About this file
This is a Department of the Army permit issued by the U.S. Army Corps of Engineers Jacksonville District on October 15, 2025, authorizing safety improvements to County Road 205 in Flagler County, Florida. The permit, issued to Richard Zion, Assistant County Engineer for Flagler County, authorizes roadway resurfacing, the addition of emergency safety shoulders, and the extension of existing culverts and crossing approaches to accommodate roadway widening. The project is located in Sections 11, 02, and 35, Township 12 South, Range 29 East, in Bunnell, Flagler County. The authorized work is governed under Nationwide Permit 14 (Linear Transportation Projects) pursuant to Section 404 of the Clean Water Act. The permit verification is valid until March 14, 2026, and compliance with all Nationwide Permit General Conditions, Jacksonville District Regional Conditions, and project-specific special conditions is required.
The project will result in minimal environmental impacts, with less than 0.1 acre of jurisdictional wetland impacts (0.04 acres) and impacts limited to maintained right-of-way areas, non-jurisdictional swales vegetated with Bahia grass lacking hydric soils, and non-jurisdictional conveyance ditches. Key conditions include installation of erosion control measures prior to work initiation, use of clean fill material only, maintenance of permit documentation at the construction site, and completion of a self-certification form (ENG Form 6285) within 60 days of work completion. The permittee must comply with all cultural resources protection requirements, including immediate notification and work stoppage if archaeological materials are encountered, and must coordinate with the Florida Fish and Wildlife Conservation Commission regarding state-listed fish and wildlife species. The permit does not authorize the take of state-listed species and does not preclude the necessity of obtaining other federal, state, or local permits that may be required.

Regulatory Division North Permits Branch Jacksonville Section

Richard Zion, Assistant County Engineer Flagler County 1769 East Moody Boulevard Bunnell, Florida 32110 Sent via email: rzion@flaglercounty.gov
Dear Mr. Zion:
The U.S. Army Corps of Engineers (Corps) has completed the review of your application for a Department of the Army permit received on September 30, 2025. Your application was assigned file number SAJ-2015-03397. A review of the information and drawings provided indicates the proposed project will result in the safety improvements to the existing County Road 205. The improvements include resurfacing, the addition of emergency safety shoulders, and the extension of existing culverts and crossing approaches to accommodate widening of the roadway. The proposed activity will result in less than 1/10-acre of jurisdictional wetland (0.04 acres) impacts. The project proposes minimal impacts to maintained right of way, non-jurisdictional swales vegetated with Bahia grass (Paspalum notatum) and lacking hydric soils. The project proposes minimal impacts to non-jurisdictional conveyance ditches perpendicular to the roadway. Culvert crossings occur at each of these conveyance features. The activities subject to this permit are authorized pursuant to authorities under Section 404 of the Clean Water Act (33 U.S.C. § 1344). The project is located at County Road 205, Right of Way (ROW), in Section 11, 02, and 35, Township 12 South, Range 29 East, Bunnell, Flagler County, Florida.
Your project, as depicted on the enclosed drawings, is authorized by Nationwide
Permit (NWP) 14 (Linear Transportation Projects). This verification is valid until March 14, 2026. In order for this NWP authorization to be valid, you must ensure that the work is performed in accordance with the Nationwide Permit General Conditions, the Jacksonville District Regional Conditions, and the General and Project-Specific Special Conditions listed below. Furthermore, if you commence or are under contract to commence this activity before the date that the relevant NWP is modified or revoked, you will have 12 months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP. You can mailto:rzion@flaglercounty.gov
