About this file
This document is a federal contract clause addressing quality control requirements for equipment and supplies procurement. VAAR 852.212-71 mandates that all items provided must be new Original Equipment Manufacturer (OEM) products only, with explicit prohibitions against used, refurbished, remanufactured, or gray market items. Gray market items are defined as OEM goods sold outside authorized sales territories or through non-authorized dealers.
The clause establishes strict anti-counterfeiting requirements, prohibiting unlawful or unauthorized reproductions, substitutions, or alterations that are mismarked, misidentified, or misrepresented as authentic OEM products. This includes used items falsely represented as new or false identification of grade, serial number, lot number, date code, or performance characteristics. Vendors must be either an OEM, authorized dealer, authorized distributor, or authorized reseller, with authorization verified through documentation from the OEM. All software licensing, warranty, and service terms must comply with OEM terms and conditions.
