About this file
This is a Warranty Bond Form template for the City of Bunnell and Flagler County Board of County Commissioners related to the County Road 205 Phase 2 Widening and Resurfacing project. The form establishes a surety bond requirement to guarantee contractor performance and warranty obligations for the completed roadway improvement project between State Road 100 and a private dirt road. The bond is conditioned to protect the Owner against defects in workmanship and materials for a one-year period following project approval and acceptance. The Principal contractor must furnish a surety bond that remains in effect for one year after the project completion date and covers any defective materials or workmanship discovered during that warranty period. The bond obligates the contractor to perform all warranty work, make payments to subcontractors and material suppliers, and cover all costs associated with remedying defects that become apparent within the one-year warranty period.
The bond amount is to be determined based on the contract value, with the surety authorized to conduct surety business in Florida. The form specifies that any changes to contract documents do not affect the surety's obligation under the bond. The exclusive jurisdiction and venue for resolving disputes relating to the warranty bond shall be the Circuit Court of Flagler County, Florida. All parties—the Principal, Surety, and Owner—execute the bond with witness signatures and the Surety's authorized agent signature. This warranty bond ensures financial accountability and protection for the public owner throughout the one-year defect liability period following substantial completion and acceptance of the County Road 205 Phase 2 project.
