About this file
This is a Non-Disclosure Statement and Offeror Consent form for solicitation SP0604-26-R-0409, issued by the Defense Logistics Agency Energy for the Department of War's nationwide coal-based Power Purchase Agreement initiative implementing Executive Order 14386. The document establishes a confidentiality agreement between an offeror and a nongovernment advisor's company that may have access to sensitive procurement information during the proposal evaluation process.
The form requires the nongovernment advisor's employer to agree not to disclose any procurement-sensitive information, confidential financial data, trade secrets, technical reports, offeror identities, proposal information, or evaluation procedures to individuals outside the designated Source Selection Team without prior written approval from the Contracting Officer. The nongovernment advisor's company acknowledges that these confidentiality obligations persist regardless of contract award and that violation may result in employment termination or contract termination. By signing, the offeror provides explicit consent for DLA Energy to share its proprietary information with the specified nongovernment advisor's company solely for the purpose of evaluating the proposal. The document is a template requiring offerors to complete company name fields and obtain signatures from both the offeror and nongovernment advisor representatives with their printed names, titles, company names, and dates.
