About this file
This is a federal contracting clause document (VAAR 852.212-71) addressing gray market and counterfeit item prohibitions, effective February 2023.
The clause establishes three primary requirements for vendors supplying equipment and parts. First, all items must be new Original Equipment Manufacturer (OEM) products only; used, refurbished, or remanufactured supplies and equipment/parts are prohibited, as are gray market items (OEM goods sold outside authorized sales territories or by non-authorized dealers). Second, counterfeit items are strictly forbidden, including unlawful or unauthorized reproductions, substitutions, or alterations that are mismarked, misidentified, or misrepresented as authentic items, as well as used items falsely represented as new or items with falsely identified grade, serial number, lot number, date code, or performance characteristics. Third, vendors must be an OEM, authorized dealer, authorized distributor, or authorized reseller for the proposed equipment/system, with authorization verified by an authorization letter or other documentation from the OEM. All associated software licensing, warranty, and service must comply with OEM terms and conditions.
