About this file

This is a solicitation for weed control services for undeveloped Reclamation lands within the Snake River Area Office (SRAO). The Bureau of Reclamation, Pacific Northwest Region, located in Grand Coulee, Washington, seeks a contractor to provide herbicide application services across approximately 106,791 acres of undeveloped lands, with 31,431 acres identified annually for treatment across 27 scattered areas in southern Idaho, eastern Oregon, and western Wyoming. The contract is set aside for Women-Owned Small Businesses (WOSB) with a NAICS code of 561730 and a size standard of $9.5 million. The solicitation number is 140R1726Q0025, with an offer due date of June 12, 2026 at 1200 Pacific time and a delivery date of June 30, 2027. The contract structure includes one base year (July 1, 2026 to June 30, 2027) plus four one-year option periods, with a total contract period extending through June 30, 2031. Payment will be made through the Invoice Processing Platform (IPP), and invoices should be submitted every two weeks.

The Performance Work Statement requires contractors to safely apply post-emergent herbicides to noxious weeds at optimal times, submit a detailed annual work plan within seven working days of award for COR approval, provide daily application logs by treatment area, maintain GPS documentation and geo-tagged photographs of all treatment areas, and submit comprehensive annual reports by November 15 each year. Contractors must possess applicable federal, state, and local permits and licenses, including professional applicator certifications. The acceptable quality level for Task 2 (herbicide application) requires colonies to be eliminated with individual plants acceptable, and all tasks must be performed within specified tolerances 98 percent of the time excluding circumstances beyond the contractor's control. Evaluation factors are primarily technical experience and past performance (significantly more important than price), and contractors must demonstrate direct experience applying herbicides in areas exceeding 300 acres within riparian zones and sensitive areas. Additional requirements include compliance with Reclamation Safety and Health Standards, Environmental Compliance Documentation (Endangered Species Act, NEPA, Clean Water Act), and use of spray marker dye and approved adjuvants to ensure complete coverage.

C.1 Introduction Federal legislation including the Federal Insecticide, Fungicide, and Rodenticide Act of 1947

(as amended); the Carson-Foley Act of 1968; the Federal Noxious Weed Act of 1974 (as amended), and the Plant Protection Act of 2000, authorize and direct Reclamation to implement weed management as well as to coordinate with Federal, State and local agencies on the management of noxious weeds and invasive plants. Reclamation uses an integrated pest management approach to control noxious weeds and invasive plants, which include multiple methods such as chemical, mechanical, and biological control on all undeveloped lands with the

Snake River Area Office (SRAO). Currently, Reclamation has neither the personnel nor the equipment to successfully conduct noxious weed and invasive plant treatments for its undeveloped lands.

C.2 Mission

Weed control is required to prevent and reduce the economic, environmental and social impacts of noxious weeds. Protect project habitat and provide public safety through weed management treatments. The goal is to suppress the expansion and if possible, eliminate noxious weeds.

C.3 Scope

The contractor shall provide all personnel, equipment (including personal protective equipment), tools, materials, transportation, supervision, and other items and incidental services necessary to satisfactorily identify and spot treat invasive weed species on

Reclamation undeveloped lands. There are approximately 106,791 acres of undeveloped lands within the Snake River Area Office. Out of these lands 31,431 acres have been identified for treatment each year.

These areas were identified as having the highest probability of requiring treatment or are located near high‑value crops or human‑use areas. Not all potential acreage will require spraying; only specific locations within these areas will be treated as weed colonies are identified.

Lands are scattered across 27 areas in southern Idaho, eastern Oregon, and western

Wyoming (see C.17 - maps), spraying will vary according to problem areas and annual infestation of noxious weeds. Access into many of the treatment areas can be difficult.

Many of the areas are inaccessible through Reclamation rights-of-way, requiring the contractor to obtain permission to access through private lands.

C.4 Non-Personal Services

The Government shall neither supervise contractor employees nor control the method by which the contractor performs the required tasks. Under no circumstances shall the Government assign tasks to, or prepare work schedules for, individual contractor employees. It shall be the responsibility of the contractor to manage its employees and to guard against any actions that are of the nature of personal services or give the perception of personal services. If the contractor believes that any actions constitute, or are perceived to constitute personal services, it shall be the contractor's responsibility to notify the Contracting Officer (CO) immediately.

C.5 Business Relations

The contractor shall successfully integrate and coordinate all activity needed to execute the requirement. The contractor shall manage the timeliness, completeness, and quality of problem identification. The contractor shall provide corrective action plans, proposal submittals, timely identification of issues, and effective management of subcontractors. The contractor shall seek to ensure customer satisfaction and professional and ethical behavior of all contractor personnel.

C.6 Contract Management and Administration

The following subsections specify requirements for contract, management, and personnel administration.

C.6.1 Contract Management

The contractor shall establish clear organizational lines of authority and responsibility to ensure effective management of the resources assigned to the requirement. The contractor must maintain continuity between their support operations.

C.6.2 Contract Administration

The contractor shall establish processes and assign appropriate resources to effectively administer the requirement. The contractor shall respond to Government requests for contractual actions in a timely fashion. The contractor shall have a single point of contact between the

Government and Contractor personnel assigned to support contracts. The contractor shall assign work effort and maintaining proper and accurate time keeping records of personnel assigned to work on this requirement.

C.7 Personnel Administration

The contractor shall provide the following management and support as required. The contractor shall maintain the currency of their employees by providing initial and refresher training as required to meet the PWS requirements. The contractor shall make necessary travel arrangements for employees. The contractor shall provide necessary infrastructure to support contract tasks.

C.8 Contractor Qualifications, Personnel, Disciplines, and Specialties

The following clauses are in full text:

52.219-14 LIMITATIONS ON SUBCONTRACTING (SEP 2021) (DEVIATION)

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and

(2) Is considered small for the size standard under the North American Industry Classification System (NAICS) code the prime contractor assigned to the subcontract.

(c) Applicability. This clause applies only to—

(1) Contracts that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(2) Part or parts of a multiple-award contract that have been set aside for any of the small business concerns identified in 19.000(a)(3);

(3) Contracts that have been awarded on a sole-source basis in accordance with subparts 19.8, 19.13, 19.14, and 19.15;

(4) Orders expected to exceed the simplified acquisition threshold and that are—

(i) Set aside for small business concerns under multiple-award contracts, as described in 8.405-5 and 16.505(b)(2)(i)(F); or

(ii) Issued directly to small business concerns under multiple-award contracts as described in 19.504(c)(1)(ii);

(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.

(d) Independent contractors. An independent contractor shall be considered a subcontractor.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees to the following requirements in the performance of a contract assigned a North American Industry Classification System (NAICS) code applicable to this contract:

It will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding certain other direct costs and certain work performed outside the United States (see paragraph (e)(1)(i)), to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

(i) The following services may be excluded from the 50 percent limitation:

(A) Other direct costs, to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract.

(3) General construction. It will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 85 percent subcontract amount that cannot be exceeded.
