1Question Gov’t Response 9/12
With regards to border security, please confirm that Contractor is providing consultation to Host Nation personnel and not performing the physical patrolling or enforcement at the borders.What country is this in reference to? What line or paragraph number is referenced? We require more specifics in order to respond.As follow up to Government Q&A 41 released 9/12/14, the PWS makes general reference to Border Security in PWS 1.A.2.a (Introduction), 1.A.2.h (Mission Requirements), 1.A.3.b (Aviation Support Services) and 2.A (General Requirements). There is also a specific Reference in PWS 7.A (Pakistan-General Requirement” which states “The Aviation Support Services Program supports the US Embassy Country Team and INL-Post Islamabad in assisting the Government of Pakistan (GOP) in the Border Security Project.” Please confirm that Contractor is providing consultation to Host Nation personnel and not performing the physical patrolling or enforcement at the borders (physical presence at the border).INL/A confirms that Contractor is not performing the physical patrolling or enforcement at the borders (physical presence at the border).

Regarding the, "general reference to …" you are citing paragraph 'A' of the country sections (1-10). Those are precisely that, general and high-level scope to orient the reader to the overall mission in that country. Specific contractor requirements towards those ends are cited in sections C- G.

2The titles for key personnel represented in the new Attachment J.11, in the existing RFP Section H.13.2, and Attachment J.5 Pricing Tables do not match each other.Would the Government please clarify what key personnel titles Offerors should use or which document takes precedence?Key personnel are as cited in Section H - Special Contract Requirements, H.13 Contractor Personnel, H.13.2 Key Personnel, inclusive of Amendments 1-4.
3Can the Government clarify the position titles in Logistics? The qualifications for the Manager position are higher than for the Deputy Director role.This is corrected in ammendment #2. See revised attachment, J.11 – Amended Min Quals 10 Sept.
4MGT & Admin tab - are the minimum education requirements switched for the PM and PD?See revised attachment, J.11 – Amended Min Quals 10 Sept.
5MGT & Admin tab - several of the positions have erronous data in the minimum education and specific training fields. Please provide an updated document with correct data in all appropriate fields.See revised attachment, J.11 – Amended Min Quals 10 Sept.
6In the recent answers to questions, Question #165 asked the Government to please “clarify where in Volume II the Total Compensation Plan should be incorporated.” The Government stated the Total Compensation Plan should be included in Volume II.A.1, Personnel recruitment and management approach.Would the Government please allow the Total Compensation Plan to be excluded from page count and included as an attachment to Factor 1: Management of Program, Projects, and Contracts?No, the total compensation plan is included in the page count.
7A significant number of the government’s performance standards and Acceptable Quality Level (AQL) criteria requires performance at the zero defect level. In example is the PWS 3.C.102.c(1),(2) requirement to have “No instances of frustrated cargo”, “No instances of damaged cargo”, and “No instances of material waste” where the estimated quantity is 40,000 individual shipments per year.As the RFP Attachment J.2 contains significant penalty for failure to maintain standard, would the government consider requiring a more reasonable standard in accordance with FAR 52.246-4 (from RFP Clause E.1)? Across the AQLs it appears they are inconsistent with the FAR Clause.Yes zero damaged cargo is the standard.
8Can the Government provide amount and the number of times of LDs that have been assessed on the current contract? Data reflects an average of 26 Lost, Damage, Destruction, Theft (LDDT) cases per month.
Note: The new term as of 2012 is Loss vs LDDT.Not at this time. That data will come into play during phase-in and transition work.
9Can the Government provide a list of those losses with dollar amounts or at least the average dollar amount lost?Not at this time. That data will come into play during phase-in and transition work.
10The description of duties for the Director of Logistics, Procurement and Support Services says this position is "Responsible for overall contract performance." Is the Governments intent that this director be responsible for the entire program eliminating the previous Program Director?That depends on your approach. Ostensibly the Director of Logistics, Procurement and Support Services would be responsible for those requirements under their purview, as assigned by you.
11Was the removal of the Program Director and Program Manager min quals an oversight?
If the deletion of the Program Director and the Program manager was not an oversight, will the key list at H.13.2 be adjusted to reflect this change?Key personnel are as cited in Section H - Special Contract Requirements, H.13 Contractor Personnel, H.13.2 Key Personnel, inclusive of Amendments 1-4.
12Would DOS be willing to award a separate contract for security outside of WASS to provide the physical security requirement within Afghanistan? (Our concern stems from providing security for third party personnel, DOS and subcontractor personnel)No, INL/A does not intend to solicit a separate contract for security. The guard force requirement is limited in scope, applies only in Afghanistan, at a single site. This limited security activity is under the authority and guidance of Diplomatic Security (DS) to augment the U.S. Embassy's comprehensive security posture. In short, we bring the security force and they fall-in on the RSO established plan to augment the security Air Wing personnel, facilities and property.
13Would DOS be willing to award a separate contract for the aerial eradication requirement (Colombia) outside of WASS?No.
14Would DOS fully indemnify a Contractor for aerial eradication, if the contractor was/is unable to obtain pollution liability insurance?No. Please see Section I.3.14 and in particular paragraph (d) which states, "The Government's liability under paragraph (c) of this clause is limited to five percent (5%) of the funds remaining available in the annual appropriation for the Bureau of International Narcotics and Law Enforcement Affairs at the time a claim is adjudicated or settled. Nothing in this contract shall be construed as implying that the Congress will, at a later date, appropriate funds sufficient to meet deficiencies."
15Would it be acceptable to the DOS if the Contractor (i) could make the determination if performance would present unreasonable safety and security risk to the contractor or subcontractor personnel AND (ii) upon such determination, the Contractor would not be obligated to perform such work until the risk is mitigated? (Our concern stems from recent activities in Iraq)The contractor could risk being terminated for default for non-performance.
16In light of recent Q&A’s and amendments, would DOS consider extending the due date 2 weeks to October 16th?No extension will be given.
