General
This is a solicitation for commercial items prepared in accordance FAR Part 15. This solicitation is issued as a Request for Proposal (RFP) number SP7000-19-R-1003. The Federal Supply Class code is 3610. The Government anticipates awarding Multiple Indefinite Delivery Indefinite Quantity (IDIQ) firm fixed price contracts to the five (5) vendors that submit the Lowest Priced Technically Acceptable (LPTA) Proposals. Defense Priorities and Allocations Systems (DPAS) are not applicable to this solicitation. Network testing will be conducted prior to award. Any award resulting from this solicitation will be issued on a Standard Form (SF) 1449. Once IDIQs are awarded, the Government intends to conduct Reverse Auctions (RAs) on each individual order placed amongst the IDIQ holders. All vendors issued a multiple award IDIQ shall be able to accept option CLINs for any and all service CLINs on subsequent task orders awarded.
Requirement Description
DLA Data Production Operations seeks to enter into Multiple award Indefinite Delivery / Indefinite Quantity (IDIQ) contracts for the purchase of Small-Format color reproduction equipment and associated services. The ongoing services include: delivery, installation, maintenance, repair, consumable supplies (excluding paper), networking functionality, information technology (IT) security accreditation and technical support, training on using the equipment, meetings, reports and administration regarding the equipment. (See attachment 1 – Statement of Work (SOW) for requirement details).
Estimated Period of Performance
The IDIQ will have an up to 60 month ordering period from time of award. The estimated period of performance is June 16, 2021 – June 15, 2026 (This date may change upon testing of devices).

Will be listed on each Delivery Order (DO) / Task Order (TO)
Minimum and Maximum Ordering Amounts
The maximum program ceiling is $20,412,975.00 and the guaranteed minimum program ceiling for the entire life of this IDIQ is 10 Devices. The guaranteed minimum of 10 devices is not 10 devices per vendor but instead a total that no matter how many devices are awarded to any vendor that once the government reaches 10 devices is considered met by the government. The minimum for each delivery/task order is $10,000. Once the maximum program ceiling is met there will be no further delivery orders issued.

FAR 52.212-1 - Addendum Proposal Submission
Proposals must be submitted electronically only to the points of contacts listed above. Proposals must be submitted in English and in United States Dollars. It is the vendor’s responsibility to ensure that their electronic correspondence and/or proposal information has been received by the Government. Any proposals received after the closing date and time will be late and will not be accepted. In accordance with FAR 52.212-1(g) The Contracting Officer reserves the right to make award without discussions. All interested vendors must submit only one proposal containing pricing for award in response to this solicitation.
Period for acceptance of offers
The offeror agrees to hold the prices in its offer firm for 365 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
Network Testing
Will only be accomplished with the five (5) lowest priced technically acceptable offerors, prior to award in-accordance-with the requirements set-forth in the Statement of Work. If the offeror is unable to pass network testing then the offeror will not be considered for award. The Government will follow this process until the five (5) lowest technically acceptable offerors successfully pass network testing or the Government exhausts all technically acceptable offerors; whichever occurs first. In the event that multiple vendors submit the same make and model of equipment for testing, only one vendors equipment will need testing. If offeror A’s equipment doesn’t pass testing, offeror B’s equipment for the same make and model will then need to be submitted for testing.

Vendors shall submit a COMPLETED copy of provision 52.212-3 with their proposal in order to be considered responsive. The vendor shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site accessed through http://www.sam.gov. If the vendor has not completed the annual representations and certifications electronically, the vendor shall complete only paragraphs (c) through (r) of this provision.

