About this file
This document is a Federal Acquisition Regulation (FAR) clause titled "VAAR 852.212-71 Gray Market and Counterfeit Items" dated February 2023. The clause establishes strict requirements for vendors providing equipment or supplies to a federal agency, specifically mandating that only new, original equipment manufacturer (OEM) items can be supplied. The document prohibits used, refurbished, remanufactured, gray market, or counterfeit items, defining gray market items as OEM goods sold outside authorized sales territories or by non-authorized dealers.
The clause requires vendors to be an OEM, authorized dealer, authorized distributor, or authorized reseller, which must be verified through an authorization letter or official documentation from the original manufacturer. Additionally, all software licensing, warranty, and service associated with the equipment/system must comply with the OEM's specific terms and conditions. The key objective is to ensure the procurement of authentic, high-quality equipment with proper authorization and original manufacturer support.
