STATEMENT OF WORK
FOR
Multiple Award Construction Contract
PART 1 INTRODUCTION
It is the intent of this Scope of Work to provide the requirements for the NIST Multiple Award Construction Contact (MACC). This SOW is to define the type of work that may be required by the task orders issued under the MACC.
The DOC site campus is located at 325 Broadway in Boulder, Colorado. The requirements, as presented in this document, along with any attachments, are intended to describe the minimum Government requirements.
See the General Instructions for Construction/Maintenance Activities for conducting work included in the contract for information on rules and requirements of performing work on the National Institute of Standards and Technology (NIST) sites in Boulder and Ft. Collins, Colorado.
PART 2 BACKGROUND
The Office of Facilities and Property Management (OFPM) manages and provides services to the Department of Commerce (DOC) staff in support of their research, technical, and administrative programs. DOC agencies serviced by OFPM Division include, but are not limited to The National Telecommunications and Information Administration (NTIA) and NIST.
The facilities consist of scientific research facilities and radio transmission sites. The facilities are made up of approximately 30 different buildings (approx. 650,000 sq ft.), which consist of scientific research labs and clean rooms, warehouses, machine shops, maintenance shops, a central utility plant, administrative offices, and conference/auditorium spaces. The age of the facilities range from late 1950’s to present day technology and construction. These sites are located in Boulder and Fort Collins, Colorado. The majority of the work is expected to be at the NIST facility in Boulder, CO with minimal expected to be in the Ft. Collins, CO.
It is anticipated that multiple Task Order Requests for Proposals (TO-RFP) will be issued for pricing and negotiations to all MACC contractors each fiscal year. TO-RFPs will be competed among all qualifying contractors who hold a MACC contract. Resulting TOs will be firm-fixed-price. Upon receipt of a TO-RFP, contractors will be given a set amount of time, dependent upon the complexity of the project, to provide completed proposals.
Task orders will be construction in nature involving, for example, demolition; site work; concrete; electrical; mechanical; roofing; fire protection and hazardous materials removal, including asbestos and environmental projects. Work will be performed in a scientific and research environment where the facility must remain operational at all times.
PART 3 TASK ORDERS
The Contractor shall furnish all management, supervision, labor, materials, equipment, and incidentals required for a broad range of maintenance, repair, and construction work on various real property facilities at installations covered under this contract, to include design and engineering services incidental to construction. Individual TO projects will vary in size, from $2,000 to $1,250,000. As projects are identified, they will be competed among the MACC contractors. The total maximum quantity to be ordered is $9,999,000 for the length of the contract, not to exceed five years. The maximum quantity is calculated as the sum of all orders issued, including modifications, to all the MACC contractors.
Task orders may involve trades such as carpentry, plumbing, electrical, mechanical, painting, pipe fitting, sheet metal, welding, roofing, site work, site utilities, excavation, concrete, masonry, pavement repair, asbestos and lead paint removal, security hardware installation, and demolition.
Task orders may include, but are not limited to, construction/renovation of scientific research laboratory facilities and/or administrative facilities (offices, operation centers, and warehouses); utilities; electrical systems; water systems; sewage systems; ADA compliance requirements; safety systems such as fall protection devices/guardrails; solar/energy conservation systems; roofs; communications; security systems; radio transmission towers; HVAC systems; roads; fences; and gates. (More detail is provided below.)
Activities may consist of but are not limited to:
1. Construction services including site renovations and renovations of existing labs and offices up to and including the complete strip out of selected areas and the reconstruction of new labs and offices in facilities built as long ago as the early 1950’s.
2. Structural demolition and construction including foundations, concrete, steel and other materials used in the construction trades.
3. Mechanical demolition and construction including energy conservation, heating and ventilation, air conditioning, plumbing, fire protection, alarms, sprinkler systems, special mechanical systems and process systems. May include the repair, replacement, and or upgrading of mechanical systems or equipment including controls.
4. Electrical construction including power service and distribution, lighting, telephones, fire detection and alarms, security systems, electronic communications, special electrical systems, energy conservation, code analysis, and general space requirements. May include the repair, replacement, and or upgrading of electrical systems or equipment.
5. General excavation including utility systems, water systems, fire protection systems, drainage systems, roads, earthwork and paving, grading, native landscaping, irrigation, landscape, and walkways/bike paths.
6. Disassembling, reassembling and moving of laboratory/office equipment/furniture from one area to a new location and or storage during the activities described in the SOW.
Each TO will have a specific Statement of Work (SOW) and, depending on the complexity of the job, may include drawings and specifications that are project and site/location specific. They may consist of, but not be limited to, upgrading facilities or equipment, replacing, repairing, or some combination of the three.
Task orders will be primarily multiple-craft involving the installation of new equipment, and/or the removal of old or outdated equipment and may involve the repair or modernization of existing equipment within laboratories and surrounding spaces attached to laboratories and offices. In addition, some TOs may involve the complete demolition of an existing space and the build-back of a completely new lab, office, or common space with new materials from the floor to ceiling including lights, air handling and temperature control systems, along with any specialized connections to support the lab function such as chilled water, low/high pressure air, special electrical requirements, fume hoods, and exhaust fans, etc. TOs may also include the moving and installation of new scientific equipment and/or the removal of equipment from one area of the site, then moving and installing it at a new, designated location. This will require involvement of contractor personal with the COR, scientific staff, and possibly the manufacturer of equipment.