Part II – Technical
Offerors shall submit one (1) original copy and one (1) redacted version. (The redacted version is used during the technical evaluation and, therefore, it should be without company logo, identifying marks, and names. Failure to provide a redacted copy may result in a non-responsive determination. The Government will validate Offeror’s redacted company information but will not make changes to the Offeror’s provided redacted proposal either to add or delete redacted text/graphics/etc.).
The offeror must demonstrate compliance with ALL the Technical Requirements set forth in the Statement of Work. Offerors must provide a signed copy of the statement of work compliance form, Attachment 4, as part of their solicitation response.
Part III – Past Performance
Offeror is required to submit information, on a single page, identifying federal, and/or state and/or local Government and/or private contracts performed within the past three years, which are similar in scope and complexity to the effort described in this solicitation. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror shall state “no past performance information available.”
Submit no more than three (3) customer references for work performed that is relevant and similar in scope to this requirement. Include reference names, telephone numbers, email addresses, and a brief description of the work performed. Any submission(s) in excess of this stated limit will be excluded by the Government. The Government will choose the excluded contract(s) at random, or in any manner that the Government, in their absolute discretion, deems appropriate, without any consideration for the best interests of the Offeror. If subcontractor contracts are submitted, the Offeror must also clearly indicate the percentage of work that the subcontractor(s) performed under each task/category of effort throughout the course of the contract.

Part IV – Pricing (See attachment 3 CLIN structure to input offeror unit prices)
Offerors are required to submit a price proposal for the total five (5) year ordering period addressing all pricing involved in the execution of the technical requirements set forth in the solicitation.
Proposed prices shall be entered on a spreadsheet file (unlocked) readable in Microsoft Office Excel format. Please include a copy of the SF1449 – CONTINUATION SHEET with the Contract Line Item (CLIN) Unit Prices and, for evaluation purposes, the Total Prices filled in (Supplies and/or Services and Prices and/or Costs). The offeror must submit a single unit price for each CLIN listed in
Solicitation # SP7000-19-R-1003 Page 7 of 42 attachment 1, CLIN structure, in the space provided for the unit price. In addition, the offeror must provide a total for each CLIN (Total Formula = Estimated Quantity for Evaluation Purposes Units X Unit Price).
All price and price supporting information shall be contained in Part IV and the price/cost proposal.
No price or pricing information shall be included in any other technical Part including cover letters.
The Offeror is responsible for submitting sufficient information to enable the Government to fully evaluate their price/cost proposal.
Part V - Offeror Representations and Certifications with proposal (FAR 52.212-3).
This part shall contain all information regarding Offeror’s Representations and Certifications or a validation that System for Award Management (SAM) registration information is up to date and includes all the necessary representations and certifications. Only one (1) original copy shall be submitted for Part V. This information will be used in the responsibility determination required by FAR 9.103(a).
Proposal Format.
Offerors shall prepare and submit their proposals as set forth in Table 1. The titles and contents of the sections are defined in Table 1 of this document and with the number of copies specified in the table.
An electronic copy of all documents (technical, past performance information list and price) shall be submitted. Proposals shall be prepared using “Arial” or “Times New Roman” 11-point font style on 8½ x 11 inch. Tables and illustrations may use a reduced font style, not less than 8 points. Margins shall be one (1) inch on all sides. All material submitted may be single-spaced. Offerors should ensure that each page provides identification of the submitting Offeror in the header or footer.

Evaluation Criteria
The evaluation method that will be utilized is Lowest Priced Technically Acceptable (LPTA) in accordance with FAR 15.101-2. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. The Government intends to evaluate and make awards without discussions unless discussions are determined to be necessary. The evaluation criteria are as follows: Price, Technical Capability, and Past Performance.

