COCO Storage Services, Port of Salalah, Oman Solicitation SP0600-12-R-0518
1. This amendment is hereby issued to respond to Offerors questions resulting from discussions with
DLA Energy (DLAE). Offerors questions and DLA Energy (DLAE) responses are as follows:
A. QUESTIONS ON NEGOTIATION ISSUES:
1. In the letter dated 28 November 2012 that the Offeror received from DLAE advising us of the opening of negotiations, DLAE indicated that the Offeror’s offer was high based on market research. The Offeror kindly askes DLAE to share such market research its understanding.
DLA Energy’s Response: The Government Objective Excess Throughput price is $0.30 per barrel.
In accordance with FAR 15.404-1(b) (2) (vi) the Government may use various price analysis techniques and procedures to ensure a fair and reasonable price. DLA Energy used a comparison of proposed prices with prices obtained from negotiated or existing Contractor Operated Contractor Owned (COCO) contract prices worldwide, and previous competitively awarded contracts on the basis of fair and reasonableness to derive this price.
2. The Offeror would also like to receive a confirmation from Salalah Port Authorities that any material that will be imported into Oman for the construction of the terminal under the present solicitation will be free of any customs taxes and duties.
DLA Energy's Response: DLA Energy requested a response to this question from the Salalah Port Authorities. The Salalah Port Authorities said there is no duty on goods being imported into Oman for use inside the port as it never enters into Oman. The Port also said to remind all contractors that they must independently contact the Omani Department of Finance as well as the Royal Omani Police (Customs Directorate), to assure themselves of the latest rulings and notices in this regarding duty on goods being imported into Oman for use inside the port. The SPS will provide assistance with documentation to enable claims but will not be responsible for settling claims etc with the ROP (Customs).
B. QUESTIONS ON NEGOTIATION ISSUES SECTION B TECHNICAL EVALUATION SUMMARY:
3. Please clarify what the pumping pressure will be on product discharges? The Offeror requires this information as the terminal location is 45 meters above the jetty level.
DLA Energy's Response: DLA Energy vessels will maintain minimum 100 psi at rail.
4. Please clarify what the cargo size will be?
DLA Energy's Response: 310,000 bbls
2. This amendment is also hereby issued to notify Offerors that the Salalah Port Services, in an e-mail correspondence to DLA Energy dated 15 January 2013, has acknowledged forwarding the following information to Offerors:
COCO Storage Services, Port of Salalah, Oman Solicitation SP0600-12-R-0518
