About this file

This is a federal contract clause document establishing requirements for the supply of new Original Equipment Manufacturer (OEM) items.

The clause prohibits the provision of used, refurbished, or remanufactured supplies or equipment/parts, as well as gray market items—defined as OEM goods sold outside authorized sales territories or by non-authorized dealers. Additionally, no counterfeit supplies or equipment/parts are permitted. Counterfeit items are defined as unlawful or unauthorized reproductions, substitutions, or alterations that have been mismarked, misidentified, or otherwise misrepresented as authentic OEM products or products from authorized sources, including authorized aftermarket manufacturers. This definition extends to used items falsely represented as new and false identifications of grade, serial number, lot number, date code, or performance characteristics. Vendors must be an OEM, authorized dealer, authorized distributor, or authorized reseller, with authorization verified through a letter or other documentation from the OEM. All software licensing, warranty, and service associated with the equipment or system must comply with OEM terms and conditions.
