About this file
This is an environmental permit exemption determination letter from the St. Johns River Water Management District (SJRWMD) to Flagler County regarding County Road 205 Phase 2 widening and resurfacing improvements. The project involves construction of roadway shoulders and resurfacing of County Road 205 for roadway safety improvements, along with replacement of culverts under the roadway. Flagler County submitted its exemption verification application on June 9, 2025, with construction plans received on July 7, 2025, and the determination fee received on August 18, 2025. The SJRWMD issued its determination on August 21, 2025, authorizing a concurrent general permit (GEN-035-145469-2) for the culvert replacement work.
The SJRWMD determined that an Environmental Resource Permit is not required for the project, as it meets exemption requirements under Florida Administrative Code sections 62-330.051(4)(c) and (d). The exemption determination is specific to SJRWMD jurisdiction and does not relieve Flagler County from permitting requirements of other agencies. The determination letter references PDEX number 145469-3 for all correspondence and provides contact information for SJRWMD staff members Amy Maxwell and Tori Catalo for questions regarding the permit determination. The letter was sent to Hamid Tabassian, Flagler County's representative, and was copied to the regulatory file and project consultant John A. Dillard of Zev Cohen & Associates.

PDEX: 145469-3
(Please reference the PDEX number on all correspondence.)
Dear Mr. Tabassian:
On June 9, 2025, the St. Johns River Water Management District received your application requesting an exemption verification for the above referenced project. The District received the construction plans and the determination fee on July 7, 2025, and August 18, 2025, respectively. Based on this submittal, the proposed project involves the construction of roadway shoulders and the resurfacing of County Road 205 for roadway safety improvements. General permit GEN-035-145469-2 is being authorized concurrently for the replacement of culverts under County Road 205.
Pursuant to 62-330.051(4)(c) and (d), Florida Administrative Code (F.A.C.), an Environmental Resource Permit is not required since the project meets the exemption requirements. Please be advised that this determination only applies to the District and does not relieve you from the permitting requirements of other agencies.
Thank you for your cooperation with the permitting and compliance process. If you have any questions, please contact the District through Amy Maxwell, at (386) 329-4273 or AMaxwell@sjrwmd.com, and Tori Catalo, at (386) 643-1126 or TCCatalo@sjrwmd.com.
Sincerely, Tanya M. Alvarez Supervising Regulatory Scientist Division of Regulatory Services
