a Contractor's proposal that is conditioned upon such agreement by Contractor's third-party suppliers?

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

25
Section 6.6 – Privacy
Q: The State revised Section 6.6.A to exclude anonymized Telemetry and Statistical Data from State ownership. Please confirm if this exclusion also applies to Section 5.4 (Ownership of Material) and whether this exclusion from State ownership would also apply to other anonynmized data.

A: This question is outside the subject matter for the second Electronic Question and Answer period as set forth in Bid Amendment #9. Please refer back to the Answers posted in the prior Bid Amendment.

26
Section 6.6 – Privacy
Q: Section 6.6 states “Anonymized information regarding data elements, such as Telemetry and Statistical Data, collected by the Contractor for the improvement of its product for the benefit of all of the Contractor’s customers, generally, is excluded from this definition.” Would you please provide a definition for the capitalized terms “Telemetry Data” and “Statistical Data”?

A: The State will not be adding additional definitions for Telemetry Data and Statistical Data.

27
Section 9.3 – Contract-Specific Definitions
Q: Could the State please define the term "Hosted Service Provider?" We ask this question because vendors such as Microsoft, Webex, and Zoom typically do not implement or manage end-user environments directly but instead rely on System Integrators to deliver and support these services. Can this statement be modified to state Hosted Service Providers and their certified System Integrators or better define Hosted Services Provider?

A: The State has defined Hosted Service Provider in Bid Solicitation Section 9.3 Contract – Specific Definitions.

28
