Eielson AFB Micro-Reactor - Request for Information – Group 5
1. Can DLA confirm that indemnity will be granted from the Department of Energy on this project once the design receives NRC licensing?
a. DOE will not be providing indemnity for the microreactor at Eielson Air Force Base.. As an NRC-licensed reactor, nuclear hazards indemnification will be covered under the NRC system as defined in AEA 170c and related regulations. DOE will not be indemnifying the reactor pursuant to its AEA 170d authority. Further indemnification questions should be addressed to the NRC.
2. Post NOITA and prior to award, the NRC must complete both the NEPA and licensing processes. This requires large costs, over a lengthy period of time to be spent by the contractor prior to award without a contract. Compensation for these costs can be achieved after award. What happens if, for whatever reason (e.g., congressional budgets), this contract is not awarded? What recourse does the contractor have to be compensated for costs performed in support of the Government?
a. Any costs incurred by the offeror prior to contract award will not be compensated by the Government.