The offerors proposals will be evaluated for the IDIQ period in its entirety. When “the SOW” is referenced in the factors below, it refers to the IDIQ in its entirety unless stated otherwise.
1. TECHNICAL
Technical Approach
Technical Approach Instruction to Offerors:
Five (5) IDIQ contracts will be issued to the offerors that have the Lowest Priced Technically Acceptable proposals, subject to network testing and approval. The offerors must demonstrate compliance with all the technical requirements set forth in the SOW.
Technical Approach Evaluation of Offers:
The Government will evaluate the offeror’s ability to meet all technical requirements for proposed Small- Format color reproduction equipment and associated services required. The Government will evaluate the offeror’s proposed Small-Format color reproduction equipment and associated services for meeting all specific technical requirements in-accordance-with the SOW.
2. PAST PERFORMANCE
Past Performance Instruction to Offerors:
Offeror is required to submit information, on a single page, identifying federal, and/or state and/or local Government and/or private contracts performed within the past three years, which are similar in scope and complexity to the effort described in this solicitation. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror shall state none. The offeror shall submit no more than three (3) customer references for work performed that is relevant and similar in scope to this requirement. Include reference names, telephone numbers, email addresses, and a brief description of the work performed.
Past Performance Evaluation Criteria
Past performance shall be used as an evaluation factor within the LPTA process, unless waived by the Procurement Contracting Officer, in accordance with FAR 15.101-2(b). Past performance shall be evaluated in accordance with FAR 15.305 and DFARS 215.305. However, the comparative assessment in FAR 15.305(a)(2)(i) does not apply. Therefore, past performance will be rated on an “acceptable” or “unacceptable” basis using the ratings below. Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. Unacceptable: Based on the offeror’s performance
Solicitation # SP7000-19-R-1003 Page 9 of 42 record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort. Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
3. PRICING
Offerors are required to submit a price proposal addressing all pricing involved in the execution of the technical requirements detailed in-accordance-with requirements set forth in the solicitation. The pricing shall be submitted by the vendors on Attachment 3-CLIN structure. There is no page limit for the price proposal.
Offerors are required to submit a price proposal for the total five (5) year ordering period of the contract.
Price Proposal Evaluation of Offerors:
The price proposals will be evaluated for total price proposed from each offeror. The Pricing Team plans to determine pricing fair and reasonable based on competition in accordance with FAR 15.404-1(b)(2)(i).
In addition to competition, in order to ensure a fair and reasonable price, the Pricing Team may use other available price analysis techniques in accordance with FAR 15.404-1(b)(2), such as:
-Comparison of proposed prices to historical prices paid.
-Comparison of proposed prices with Independent Government Cost Estimates -Comparison of proposed prices with prices obtained from market research for the same or similar items
RATINGS
Factor 1 - TECHNICAL:
Acceptable: Proposal meets the requirements of the solicitation.
Unacceptable: Proposal does not meet the requirements of the solicitation.
Factor 2 – PAST PERFORMANCE:
Acceptable: Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable: Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
FAR 52.212-2 EVALUATION COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Price, Technical Capability, and Past Performance Technical and past performance, when combined, will not be weighted. The LPTA source selection process will be utilized.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN
TELECOMMUNICATIONS AND VIDEO SURVEILLANCE SERVICES OR
EQUIPMENT (AUG 2019)
(a) Definitions. As used in this clause—
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means-
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications https://www.acq.osd.mil/dpap/dars/dfars/html/current/252239.htm#252.239-7016
Solicitation # SP7000-19-R-1003 Page 13 of 42 equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment; or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.
Critical technology means-
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled—
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies
Solicitation # SP7000-19-R-1003 Page 14 of 42 or the covered telecommunication equipment or services are covered by a waiver described in Federal Acquisition Regulation 4.2104.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1)of this clause:
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known);
supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description;
and any readily available information about mitigation actions undertaken or recommended.
(ii) Within 10 business days of submitting the information in paragraph (d)(2)(i)of this clause: any further available information about mitigation actions undertaken or recommended. In addition, the Contractor shall describe the efforts it undertook to prevent use or submission of covered telecommunications equipment or services,and any additional efforts that will be incorporated to prevent future use or submission of covered telecommunications equipment or services.
(e) Subcontracts. The Contractor shall insert the substance substance of this clause, including this paragraph (e), in all subcontracts and other contractual instruments, including subcontracts for the acquisition of commercial items.