All tasks will be performed in and around occupied areas performing scientific/research experiments where vibration, noise, outages of utilities and/or disturbances to the physical environment will hinder the ability of the Government to perform required activities. ALL activities must be planned, scheduled and coordinated with the COR in order to be posted for a minimum of two weeks prior to the activity beginning. Flexibility may be required for certain activities and may have to be performed out of normal business hours, such as concrete sawing, hammer drilling, utility shutdown and/or other activities which may cause disturbances and interrupt normal activities.
The contractor shall submit Performance and Payment Bonds for awarded TOs only. The Contractor shall ensure the MACC number and the TO number are included on each Performance and Payment Bond.
Liquidated damages may be applicable depending on the scope and size of the task order.
The Government will assign a specific Contracting Officer’s Representative (COR) for the base MACC contract and a COR for each task order.
PART 4 TASK ORDER PROPOSAL
1. Request for Proposal
a. When the Government requires work under the MACC, a TO-RFP will be issued to the MACC contractors. The TO-RFP will include an electronic copy of the Statement of Work (SOW), and if applicable, an electronic set of drawings and specifications. The level of the design provided to the Contractor shall be anywhere from a basic concept to a complete design package. The Contractor may reproduce the drawings and specifications at the Contractor’s own expense. The Contractor shall check all drawings and specifications immediately upon receipt for discrepancies and notify the CO immediately of any/all discrepancies found. Enlarged plans and details shall govern where the same work is shown at smaller scales. The Contractor shall compare all drawings and verify the installation before proceeding with work and shall be responsible for any errors which might have been avoided thereby.
2. Site Visit
a. Depending on the complexity of the project, the Government may conduct a pre-proposal site visit for the TO. Site Visits are not mandatory, nor will the Government reimburse any expense the contractor incurs in proposal preparation. Site visit discussions may include clarification of: scope of work, method of construction, sequence of operations, progress schedule, means of access to project site, delivery and storage of materials and equipment, work restrictions, coordination requirements, project goals, liquidated damages, and potential difficulties/problems. The Contractor shall email site visit questions to the Contracting Officer within two (2) workdays following the site visit. The Contracting Officer, or designated representative, will provide responses to all Contractors within four (4) workdays of the site visit.
3. On-Site Conditions
a. Drawings may not be available or provided. Drawings showing the location of equipment, piping, ducts and conduit, etc. are diagrammatic and may not show every detail required. In addition, site conditions will not always permit installation in the locations shown. Drawings showing equipment, piping, ducts, conduit, etc., to be removed, altered, or installed may require deviation from the configuration of the demolition or installation drawings due to existence of conflicting ducts, conduits, hangers, light fixtures, structural items, and temporary walls, etc. All such minor details of work which are not shown on the drawings, as well as such items not specifically mentioned in the specifications, but which are essential and necessary for the completion of the work, and to make all systems or equipment operational, shall be considered as incidental and shall be included as part of the work. When this situation occurs, the final placement of permanently installed items shall be subject to approval by the applicable CO. The Contractor shall be responsible for inspecting to his satisfaction all areas/items of possible conflict. Failure to verify the dimensions and locations will be at the Contractor's risk and shall not relieve the Contractor from accomplishing the work required by the TO.
4. Project Proposal
a. The intent is to award TOs based on price and without discussions. However, depending on the complexity of the work associated with a new TO, the TO-RFP may be awarded to the contractor offering the best value, considering both price and non-price factors. The Government reserves the right to accept other than the lowest price offer. The TO-RFP will describe whether price is less important, more important, or equal in importance to non-price factors. When soliciting as best value, the TO-RFP may require submission of a written proposal describing the approach to the proposed project work described in the Government’s SOW and project drawings, if any. The Contractor’s proposal may be required to include; a written narrative describing their approach to the subject project, drawings to show the intended work, a schedule showing the Contractor’s intended progression, and any permits required.
b. The Contractor shall submit the proposal within the timeframe required by the TO-RFP, typically 5 to 15 days from the date of the TO-RFP. All proposals shall include, at a minimum, a cover page, the firm-fixed price, design assumptions, performance period, any special considerations such as request for winter exclusion, phasing of construction, operational concerns, etc. The Contractor’s proposals shall be complete and concise. Contractors are not required to submit a proposal for each task order. The contractor must give written notification to the CO of the intent to decline competing for TOs.
c. The Government may require, as part of the proposal, a basic design solution showing a complete understanding of the requirement. Depending on the complexity of the particular TO, if the SOW does not include Government provided drawings, drawings may need to be included with the proposal, and be thorough enough to substantiate the proposed approach for the task. Also, designs shall clearly illustrate compliance with all applicable building and construction codes. In the RFQ, the Government will identify the extent of documentation that the Contractor shall include in the TO proposal. This documentation may include:
i. Design calculations to substantiate appropriate equipment or material selection/ sizing, component assembly, and proposed layout and sizing of utilities and structural elements. The Contractor shall (if applicable) supply the following calculation:
ii. Mechanical: HVAC load analysis and unit sizing, pipe sizing, and duct sizing.
iii. Electrical: Electrical system capacity, conductor, conduit, protective devices, and other equipment sizing.
iv. Structural: Structural system and foundation sizing.
v. Pavement/Site Work: Area run-off quantities, drainage capacities, and grading slopes.
